This is the last Will and Testament of me Benjamin Leavesley of Stathern in the County of Leicester Grazier

I hereby revoke all former Wills and testamentary dispositions made by me

I appoint my friend Thomas Lamin of Harby in the said County of Leicester Farmer and my Son Alfred Barnes Leavesley Trustees and Executors of this my Will and they or the survivor of them or the executors or administrators of such survivor or other the Trustees or Trustee for the time being hereof are hereinafter referred to as “my Trustees”

I bequeath the following Legacies namely To my Daughter Ann Leavesley the sum of Two hundred Pounds and my Son Benjamin Thomas Dyer Leavesley the sum of one hundred Pounds and to my Trustees the sum of One hundred Pounds and as to all my real and personal estate not hereby otherwise disposed of I give devise and bequeath the same but subject to and charged with the payment of my funeral and testamentary expenses and debts and the above mentioned Legacies Unto my Son John Barnes Leavesley absolutely

I declare that my Trustees shall invest the said sum of One hundred pounds hereinbefore bequeathed to them in or upon any of the stocks funds or securities authorized by law for the investment of trust funds with power for my Trustees from time to time at their discretion to vary the investments thereof and shall stand possessed of the said sum of one hundred pounds and the investments for the time being representing the same (hereinafter called “the said  trust Legacy”) Upon the trusts following (that is to say)

Upon trust to pay the annual income or dividends arising therefrom to my Daughter Arabella the Wife of Thomas Barker of Stathern aforesaid Baker during her life and from and after her decease Upon trust to pay out of the said Trust Legacy the sum of Forty pounds to Frederick Barker the eldest Son of my said Daughter Arabella Barker on his attaining the age of Twenty one years and to hold the residue of the said trust Legacy In Trust for all the Children of my said Daughter Arabella Barker (other than the said Frederick Barker) who being a Son or Sons shall attain the age of Twenty one years or being a Daughter or Daughters shall attain that age or marry in equal shares and if there shall be only one such Child the whole to be in trust for such one Child

And I lastly declare that every gift or disposition whether in the nature of income or capital hereby made to or in favour of a female shall be for her separate use independently of any Husband and of his debts control and engagements and that in the case of a life interest she shall not have power to dispose or deprive herself of the benefit thereof by way of anticipation

Signed and Declared by the above named Testator as and for his last Will and Testament in the presence of us who at his request in his presence and in the presence of each other have hereunto subscribed our names as Witnesses the word “Son” between the 6th and 7th lines from the top of the first page having been first substituted for the word “Brother” and the word “John” between the 21st and 22d line from the top of the said first page have been substituted for the word “Joseph”

Proved at Leicester on the Thirty first day of August 1883 by the Oaths of Thomas Lamin and Alfred Barnes Leavesley, the Son, the Executors to whom administration was granted

The Testator Benjamin Leavesley was late of Stathern in the County of Leicester Grazier and died on the Twenty first day of May 1883 at Stathern aforesaid
