Thomas Kirke of Harby 1720 Will

In the name of god Amen I Thomas Kirke the Elder of Harby in the County of Leicester yeoman being mindful of my Mortality doe make & ordain this my last will & Testament in manner following

Imprimis I will that All my Just Debts & funerall expences shall be first paid off and discharged by my Executor hereinafter named

Allsoe I Give and Bequeath unto my three Daughters (viz) Anne Whittle Elizabeth Stokes and Sarah Jarvis one shilling a piece

Alsoe I Give & Bequeath unto my youngest son Richard Kirke the Sume of forty pounds of good and lawfull money of Great Britain to be paid him by my Executor at the age of one & twenty years

Alsoe I Give & Bequeath unto my two Daughters (viz) Mary Kirke and Hannah Kirke the Sume of Twenty pounds a piece of good & lawfull money of Great Britain to be paid them severally by my Executor at their respective Ages of nine & twenty years or daies of Marriage which shall first happen

Alsoe I Give & bequeath unto my two youngest Daughters (viz) Alice Kirke & Ruth Kirke the Sume of Twenty pounds a piece of good and lawfull money of Great Britain to be paid them severally by my Executor at their respective Ages of four and twenty years or daies of Marriage which shall first happen and in Case that my personal Estate Shall fall Short of the payment of my Debts & Legacies aforesaid That then my Will & mind is that my Son Thomas Kirke shall raise & pay soe much money out of my Messuages or Lands Tenements hereditaments Scituate & being in Harby aforesaid as shall make up the Sume of money so falling short as aforesaid

And my Will & Mind further is that in Case my said Son Richard or any of my said four Daughters (viz) Mary, Hannah, Alice, or Ruth shall happen to Depart this life before his her or their Legacy or Legacies Shall become due & payable as aforesaid that the portion or portions of such Child or Children so dying shall be Equally divided amongst the Survivors of my said five Children last named & my said Son Thomas share & share alike

And Alsoe I Give Devise & Bequeath All & every of my Messuages Lands Tenements & hereditaments whatsoever situate & being in Harby aforesaid or within the several fields liberties territories & precincts thereof And Allsoe All & every of my Goods Chattels rights Creddits & personal Estate whatsoever & wheresoever the same shall or may be found unto my said son Thomas Kirke Subject to the payment of All my said Just Debts Legacies & Funeral Expences aforesaid

And Lastly I doe hereby Make ordain Constitute & appoint my said Son Thomas Kirke Sole Executor of this my last Will & Testament hereby revoking all former Wills & Testaments whatsoever by me at any time heretofore made if any shall be found

In Wittnesse whereof I the said Thomas Kirke the Testator have to this my last Will & Testament set my hand & seale the fifteenth day of August Anno Dom 1720
