This is the last Will and Testament of me John Mann of Hickling in the County of Nottingham farmer

I give devise and bequeath all and singular my estate at Gotham in the County of Nottingham as that which I have recently contracted to purchase there as the rest I have already there belonging to me and at Hickling also in the County of Nottingham and all other my real and personal estate and effects whatsoever and wheresoever to Thomas Sharp of Kinoulton in the said County of Nottingham farmer and my son in law William Rowbotham of Waltham in the County of Leicester watchmaker their heirs executors administrators and assigns UPON TRUST to permit and suffer my wife Elizabeth Mann to enjoy the same during her natural life for her own use and benefit and after her death I give and devise the house and garden and Home Close at Hickling aforesaid with all and singular the outbuildings rights members and appurtenances thereto belonging and now in my own occupation unto my eldest son John Mann and the heirs of his body lawfully issuing on condition that my said son John Mann pays to my grandson Thomas Barlow son of my daughter Mary twenty pounds within six months after my wifes decease which sum of twenty pounds to be paid I bequeath to the said Thomas Barlow accordingly and after of the death of my said son John Mann without leaving lawful issue then I give and devise the same to my son Richard Mann his heirs and assigns for ever

I give and devise the house (or two tenements) at Hickling now occupied by Andrew Wheatley and Robert Rippen to my youngest son George Mann his heirs and assigns forever on condition that he pays to my second son Richard Mann twenty pounds within six months after my said wifes death which sum of twenty pounds so to be paid I bequeath to the said Richard Mann accordingly

And I direct that my said trustees shall from and after my said wifes decease stand possessed of All the rest residue and remainder of my said real and personal estate Upon Trust to convert the personal estate into money and to sell the real estate as hereinafter mentioned and to divide and pay the proceeds as follows that is to say the proceeds of any personal estate after the payment of my debts and funeral and testamentary expenses to be equally divided between and amongst my sons Richard and George and my daughters Mary Mann Fanny the wife of the said William

Rowbotham and Alice the wife of Thomas Hickling of Broughton butcher But my said trustees are to retain in their hands Alice’s share In Trust as hereinafter expressed

And the proceeds of my real estate (not specifically disposed of as aforesaid to my sons John and George) to be divided amongst all my said children equally share and share alike namely John Richard George Mary Fanny and Alice my said trustees retaining in their hands Alice’s share In Trust as hereinafter expressed

I authorise and empower my said trustees to sell and dispose of any said real estate (not specifically disposed of to my sons John and George as aforesaid) as soon as they can conveniently do so after my said wifes decease by public auction or private contract for such price or prices in money as they can reasonably obtain and their receipt to be a good discharge for all monies therein expressed to be received and no person paying them any monies for the purposes of this my Will and taking such receipt shall be obliged to see to the further application of the same monies nor be answerable for the misapplication thereof

I declare that neither of my said trustees shall be answerable for the other or for the acts deeds or defaults of the other nor for any involuntary loss and that they may reimburse themselves and each other out of the said Trust monies all costs and expenses which they may incur in the execution of the trusts of this my will I direct that my said trustees shall stand possessed of my said daughter Alice’s share of my said real and personal estate In Trust to put the same out at interest on Government or real securities in England and alter vary and transpose such securities as occasion may require or they may deem expedient and to pay half yearly as and when the interest and dividends thereof become due, the same interest and dividends into the proper hands of my said daughter Alice Hickling for and during the term of her natural life for her sole separate and exclusive use and benefit free from the interference or control of her said present in any future husband and her receipt alone notwithstanding her coverture to be a valid discharge for the same and at her decease to pay the principal monies so secured as aforesaid to the child or children of my said daughter Alice equally

In case of the decease of either of my said trustees before the trusts hereby in them reposed have been fully performed I declare that the survivor shall and may have and exercise all the powers and authorities which are hereby given to them jointly the same as if such survivor had been originally appointed alone a trustee under this my will I appoint the said Thomas Sharp and William Rowbotham executors of this my will

I hereby certify that on the eight day of April in the year of our Lord 1852 Thomas Sharp of Kinoulton in the County of Nottingham farmer and William Rowbotham formerly of Waltham but now of Stathern in the County of Leicester watchmaker (the son in law) the Executors named in this the last Will and Testament of John Mann late of Hickling in the said County of Nottingham in the Diocese of York farmer deceased … … well and truly to execute and perform the same And that the whole of the goods chattels and credits of the said deceased within the Diocese of York do not amount in toto to the sum of hour hundred and fifty pounds
