John Miller of Grimston 1831 Will

There are two copies of this will at the Archives, the original and the probate copy.  The codicil does not seem to be any longer with the will but it is in the probate copy

I John Miller of Grimstone in the county of Leicester Grazier do hereby revoke all former wills by me made and do declare this to be my last Will and testament

I direct all my just debts funeral and testamentary expences be first paid

I Give and bequeath all my Personal Estate and effects whatsoever subject in the first place to the payment of my said debts funeral and testamentary expences unto my two friends The Reverend John Wilson of Broughton Sulney in the county of Nottingham Clerk and Thomas Hemsley of Kirby Bellars in the said county Grazier their executors and administrators upon trust nevertheless that they and the survivor of them his executors and administrators shall permit my dear Wife Mary Miller to have the free use and enjoyment thereof for the term of her natural life

And from and immediately after her death then I Give unto my six Children by my former Wife vizt James John Elizabeth Ann Mary and Sarah Miller the Sum of Fifty pounds apiece

And as to the residue of my said personal estate after payment of the said six legacies above bequeathed I Give the same unto my two Children by my present Wife vizt Hannah and Eleanor Miller their executors and administrators in equal shares

And I do appoint the said John Wilson and Thomas Hemsley joint executors of this my Will

In Witness whereof I have hereunto set my hand and seal this Tenth day of November 1829

Signed sealed published and declared by the said John Miller the testator as and for his last Will and testament in the presence of us who have at his request and in his presence and in the presence of each other set our hands as Witnesses to the due execution thereof

Whereas I John Miller of Grimston in the County of Leicester Grazier have made and duly executed my last Will and Testament in Writing bearing date the 10th day of November 1829 now I do hereby declare this present Writing to be a Codicil to my said Will and I do direct the same to be annexed thereto and to be taken as part thereof

And whereas I did in my said Will Give Unto my six Children by my former Wife vizt James John Elizabeth Ann Mary and Sarah Miller the sum of Fifty pounds apiece I now will and direct that in case any of Money which I have lent upon Bond should be lost then and in such case the said Legacies of Fifty pounds to my said six Children shall be reduced by my Executors named in my last Will in proportion to such loss as may be sustained but not otherwise

And I do hereby ratify and confirm my said Will in all the other particulars thereof

In witness whereof I the said John Miller have to this Codicil set my hand and seal this 3rd day of August in the year of our Lord 1830

Let a Probate be made to Thomas Hemsley heretofore of Kerby Bellars but now of Grimston in the County of Leicester Farmer and Grazier one of the Executors named in the will of the deceased with power of making the like Grant to the Reverend John Wilson of Broughton Sulney in the County of Nottingham Clerk the other Executor when he shall apply for the same

He the said Thomas Hemsley having been duly Sworn as well to the faithful Execution of the Will and Codicil marked (A) as that the Goods Chattels and Credits of the deceased within the Peculiar of Rothley did not amount in value to the Sum of Two hundred Pounds
