Samuel Hopkins of Nether Broughton 1841 Will

This is the last Will and Testament of me Samuel Hopkins of Nether Broughton in the County of Leicester Yeoman

I Give devise and bequeath all and singular my real and personal estate and effects whatsoever and wheresoever unto Samuel Bagnall Wild of Costock in the county of Nottingham Esquire his heirs executors and administrators Upon trust to permit and suffer my Wife Ann Hopkins to occupy and enjoy the same during her natural life she paying the interest on the mortgage now affecting my real estate, or Upon trust with the consent of my said Wife absolutely to sell and dispose of the same or any part thereof at any time during her life and in such a manner as he the said Samuel Bagnall Wild shall in his discretion think best and after paying off the said mortgage to pay the interest and proceeds of the surplus to my said Wife during her natural life

And upon and immediately after my said wife’s decease, in case my said real and personal estate and effects or any part thereof shall not have been sold and disposed of during her life Upon trust to sell and dispose of the same as he the said Samuel Bagnall Wild his heirs executors or administrators shall think best and to pay thereout the said mortgage and interest and then to pay to my eldest son George Hopkins the legacy or sum of Twenty Pounds and to pay and divide the remainder of the proceeds of the sale of my said real and personal estate and effects unto and equally between and amongst the said George Hopkins and all my other children, the children of my deceased daughter Phebe Hallam to take the share which their deceased mother would have received had she been living but my will is that there shall be deducted from the said Phebe Hallam’s children’s share the sum of twelve pounds, being the value of a Cow I gave her when she was married and the said sum of twelve pounds divided amongst the rest of my children equally The receipt of the said Samuel Bagnall Wild his heirs executors and administrators alone to be a sufficient receipt and discharge for all moneys payable under this my Will And I declare that he is not to be responsible for any more moneys than he shall actually receive, nor for any involuntary loss and that he shall be at liberty to reimburse himself all costs charges and expenses in carrying into effect the trusts of this my Will

The foregoing devises and bequests are subject to all my just debts and funeral and testamentary expenses and also to the funeral and other expenses attendant on the decease of my said Wife

I appoint the said Samuel Bagnall Wild Executor of this my Will

In the Court of the Archdeacon of the Archdeaconry of Leicester Appeared personally Elizabeth the wife of William Baker of Nether Broughton in the County of Leicester Groom and made oath that she is one of the subscribed Witnesses to the last Will and Testament of Samuel Hopkins late of Nether Broughton aforesaid Yeoman deceased bearing date the thirtieth day of Jun 1838 now hereunto annexed and marked with the letter (A) And she further made oath that on the thirtieth day of June aforesaid the said Testator duly Executed his said Will by affixing his Mark at the foot or end thereof in the presence of this Deponent and of Thomas Scott of Nether Broughton aforesaid Clerk the other subscribed Witness thereto who were then together present at the same time with the said deceased And this deponent and the said Thomas Scott thereupon attested and Subscribed the said Will in the presence of the said Testator and of each other

On the first day of April in the year of our Lord One thousand eight hundred and forty one the said Elizabeth Baker was duly sworn at Loughborough in the County of Leicester to the Truth of the aforegoing Affidavit

Let a Probate be made to Samuel Bagnall Wild of Costock in the County of Nottingham Esquire the Sole Executor named in the Will of the deceased

He having been duly sworn as well to the faithful Execution of the Will as that the testator’s Goods Chattels and Credits without deducting any Debts owing by the deceased therefrom do not amount in value to the Sum of One hundred Pounds and that the deceased died on the 4th October last
