This is the last Will and Testament of me Richard Mason of the Parish of Stathern in the County of Leicester, Carpenter

First I direct that all my just Debts funeral and testamentary expenses be paid by my Executors hereinafter named

I Give and bequeath unto my Executors upon Trust my undivided share of Freehold Land called the Pasture field lying and being the said Parish of Stathern to dispose of to my eldest son Richard Mason his heirs executors and administrators to be delivered to him when my youngest child then living shall have attained the age of Twenty one years and also at the said time the Sum of Fifty Pounds to be paid to him subject to one third of the Sum of Ten Pounds annually afterwards bequeathed to my Wife

I Give and bequeath unto my Executors Upon Trust all my Freehold Houses and appurtenances belonging thereto situate in the Parish of Stathern aforesaid to dispose of to my son Francis Mason his heirs Executors and administrators to be delivered to him when my youngest child then living shall have attained the age of Twenty one years and also at the said time I direct the Sum of One Hundred Pounds to be paid to him subject to one third of the Sum of Ten Pounds annually hereinafter bequeathed to my Wife

I Give and bequeath unto my Executors Upon Trust The Sum of Two Hundred and fifty Pounds to be paid to my Daughter Sarah Mason when my youngest child then living shall have arrived at the Age of Twenty one years subject to one third of the Sum of Ten Pounds annually hereinafter bequeathed to my Wife

I further direct my Executors Upon Trust to let my Freehold Houses and Land bequeathed to my Sons Richard and Francis Mason and also invest the several Sums of Money bequeathed to my aforesaid sons and my Daughter Sarah Mason in the securities they consider best and I direct that the Rents and Interest and annual produce arising therefrom shall be paid and applied in and towards the maintenance and support of my Wife and children until my children shall severally and respectively attain the said age of twenty one years and in case my Wife Elizabeth Mason should marry before my youngest child shall attain the said age of twenty one years then my said Wife shall not be permitted to receive any further payment therefrom and in case any or either of my said children should happen to die before their said legacies shall become payable then I Give and bequeath the share or shares of him, her, or them so dying as aforesaid unto the survivor or survivors of them equally as the case may be

I Give and bequeath unto my Executors Upon Trust to permit my Wife to have the Sum of Ten Pounds annually after my youngest child then living shall have attained the age of Twenty one years for and during the term of her natural life providing she shall so long continue my Widow to be paid quarterly the sum of Two Pounds ten shillings to be paid every quarter from the Freehold Houses, Land and personal Estate before mentioned and also the remainder of my Estates and effects of what nature or kind soever not hereinbefore disposed of after the payment of my just debts, funeral and testamentary expenses and the aforesaid legacies I give full power to my Executors to dispose every part thereof amongst my children as they deem most proper and I do hereby nominate and appoint my Kind friends John Mason my Brother and Francis Welbourn my Wife’s Father to be my Executors for carrying this my Will and Testament into effect

And I do hereby declare that my said Executors shall and may at all times our of the first monies that my come to their hands reimburse and indemnify themselves and that neither of them shall sustain loss nor be answerable for my monies or loss which may happen to the said trust premises

And I do hereby revoke and make void all former Wills and Testaments by me at any time heretofore made and do declare this my last Will and Testament

In Witness whereof I the said Richard Mason the Testator have to this my last Will and Testament set my hand and seal this twenty second Day of October in the year of Our Lord One Thousand Eight Hundred and forty one

Francis Welbourn of Plungar in the County of Leicester, labourer, the sole surviving executor in this will named, was duly sworn to the truth and faithful performance thereof, as usual, and that the goods, chattels, and credits of the said deceased, do not amount in value to the sum of Four Hundred and Fifty Pounds, and that the deceased died on the twenty seventh day of October last past

On the 6th Augt 1842 Orig Will exhibited before the Rev Jemson Davies Clerk MA and Surrogate and Probate decreed to pass Seal in the presence of

In the Court of the Commissary of the Archdeaconry of Leicester Appeared personally Nathaniel Kemm of Eaton in the County of Leicester Schoolmaster and made oath that he is one of the subscribed witnesses to the last will and Testament of Richard Mason late of the Parish of Stathern in the County and Archdeaconry of Leicester Carpenter deceased bearing date the twenty second day of October now last past and now hereunto annexed and marked with the letter (A) and he further made oath that on the twenty second day of October aforesaid the said Testator duly executed his said last will by signing his Name at the foot or end thereof and sealing publishing and declaring the same as his Will in the presence of this Deponent, and of Thomas Barker of the Parish of Stathern in the County and Archdeaconry of Leicester aforesaid, labourer the other subscribed Witness thereto who were then together present at the same time with the said deceased And this Deponent and the said Thomas Barker thereupon attested and subscribed the said Will in the presence of the said Testator and of each other
