This is the last Will and Testament of me William Marriott of Long Clawson in the County of Leicester Gentleman

All those my two Messuages or Tenements with the Yards Gardens Outbuildings and Appurts thereunto belonging and also all those several Closes or inclosed Grounds situate lying and being in Long Clawson aforesaid containing altogether one hundred and fifty four acres or thereabouts (be the same more or less) and now in the occupations of my Nephew Hayes Marriott and Thomas Harby Wheelwright and their assigns and all other my Real Estate in Long Clawson aforesaid and also one undivided moiety or half part of all those several Closes or Grounds inclosed situate lying or being in Scalford in the said County of Leicester containing together forty eight acres or thereabouts (be the same more or less) and now in the occupation of Richard Taylor I give and devise unto my said Nephew Hayes Marriott his heirs and assigns for ever

And all those my three several Closes or Grounds enclosed situate lying and being in Humberstone in the said County of Leicester containing together fifty one acres or thereabouts more or less & also all that my Close or Ground inclosed situate lying and being in Thurnby in the said County of Leicester containing seven acres and an half and adjoining the said last mentioned Closes and occupied therewith by my said Nephew Hayes Marriott and all other my Real Estate in Humberstone and Thurnby aforesaid and also one undivided half part of all those the said several Closes or Grounds inclosed situate lying & being in Scalford aforesaid containing together forty eight acres or thereabouts (more or less) and now in the occupation of the said Richard Taylor I give and devise unto my Nephew John Marriott his heirs and assigns for ever

And all that my undivided moiety or half part of and in all those my several Closes or Grounds inclosed situate lying and being in Hose in the said County of Leicester containing altogether one hundred and twelve acres or thereabouts (more or less) now in the respective occupations of my said Nephew Hayes Marriott and Mrs Elizabeth Huccaby and all other my Real Estate in Hose aforesaid I give and devise unto my Nephew William Morpott Marriott his heirs and assigns for ever

And I give all Mortgage and Trust Estates what may be now vested in me unto the said John Marriot, Hayes Marriott and William Morpott Marriot their heirs executors admors and assigns subject to and upon the equities and trusts affecting the same

And all my monies securities for money Personal Estate and Effects whatsoever and wheresoever after payment of my just debts funeral and testamentary expences I give and bequeath unto my said three Nephew John Marriott Hayes Marriott and William Morpott Marriott equally to be divided between them share and share alike

And I appoint my said three Nephews John Marriot Hayes Marriott and William Morpott Marriott joint Executors of this my last Will and Testament hereby revoking all former and other Wills by me made

In Witness whereof I the said William Marriott the testator have to this my last Will and Testament contained in two sheets of paper to each sheet thereof set my hand and seal this third day of June one thousand eight hundred and thirty one

Whereas I the said William Marriott of Long Clawson in the County of Leicester Gentleman have duly made and published my last Will and Testament in writing bearing date this third day of June one thousand eight hundred and thirty one now I do hereby direct this writing purporting to be a Codicil to be annexed and taken as part of my last Will and Testament

I give to the said John Marriott & Hayes Marriott the sum of four hundred pounds Upon trust that the said John Marriott and Hayes Marriott or the survivor of them or the executors admors or assigns of such survivor do and shall place out and invest the same on Government or Real securities at Interest with power to vary the securities at pleasure and do and shall pay the yearly interest and dividends thereof to my niece Frances the wife of George Marriott of Melton Mowbray in the said County of Leicester Draper for her life for her sole and separate use whose receipt shall be a good discharge for the same and so that the same may not be subject to the control debts or engagements of her present or any future husband and that such interest and dividends shall not be sold or anticipated by my said Niece whilst she is under Coverture

And from and after the decease of my said niece Frances Marriott Upon trust that they my said trustees or trustee do and shall stand possessed of the said sum of four hundred pounds and the securities for the same and the interest and produce thereof In trust for all or any one or more of the Child and Children of my said niece Frances Marriott begotten or to be begotten for such Estate and Estates and in such manner as my said niece notwithstanding any Coverture shall by Deed or Will appoint and in default of such appointment In trust for all and every the Child and Children of my said niece Frances equally to be divided between them if more than one and his her and their respective executors admors and assigns but if any of such Children shall die under the age of twenty one years without having been married then the share or shares of him her or them so dying as well original as accruing by virtue of this my Will of and in the same monies and premises shall be In trust for the others and other of them equally between such others of them if more than one and their his or her executors admors and assigns but shall not be vested sooner than their his or her original shares shall become vested and if there shall be such child of my said niece who shall live to take a vested interest then upon trusts as she shall be Deed or Will appoint and for default of such appointment Upon trust for my three Nephews John Marriott Hayes Marriott and William Morpott Marriott equally and I direct that the interest of the said trust monies after my said nieces death until the same shall become payable as aforesaid shall be applied for the maintenance and education of the Child and Children presumptively entitled thereto according to their respective shares and that the unapplied Interest during as aforesaid shall be accumulated and the same and the accumulations thereof be advanced to the Capital share or shares from which the same shall arise

And I ratify and confirm my said Will in all other respects

In Witness whereof I the said William Marriott the Testator have to this Codicil contained in this and part of the preceding sheet of paper set my hand and seal this third day of June one thousand eight hundred and thirty one
