John Mason of Stathern 1842 Will

This is the last Will and Testament of me John Mason of the Parish of Stathern in the County of Leicester Carpenter

First I will that all my just Debts funeral and Testamentary expenses be paid by my Executor hereinafter named

I Give and bequeath unto my Brother William Mason all that my Copyhold estate with the House Land and appurtenances thereunto belonging situate in the Parish of Stathern aforesaid and now in my occupation to have and to hold the said Copyhold Estate unto him my said Brother William Mason his heirs and assigns for ever

I Give and bequeath unto my late Brother Richard Mason’s eldest Son Richard Mason all that my undivided share of Freehold Land called the Hills pasture situate in the parish of Stathern aforesaid with the appurtenances thereunto belonging unto him my said Nephew Richard Mason to have and to hold the same his heirs and assigns for ever but not to have it until he has attained the age of twenty one years and I direct that the profits arising therefrom after my decease during his minority if I should happen to die before he has attained the said Age of twenty one years shall then be applied towards his maintenance and education until he shall attain the said age of twenty one years

I Give and bequeath unto my Sister Mary Watkin The Sum of One Hundred and fifty Pounds to be paid by my Executor within twelve calendar months after my decease

I Give and bequeath unto my Brother Jervase Mason an annuity or annual sum of Eight Pounds for and during the term of his natural life the first payment to be made at the expiration of twelve calendar months after my decease

I Give and bequeath unto my Sister Ann Clarke an annuity or annual sum of Seven Pounds for and during the term of her natural life the first annual payment thereof to be made at the expiration of twelve calendar months after my decease

And as to all the rest residue and remainder of my estate and effects whatsoever and wheresoever and of what nature or kind soever not hereinbefore disposed of after payment of all my just debts funeral and testamentary expenses and the aforesaid legacies I Give devise and bequeath the same and every part thereof unto my aforesaid Brother William Mason and I do hereby nominate constitute and appoint my said Brother William mason sole Executor for carrying this my last Will into effect and I do hereby revoke and make void all former or other Wills and Testaments heretofore made I do declare this to be my last Will and Testament

In Witness whereof I the said John Mason the Testator have to this my last Will and Testament set my hand and seal this twenty seventh Day of October in the Year of Our Lord One Thousand Eight [“hundred” missing] and forty one

Signed Sealed published and declared by the said Testator John Mason as and for his last Will and Testament in the presence of us who at his request and in his presence have signed our names as Witnesses to the same

William Mason of Stathern farmer the sole executor in this will named was duly sworn to the truth and faithful performance thereof as usual and that the goods chattels and credits of the deceased without deducting any debts owing by him therefrom do not amount in value to the sum of three hundred pounds and that the deceased died on the third day of November last

In the Court of the Commissary of the Archdeaconry of Leicester Appeared personally Nathaniel Kemm of Eaton in the County of Leicester School Master and made oath that he is one of the subscribed witnesses to the last will and Testament of John Mason late of the Parish of Stathern in the County and Archdeaconry of Leicester Carpenter deceased bearing date the twenty seventh day of October last past now hereunto annexed and marked with the letter (A) and he further made oath that on the twenty seventh day of October aforesaid the said Testator duly executed his said last will by signing his Name at the foot or end thereof and by sealing publishing and declaring the same as his Will in the presence of this Deponent, and of John Cobley of Stathern aforesaid Farmer and Grazier and George Braithwaite of the same place Farmer the other subscribed Witnesses thereto who were then together present at the same time with the said deceased And this Deponent and the said John Cobley and George Braithwaite thereupon attested and subscribed the said Will in the presence of the said Testator and of each other

On the fourth day of May in the year of our Lord One thousand eight hundred and forty two the said Nathaniel Kemm was duly sworn at Melton Mowbray in the County and Archdeaconry of Leicester to the truth of the aforegoing Affidavit
