John Mason of Eaton 1810 Will

This is the last Will and Testament of me John Mason of Eaton in the county of Leicester Grazier as follows

First I Will that all my just Debts Funeral and Testamentary Expences be fully paid

I Give and Devise All that my messuage or tenement Yard Garden Outbuildings and premises situate standing lying and being in Eaton aforesaid with their and every of their Appurtenances unto my son Thomas Mason his heirs and assigns for ever Subject and chargeable nevertheless as hereinafter mentioned

I will and direct that my Wife Elizabeth Mason shall reside in my now dwelling house at Eaton aforesaid with my said Son Thomas Mason during such part of her natural life as she shall continue my Widow and live upon good and peaceable terms with my said Son Thomas Mason but in case my said Wife and said son Thomas Marson cannot agree to live peaceably together, and my said Wife resides elsewhere, Then I give and devise unto my said Wife Elizabeth Mason and her Assigns for and during the term of her Widowhood only One Annuity or yearly sum of five pounds issuing and payable out of the said messuage or tenement and premises and to be paid to her half yearly (that is to say) the fifth day of April and the tenth day of October in every year the first payment thereof to begin and be made on such of the said days as shall first and next happen after my said Wife shall have refused to live with my said Son Thomas Mason as aforesaid And I give unto my said Wife such and the same power of enforcing and obtaining payment of the said Annuity of five pounds as Landlords have for the enforcing and obtaining payment of rent in arrear

And I further Will and direct that my Daughter Mary Mason shall board and lodge with my said Son Thomas Mason without her paying any thing for the same so long as she thinks proper in case she continues single and unmarried

I give and devise All my Closes lands hereditaments and premises situate lying and being in the lordship of Eaton aforesaid or elsewhere in the Kingdom of England with their and every of their Appurtenances unto my said Son Thomas Mason his heirs and assigns for ever

I Give unto my three Children John Mason, Elizabeth Mason, and the said Mary Mason the sum of ten pounds apiece which I will shall be paid to them and each of them within six months after my decease by my Executor

I Give and bequeath All my household goods other goods stock Cattle Chattels rights credits ready money securities for money and all other my personal Estate and Effects of what nature kind or quality soever the same may be unto my said Son Thomas Mason his Executors Administrators and Assigns And I do hereby nominate constitute and appoint my said Son Thomas Mason Sole Executor of this my last Will and testament hereby revoking all former Wills by me made

In Witness whereof I the said John Mason the testator have hereunto set my hand and Seal the twenty second day of February one thousand eight hundred and nine
