James Kemp of Harby 1798 Will

This is the Last Will and Testament of me James Kemp of Harby in the County of Leicester Blacksmith as follows

In the first place I Give and devise All and every my Messuages Closes Lands Tenements and other Hereditaments whatsoever situate at Harby aforesaid and Stathern in the said County of Leicester or elsewhere in that part of Great Britain called England unto my dear and loving Wife Olivea Kemp and her Assigns for and during such part of her natural life as she shall continue my widow but no longer

And from and immediately after the decease or Marriage of my said Wife (which shall first happen) Then as to for and concerning all that my Messuage or Tenement and Homestead with the Garden Orchard and other the Appurtenances thereunto belonging situate standing and being in Harby aforesaid and now or late in the Tenure or Occupation of Thomas Swift his Assignee or Assigns And also all that my new inclosed piece plot or parcel of Land lying in the Long Field of Harby aforesaid and containing by Estimation two Acre or thereabouts I Give and devise unto my eldest Son James Kemp his Heirs and Assigns To Hold the same unto and to the use of my said Son James Kemp his Heirs and Assigns for ever Subject nevertheless and Chargeable with the payment of the sum of Forty pounds in manner hereinafter mentioned

And as to for and concerning all that my other Messuage or Tenement with the Yard Orchard and other the Appurtenances thereunto belonging situate and being in Harby aforesaid and now or late in the Tenure of John Boyer And also all that my new inclosed and allotted piece plot or parcel of Land situate lying and being in the Lordship or Liberties of Stathern aforesaid containing two Acres two roods and eighteen perches or thereabouts and now in my own possession with the Appurtenances I Give and devise the same unto and to the use of my said Son William Kemp his Heirs and Assigns for ever Subject and chargeable with the payment of the sum of Sixty pounds in manner hereinafter mentioned

And as to for and concerning all that my other Messuage with the Workshop Stables Yard and Garden thereunto belonging And also all those my two Closes or Grounds inclosed near unto or adjoining the same containing together two Acres or thereabouts situate standing lying and being in Harby aforesaid and now in my own possession with their and every of their Appurtenances I Give and devise unto my youngest Son Thomas Kemp his heirs and Assigns To Hold the same Unto and to the use of my said Son Thomas Kemp his heirs and Assigns for ever Subject nevertheless and chargeable with the payment of the sum of Sixty pounds in manner hereinafter mentioned

Also I Give and bequeath unto my four Daughters Elizabeth the Wife of William Dalby, Olivea Kemp, Mary Kemp and Sarah Kemp the sum of Forty pounds apiece which said several Legacies amounting together to the sum of One hundred and sixty pounds I will shall be paid within twelve Months next after the decease or Marriage of my said Wife (which shall first happen) And I do hereby subject and charge the Messuage or Tenement Lands and other Hereditaments hereby be me given and devised to my said Son James Kemp and his Heirs with the just and true payment of the sum of Forty pounds part of the said sum of One hundred and sixty pounds And I do also subject and charge the said Messuage Lands and other Hereditament hereby by me given and devised to my said Son William Kemp and his heirs with the just and true payment of the sum of sixty pounds other part of the said sum of One hundred and sixty pounds And I do hereby also subject and charge the said Messuage Workshop Lands and other Hereditaments hereby by me given and devised to my said Son Thomas Kemp and his heirs with the just and true payment of the like sum of Sixty pounds (being the residue of the said sum of One hundred and sixty pounds the whole amount of the said several Legacies) accordingly

Also I Give and bequeath one Moiety or full half part of all my Household Goods Plate Linen and Furniture whatsoever situate in my now Dwelling house in Harby aforesaid unto my said Wife Olivea Kemp for her to have the free use occupation and enjoyment thereof during such part of her natural life as she shall continue my Widow and from and immediately after the decease or Marriage of my said Wife (which shall first happen) I Give and bequeath the same unto my said Son Thomas Kemp

And as to for and concerning the other Moiety or half part of my said Household Goods Plate Linen and Furniture and also all my Stock Cattle Chattels Implements of Husbandry and Trade Rights Credits ready money and Securities for money and all other my personal Estate (not herein otherwise disposed of ) I Give and bequeath unto my said youngest Son Thomas Kemp whom I do hereby nominate constitute and appoint full and sole Executor of this my last Will and Testament hereby revoking all former Wills by me made

In Witness whereof I the said James Kemp the Testator have hereunto set my hand and Seal this Twenty ninth day of April in the year of our Lord one thousand seven hundred and ninety four

Let probat be granted to Thomas Kemp, the sole Executor of the within written Will, he being sworn to the due Execution thereof; & also made oath, that the whole personal estate of the Deceased at the time of his death did not amount in value to the sum of one hundred pounds
