John Jarvis of Nether Broughton 1791 Will

This is the Last Will and Testament of me John Jarvis of Nether Broughton in the County of Leicester Grazier As follows
In the first place I Give and devise All those my two Closes of Arable Meadow or Pasture Ground with the Appurtenances situate lying and being in the Lordship or Liberties of Nether Broughton aforesaid and now in my own possession Unto my father in law Thomas Hill and my Brother Joseph Jarvis their heirs and Assigns Upon this Special Trust and Confidence that they the said Thomas Hill and Joseph Jarvis or the Survivor of them his heirs or assigns do and shall as soon as they shall think proper sell and dispose of the said Closes or Grounds inclosed and premises for the most money and best price he and they can obtain for the same And I do hereby declare that the Receipt or Receipts of the said Thomas Hill and Joseph Jarvis or the Survivor of them his heirs or Assigns shall be a sufficient Release and discharge to such Purchaser or Purchasers of the said premises for so much money as in such Receipt or Receipts shall be expressed and that such Purchaser or Purchasers shall not be answerable or accountable for the misapplication or nonapplication of the same And upon this further Trust that they my said Trustees or the Survivor of them his heirs or assigns do and shall pay and dispose of the Purchase money arising from the said Closes and premises in manner hereinafter mentioned (that is to say)
The sum of Eighty pounds and interest due on Bond unto my said Brother Joseph Jarvis
And the residue of the said purchase money (if any) Upon Trust to put and place the same out at Interest upon one or more good and sufficient Security or Securities And the interest arising therefrom to pay the same unto my dear and loving wife Mary Jarvis for and towards the maintenance and Education of my two Daughters Ann Jarvis and Mary Jarvis until they shall severally and respectively attain to her and their age and ages of twenty one years And when and as soon as they shall so attain to their respective age and ages of Twenty one years Then upon this further Trust and my will is that my said Trustees or the Survivor of them his heirs or assigns do and shall pay the residue of such purchase money so directed to be placed out to interest as aforesaid And all interest that shall be then due for the same unto and between my said two Daughters Ann Jarvis and Mary Jarvis share and share alike
And also I Give and bequeath All my Household Goods other Goods Stock Cattle Chattels rights Credits ready money and Securities for money and all other my personal Estate whatsoever and wheresoever (my debts and Funeral Expences being first paid) unto my said two Trustees Thomas Hill and Joseph Jarvis Upon this special Trust that they my said Trustees and the survivor of them his Executors or Administrators do and shall immediately after my decease enter into the possession of my said personal Estate and premises together with the Farm now in my possession And take upon themselves the management and Execution thereof until my said two Daughters shall severally attain to their respective Age and Ages of Twenty one years And the interest and profits arising therefrom (after payment of Rent and all other expences that may be incurred in the Execution of the Trusts hereby reposed in my said Trustees) yearly and every year to pay and apply the same unto my said Wife Mary Jarvis for and towards the maintenance of herself and her two Daughters the said Ann and Mary And when and as soon as my said two Daughters shall severally and respectively attain to their said respective Age and Ages of Twenty one years Then my Will is that my said Trustees or the Survivor of them his Executors or Administrators do and shall distribute and divide my said Personal Estate and premises together with all profits arising therefrom unto and amongst my said Wife and my said two Daughters equally share and share alike
And Lastly I do hereby nominate and appoint my said Wife Mary Jarvis sole Executrix of this my Last Will and Testament Hereby revoking all former Wills by me made
In Witness whereof I the said John Jarvis the Testator have hereunto set my hand and seal this Eighteenth day of November in the year of our Lord one thousand seven hundred and Eighty Eight

She being duly sworn as well to the faithful Execution of the Will as that the Testator’s Goods Chattels and credits do not amount in Value to the sum of Twenty pounds
