This is the last Will and Testament of me Rosamond Marriott of Old Dalby in the County of Leicester Spinster

I direct that the following Articles shall not be sold, but shall be disposed of in manner hereinafter mentioned (vizt) My Wearing apparel, my Jewelry, Watch and Chain, my Silver plate, best musical Box and two tea caddies, my best china, my Needle Work including that which is made up, a likeness of my Friend, also three Bibles, a Family Bible and a Bible belonging to my Friend, a pair of Lusties, a tea pot, Sugar Basin and Cream Jug

I also bequeath all my Furniture, Farming Stock, Money, and all other my personal Estate (except the articles before mentioned) to William Bowley of Nether Broughton Miller and Robert Rippin Jackson of Old Dalby aforesaid Farmer my Trustees and Executors Upon Trust to sell such part thereof as shall not consist of Money and with my Money and from that which shall arise by such Sale or Sales, first discharge my Debts (except a Mortgage Debt) Funeral and Testamentary Expences and 2ndly apply the Residue in part discharge of the Mortgage Money I owe on my real Estate

I give and devise all my Messuage or Tenement Gardens Closes and real Estate with their appurtenances in Old Dalby aforesaid and all other my real estate (if any) unto the said William Bowley and Robert Rippin Jackson and their heirs upon the Trusts following

To receive the Rents thereof until my Son Herbert Marriott shall return to England and apply part of such Rents in keeping down the Interest of the said Mortgage and then placing the remainder in some Bank to accumulate till disposal of as hereinafter mentioned and on my said Son’s returning to England I direct that the accumulated Rents shall be paid to him, and that my said Trustees shall convey to him his heirs and assigns all my said real Estate, and also on such Return hand over to him all the said articles first mentioned in my Will

Provided always that if my said Son is not heard of within the term of Ten Years from my death and if heard of does not return to England or send a power of Attorney for the receipt of the Rents and the accumulation thereof then I direct my said Trustees or the survivor of them to pay the Rents and the accumulations thereof to my Nephew John Marriott on his attaining the age of 21 years, and to convey the said real estate to the said John Marriott his heirs and assigns for ever and also that they hand over to him all the said Articles first named in my Will

I give to each of my said Trustees a Legacy of ten pounds for their trouble to be paid 12 months after my death

And I appoint the said William Bowley and Robert Rippin Jackson Executors of my Will and I hereby revoke all former Wills hereinbefore made by me

This is Codicil to the above Will of me the above named Rosamond Marriott

I give all my Needle Work including that which is made up to my Sister Hannah Morris instead of to the person named in my Will

I revoke the devise and bequest of my real Estate and the Articles first named in my Will and the accumulation of the Rents and instead thereof provided that if my Son is not heard of within the Term of ten years from my death, and if heard of does not return to England or send a power of Attorney for the receipt of the rents and accumulations thereof I give the same to my Nephew Frank Baxter Morris and direct my Trustees to convey to him the said real Estate named in my Will (vizt)

To the said Nephew Frank Baxter Morris his heirs and assigns for ever and also that that they hand over to him all the said Articles first named in my Will, except the said Needle Work and Silver plate which I bequeath to my said Sister Hannah Morris and to my eldest Niece my Watch, and my Trinkets and wearing Apparel to be divided between my said eldest Niece Elizabeth Green and her Sister Sarah Milton Green equally and I direct that nineteen Guineas shall be paid out of the accumulation of Rents to my Brother John Marriott

And subject to the alterations made by this Codicil I hereby confirm my said Will

Proved at Leicester with a Codicil the tenth day of April 1874 by the Oaths of William Bowley and Robert Rippin Jackson the Executors named in the Will to whom Administration was granted

The Testatrix Rosamond Marriott was late of Old Dalby in the County of Leicester Spinster and died on the first day of February 1874 at Old Dalby aforesaid

Under £450.
