Thomas Jalland of Old Dalby 1822 Will

This is the last Will and Testament of me Thomas Jalland of Old Dalby in the County of Leicester Grazier as follows

I give devise and bequeath all that my messuage or Tenement Barns Stables and outbuildings thereto belonging and also all my Closes or Grounds inclosed situate standing lying and being in Colston Bassett in the County of Nottingham containing one hundred and two acres or thereabouts in the occupation of my Brother John Jalland and all other my real Estate whatsoever in the Kingdom of England with their and every of their Appurtenances and also all the Stock Cattle Chattels Furniture and Effects which shall at the time of my decease be in and upon my said Estate in Colston Bassett aforesaid unto my Brother William Jalland and my Cousin Thomas Closs [sic, but later “Cross”] of Holwell in the said County of Leicester Grazier their heirs Executors admors and assigns for every upon this special trust and confidence nevertheless

That they my said trustees and the survivor of them and the heirs Executors and Administrators of such Survivor do and shall as soon as convenient after my decease absolutely sell and dispose of all my said real Estate And the said stock and Effects thereupon either by Public Auction or Private Contract as to them or him shall seem most advisable and with the monies arising from such sale or sales as aforesaid in the first [“place” missing] to pay and satisfy all my just Debts whether on mortgage simple contract or otherwise and funeral and Testamentary expences and the Costs and charges incident to the making such sale or sales and after payment thereof

Then upon trust that they the said William Jalland and Thomas Cross or the survivor of them or the Executors or Admors of such survivor do and shall Place out the sum of two thousand Pounds other part of the said Purchase money at interest on real of Government Security and I direct my said trustees to allow the interest or dividends yearly arising therefrom to accumulate and become principal until my Son John Gill Jalland attains the age of Ten years my Mother and two Brothers William and Richard Jalland having kindly undertaken to provide for him in the mean time and with the interest or dividends arising from the said sum of two thousand pounds so to be placed out as aforesd I direct my said trustees to Apply the same from and after my said Son shall have attained his age of Ten years as aforesaid for and towards the maintenance education and bringing up of my said Son John Gill Jalland until he attains his age of twenty one years and when and so soon as my said Son shall attain his age of twenty one years then I give and bequeath the said sum of two thousand pounds with such accumulation of interest as aforesaid unto my said Son John Gill Jalland his Executors and administrators

But in case my said Son John Gill Jalland shall happen to die under the Age of twenty one Years without lawful issue then I give and bequeath the said sum of two thousand pounds with such accumulation of interest as aforesaid unto and amongst my Brothers and Sisters namely Elizabeth Edenborough the said William Jalland Robert Jalland Richard Jalland and Bishop Jalland their Executors and administrators in equal shares and proportions

And as to the residue of such purchase money if any remains after answering the purposes aforesaid I give and bequeath the same and every part thereof unto my said Brothers and Sister the said Elizabeth Edenborough William Jalland Robert Jalland Richard Jalland and Bishop Jalland their Executors and Administrators in equal shares

And for facilitating the sale or sales of my said real Estate and the indemnity of the Purchaser or Purchasers thereof or of any part thereof my will is that the receipt or receipts of my said trustees or the survivor of them and his heirs shall be a good and sufficient discharge and discharges to such purchaser or purchasers for so much money as shall or may in such receipt or receipts be expressed to be received and that such Purchaser or purchasers shall not be answerable or accountable for any loss misapplication or nonapplication of such Purchase money or Any part thereof

I give and bequeath all the household Goods and Furniture in my now dwelling house Stock upon my Farm in Old Dalby aforesaid and other Effects and all other my personal Estate and Effects not herein before by me specifically disposed of unto my said Mother Mary Jalland and my two Brothers the said William Jalland and Richard Jalland their Executors and administrators in equal shares and proportions and I humbly request my Landlord the Earl of Radnor to Admit them as Tenants to the said Farm I now rent under the said Earl

Provided And my Will is that they my said trustees and the survivor of them and his heirs shall not be answerable or accountable for any loss which may happen to the said Trust monies and premises unless the same happen through his or their wilful neglect of default nor one for the other but each for his own wilful neglect or default

And Lastly I do hereby appoint my said Mother Mary Jalland and my said two Brothers William Jalland and Richard Jalland joint Executors of this my last Will and Testament hereby revoking all former Wills by me made

In Witness whereof I the said Thomas Jalland the Testator have to this my last Will and testament written on three sheets of paper to the two first sheets thereof set my hand and to this third and last my hand and seal this twelfth day of December one thousand eight hundred and twenty one
