In the Name of God Amen I John Marriott of Claxton als Long Clawson in the County of Leicester Yeoman being Sick and Weake in Body but of perfect Mind and Memory praised bee Almighty god for it Doe make and ordeyne this my Last Will & testament in manner and forme following that is to say

Imprimis I Comitt my Soule into the hands of Almighty God and my Spirit to God that Gave it mee And my body I Comitt to the Earth from whence it Came to be Decently Buryed att the Discretion of my Executor

And as for my Goods and Chattles Lands & tenements whatsoever of mee the said John Marriott I give devise and bequeath the Same As followeth

Item I give devise & bequeath to John Marriott my Sone All and Singular my Messuages Closes Lands tenements & hereditaments with theire and every of theire Appurtenances of what nature kind or Quallity soever the Same may be which I am now possessed of or anywayes shall bee possessed in possion or Revertion or any otherwise how soever And which are Scituate Standing Lyeing and being within the Severall towneshippe feilds and Libertys of Claxton als Long Clawson aforesaid Hose and Wartnaby all in the said County of Leics or elsewhere in the Kingdome of England To have and to hold the sd Messuages Cottages Lands tenements & Hereditaments with theire and every of their appts and … and … thereof unto him the said John Marriott my Sonne and his heires and assignes forever

Item I Give and Bequeath unto My kinsman John Marriott of Knipton in the County of Leicester the sume of twenty shillings of good and Lawfull money of England for and dureing the full End and tearme of his Naturall life to be paid unto him the said John Marriott my kinsman Yearly or his assignes att foure most Usueall feasts or days of paymt in every of the said yeares by my Sonne John Marriott his heires & assigns by even and Equall porcons without the deduction of any taxes whatsoever out of the Rents Issues and profitts of a Certeyne Close of Meadow & pastures ground with its appts Lyeing and being within the feilds Libtyes and precincts of Wartnaby in the said County of Leic viz att Lady day MidSumer Michmas and Christmas In every of the said years the first payment thereof to beguin and bee made att or upon which of the sd foure days shall happen after the death of mee the sd John Marriott And I doe hereby chardge the sd Closse in Wartnaby Called by the name of the Woulds Closse Lyeing with the feilds & Libtyes of Wartnaby aforesaid with the payment of the same as aforesd

Item I give unto the said John Marriott my kinsman all my weareing apparel both woollen & linnen which I shall dye possessed of at the tyme of my death

Item I give and bequeath unto the poore of Claxton the sume of tenne shillings of Lawfull English monye to bee paid unto them att the tyme of my Buryall by my Extor hereafter named

Item I given unto my kinsman Thomas Marriott of Knipton aforesd the sume of five pounds of Lawfull English Money to be paid unto him by my Extor hereafter named within 3 Months after my decease

Item I give and bequeath Unto my kinsman Richard Marriott of Knipton aforesd the sume of twenty pounds of Lawfull English money to bee paid unto him within twelve Months after my decease by my Extor hereafter named

Item I give and bequeath unto my kinswoman Rebecca Marriott the Sume of five shillings of Lawfull English money to bee paid Unto her by my Extor hereafter named within Twoe Months after my decease

Item I give and bequeath unto my twoe Daughters in Law Grace and Mary Fawkes the sume of One Shilling apeece of Lawfull English Money to bee paid Unto them within one Month after my decease by my Extor hereafter named And I doe hereby Acquitt them of and from the paymt of all sume and sumes of money whatsoever which shall bee due to mee or my Extor hereafter named in My Right for the board Cloathing and Educating of my said two daughters in Law Upon Condicon that they shall not any ways Clayme or demand any other Sume or Sumes of money whatsoever of my sd Executor as theire share or porcon of my said personall estate And my Will and Mind further if that if the sd Grace and Mary my said twoe daughters shall Clayme of my said Executor any Sume or Sumes of money … as theire share and porcon of any parte or parcell of my said personall Estate Then I doe hereby Empower my sd Extor to aske demand and Receive of and from my sd two Daughters in Law all such Sume & Sumes of mony as shall bee at my Death due Unto mee for theire boarding and Cloathing as aforesd

Item I give and bequeath unto my sd Sonne John Marriott his extors and adtors all my Cattle horses bease sheepe swine and other Utensills of Husbandry which shall bee in my possion or the possion of any other person or persons whatsoever for my use and shall bee & kept att the tyme of my death in and Upon the farme or tenemt with thapts in Claxton aforesd where I now Inhabite and dwell And my Will and Mind is that my said Sonne John Marriott shall permitt and suffer my Grand daughter Elleanor Fawkes to take to her sole use and benefitt twoe of the best sheepe that shall bee at that tyme upon the said farme & pastures thereunto belonging without any trouble or Molestacon of my said Executor hereafter named

Item I Give and bequeath unto my said Sonne John Marriott One Coffer which stands now in the parlour att my bedd foote which I now Lye in which is conteyned my deeds and writeings which Concerne my Lands & tenemts I have herein before given And which said Deeds and writeings I hereby also give & bequeath Unto him the sd John Marriott my Sonne and all other things whatsoever which is Conteyned in the sd Coffer I give and bequeath unto my said Sonne John Marriott as aforesd

Item I give and bequeath Unto my Loveing wife Elizabeth All the Rest of my Household goods of what Nature kind or Quallity soever the same bee which shall bee in my possion in the house where I now Live and which are herein before by Mee Unbequeathed And alsoe All the Cropp of Corne Grayne & Hay which shall bee groweing Coming or bee upon the farme I now Rent of my Sonne in Law or which shall att the tyme of my Death bee thereupon Lyeing and being within the yards and Barns to the sd farme house belonging and which thereupon belongs to the sd farme house I now Live in Shee the sd Elizabeth my now wife paying and dischargeing unto the Owner thereof all such Sume & Sumes of mony As shall bee due at the tyme of my death for the Rent or Arrears thereof And my Will and Mind is farther that If my said wife Elizabeth shall not pay the sd Rent for the Arrears due Upon the sd Land and Farme I doe hereby give all the sd Goods Chattles Corne and Grayne heretofore given hereby to my sd Wife Unto my said Sonne John Marriott the better to Enable him to pay the same And doe hereby particularly Revoake my Bequest made by this My will Unto her my sd wife And My Will and Mind further is And doe hereby declare that if my sd Wife Eliz shall att any tyme hereafter pretend or Clayme to have any parte or Share of my personall estate More than I doe hereby Appoynte her then my will and Mind further is And I doe hereby Revoake my sd  Legacye Unto her and Give the same unto my sd Sonne John Marriott whom I make full and Sole Executor of this my Last Will and testamt and give him all other my personall estate whatsoever hereby be mee Unbeqeuathed And Revoake all other my … Wills either concerning Lands or tenemts or personall estate which I have heretofore at any tyme made

In wittnesse hereof I have hereunto Sett my hand & Seale the 10th day of June 1701
