This is the last Will and Testament of me William Mann of Wymondham in the County of Leicester Gentleman

I direct all my just debts personal and testamentary expences to be fully paid

I give and devise All those three Messuages or Tenements yards Gardens outbuildings and appurtenances thereto belonging situate in the Village of Wymondham aforesaid in the several occupations of Mrs Dymock Robert Baker and John Timson unto my two Sons George Mann and William Mann their heirs and assigns Upon trust to receive the rents issues and profits arising therefrom and pay the same over Unto my affectionate Wife Sarah Mann and her assigns or allow her to receive the same for her benefit for and during the term of her natural life

And as soon as convenient after her decease Then Upon Trust that they the said George Mann and William Mann or the survivor of them or the heirs or assigns of such survivor do and shall sell the said Messuages or Tenements hereditaments and premises aforesaid for the most money that can be gotten for the same and with the monies arising therefrom Upon Trust to pay and divide the same amongst my Residuary Legatees or their issue as the case may be as hereinafter mentioned

I also Give and bequeath unto the said George Mann and William Mann their executors or administrators the sum of One thousand pounds Upon trust to place the same out on good security and with the interest arising therefrom to pay the same Unto my said Wife Sarah Mann during her natural life And from and after her decease Then I Give and bequeath the monies to arise from the sale of the said Messuages or Tenements hereditaments and premises and the said principal sum of One thousand pounds Unto and amongst my Residuary Legatees namely my two Sons and three Daughters George, William, Ellen, Elizabeth and Mary But I expressly direct that the same shall be divided and apportioned into proportionate shares according to the amount of the several Legacies hereinafter bequeathed to them And in case any or either of them shall happen to die before their shares shall became payable by virtue of this my will having lawful issue Then I direct that the share or shares of him her or them so dying shall go to and be divided equally amongst the issue of such deceased child or children such children nevertheless only taking amongst them what would have been their deceased parents share if living

I Give and devise All that my messuage or tenement and hereditaments situate in Wymondham aforesaid occupied by Mrs Orson And also all those several Closes or grounds inclosed of pasture Meadow and Arable Land lying in the Lordship of Wymondham aforesaid containing eighty six Acres or thereabouts in my own possession And also all that Messuage or Farm house Yard Garden Orchard and several closes of pasture Arable and Meadow land situate in the Lordship of Hickling in the County of Nottingham containing One hundred and forty three Acres or thereabouts in the occupation of [blank] Wild And all other my Real Estate whatsoever and wheresoever situate in the Kingdom of England with their and every of their appurtenances unto my said two Sons George Mann and William Mann their heirs and assigns Upon trust as soon as convenient after my decease to sell the same or any part or parts thereof either by public auction or private contract and in one or more lots and from time to time as they or the survivor of them may think proper and most advisable and to apply the monies to arise from such sale or sales in or towards the payment of the several legacies hereinafter bequeathed

Also I Give and bequeath all my personal Estate and effects of every kind of which I shall die possessed whether in possession reversion remainder or expectancy unto the said George Mann and William Mann or the survivor of them or the executors or administrators of such survivor Upon trust to convert such parts thereof into money as may not consist of money and to apply my said personal Estate And also the monies so to arise from the sale or sales of my said real Estates First in payment of my debts legacies funeral and testamentary expences And as to all the rest residue and remainder thereof I Give and bequeath the same unto and amongst my said Residuary Legatees my two Sons and three Daughters names George William Ellen Elizabeth and Mary But I expressly direct and it is my Will that the same shall be divided and apportioned into proportionate shares according to the amount of the several legacies hereinafter bequeathed to them And in case any or either of them shall happen to die before their shares shall become payable by virtue of this my Will having lawful issue Then I direct that the share or shares of him her or them so dying shall go to and be divided equally amongst the issue of such deceased child or children such children nevertheless only taking amongst them what would have been their deceased parents share if living

I Give and bequeath unto my said two sons George and William Mann One thousand eight hundred pounds apiece And unto my two daughters Ellen and Elizabeth I Give the sum of One thousand two hundred pounds apiece And unto my daughter Mary I Give the sum of Eight hundred pounds All which said several legacies I will shall be paid at the end of twelve months after my decease But in case any of my said Legatees shall depart this life before their legacies become payable leaving lawful issue then I direct that the share or shares of him her or them so dying shall go to and be divided equally amongst the issue of such deceased Legatee or Legatees such issue however only taking amongst them what would have been their deceased parents share if living

And in case any of the said Legatees shall die before their legacies become payable without leaving lawful issue Then I will that the legacies of such of them so dying shall sink into and form part of my residuary personal Estate and be divided in the same manner as my residuary Estate is hereinbefore directed to be divided

I Give unto my said two Sons George and William Mann the sum of One thousand and four hundred pounds Upon trust to place the same out on good security and with the interest arising therefrom to pay or apply the same to or for the benefit of my Son John Mann during his life And after his decease I Give the said legacy of One thousand four hundred pounds unto and equally amongst all his children (if any) lawfully begotten share and share alike

I Give and bequeath unto my said two Sons George and William Mann the further sum of One thousand pounds Upon trust to place the same out on good security and with the interest arising therefrom from time to time to pay or apply the same to or for the benefit of my Daughter Sarah Jane during the term of her natural life and after her decease then I Give the said principal sum of One thousand pounds unto and equally amongst all her children (if any) share and share alike Provided nevertheless and it is my Will that in case my said Son John or my said Daughter Sarah Jane shall either or both of them depart this life without leaving issue Then and in that case I hereby direct that the Legacy or Legacies of either or both of my said two children so dying without issue as aforesaid shall go to and be equally divided amongst all my children then living or the issue of any one or more of such of my children as may be then dead The issue nevertheless of such of my deceased child or children only to take equally amongst them what would have been their deceased parents share if living

I do hereby appoint my said two Sons George Mann and William Mann Guardians and Trustees for such of my children who do not receive their respective shares and also Joint Executors In trust of this my last Will and Testament hereby revoking all former Wills by me made

And for facilitating the sale or sales of my said Real Estates and the indemnity of the purchaser or purchasers thereof I do declare that the receipt or receipts of the said George Mann and William Mann or the survivor of them or the heirs or assigns of such survivor shall be good and sufficient discharge and discharges to the purchaser or purchasers of all or any part of my said Real Estate who shall not be answerable or accountable for any loss misapplication or nonapplication of the said purchase monies or any part thereof

And lastly my Will further is that my said Trustees shall be at liberty out of the said Trust monies and premises to retain all necessary costs charges and expences they may be at or be put to in executing the aforesaid Trusts and that neither of them shall be answerable for any Banker Broker or other person or persons where the said Monies may be invested or for any loss which may happen thereto unless the same happen through his or their wilful neglect or default not one for the other but each for his own wilful acts deeds neglects and defaults only

In Witness whereof I the said William Mann the Testator have to this my last Will and Testament written on five sheets of paper to each of which I have set my hand this twenty third day of January One thousand eight hundred and fifty seven

Signed published and declared by the said William Mann the Testator as and for his last Will and Testament in the presence of us who have at his request in his presence and in the presence of each other at the same time set our hands as witnesses thereto the erasures on the eleventh fourteenth and sixteenth lines from the top of the fourth page being first made

I William Mann of Wymondham in the County of Leicester Gentleman declare this to be a codicil to my last Will dated the 23rd day of January 1857 and to be annexed thereto and taken as part thereof

With regard to my household furniture and linen I direct the same to be equally divided between my Wife Sarah and my son William to whom I Give and bequeath the same absolutely

And as to all my silver plate and plated articles together with all my Wines and spirits I direct the same to be equally divided between my said Wife and my two Sons George and William to whom I give and bequeath the same absolutely share and share alike

I Give and bequeath unto my two Sons George Mann and William Mann the Legacy of Two hundred pounds apiece in addition to what I have given and bequeathed to them in and by my said Will Provided and it is my Will and I do hereby expressly direct with regard to any married Daughter of mine that after the decease of any such Daughter the Interest dividends and yearly income of the trust funds and premises to which any such Daughter shall respectively be entitled under the trusts of my said Will shall go to and be paid to the Husband of any such deceased Daughter during his life

And I also direct after the death of any of my said Daughters respectively and their respective husbands that it shall be lawful for my said Trustees or Trustee during the minority of the issue of any such deceased Daughter to apply the interest dividends and yearly income of the trust funds and premises to which they would be entitled under my said Will for and towards their maintenance advancement and education during such respective minorities

And in all other respects I confirm my said Will

I William Mann of Wymondham in the County of Leicester Gentleman Declare this to be a second Codicil to my last Will dated the 23rd day of January 1857 to be annexed thereto and taken as part thereof

Whereas I have in my said Will bequeathed unto my Trustees George Mann and William Mann the sum of One thousand pounds Upon Trust for my daughter Sarah Jane and her children as therein particularly expressed Now I do hereby revoke such bequest and in lieu thereof I Give and bequeath unto the said George Mann and William Mann or the Survivor of them or the Executors and Administrators of such Survivor the Sum of Eight hundred Pounds Upon Trust to hold and apply the same for the benefit of my said Daughter Sarah Jane and her children for and upon the like trusts intents and purposes as in my said Will is particularly expressed and declared with regard to the said sum of One thousand Pounds and in all respects as if the sum of eight hundred Pounds had been originally named and specified in my said Will And I direct that the clause in my first Codicil relating to the husband of any of my daughters shall be applicable to this bequest

It is also my Will and I hereby expressly direct that it shall be lawful for my said Son William to take at a fair Valuation what stock on my Farm he may choose to select by paying or accounting to my Estate for the amount thereof such valuation to be made by some competent and disinterested part to be previously chosen and appointed by my said Trustees in Writing

In all other respects I confirm my said Will and Codicil

In Witness whereof I the said William Mann have to this my second Codicil set my hand this twelfth day of October 1864

Proved at Leicester with two Codicils the sixth day of March 1865 by the Oaths of George Mann and William Mann Sons of the deceased the Executors named in the Will to whom Administration was granted

The Testator William Mann was late of Wymondham in the County of Leicester Gentleman and died on the twenty fourth day of October 1864 at Wymondham aforesaid
