Samuel Holmes of Scalford 1831 Will

This is the last Will and Testament of me Samuel Holmes of Scalford in the County of Leicester Farmer and Maltster that is to say

I give and bequeath All my Stock in Trade Cattle Cropping Implements of Husbandry Live and Dead Stock Household Furniture Book Debts Monies Securities for Money and all other my personal estate and effects whatsoever and wheresoever unto William Holmes of Willoughby John Holmes of Edwalton and William Holmes of Plumtree all in the County of Nottingham Farmers their executors administrators and assigns Upon trust that they or the survivors or survivor of them do an shall with all convenient speed after my decease sell and convert the same into money and pay the same in manner hereinafter mentioned (that is to say)

Upon trust to pay to my son David Holmes the sum of three hundred pounds to my son Thomas Holmes the sum of four hundred pounds to each of my four daughters Sarah Holmes Rebecca Holmes Martha Holmes and Elizabeth Palmer the sum of two hundred pounds and to my daughter Mary Cooke the sum of fifty pounds the said Legacies to be respectively paid to them at the expiration of twelve calendar months next after my decease

All the rest residue and remainder of my said personal estate and effects I give and bequeath to my above mentioned sons and daughters equally to be divided between and amongst them share and share alike

Provided always that in case any or either of my said sons and daughters shall be dead at the time of my decease leaving issue then I will that the legacy and share of the residue by this my Will given to such son or daughter who shall die leaving issue shall be paid unto such issue equally amongst them at their respective ages of twenty one years

I direct my said Trustees too reimburse themselves out of my said personal estate all costs and expences which they shall be put to in the execution of this my Will and that they shall not be answerable for any loss except through their wilful neglect

I subject all my said personal estate and effects to the payment of my just debts funeral and testamentary expences

I appoint the said William Holmes of Willoughby John Holmes and William Holmes of Plumtree joint Executors of this my Will and I hereby revoke all former Wills by me at any time heretofore made and do declare this to be my last Will and Testament

In witness whereof I have hereunto set my hand and seal the twentieth day of September in the year of our Lord one thousand eight hundred and thirty

Let a probate be made to William Holmes of Willoughby in the County of Nottingham John Holmes of Edwalton in the same County and William Holmes of Plumtree in the aforesaid County Farmer the joint Executors named in the will of the deced who died  on the 21 Sepr last

They having been first duly sworn as well to the faithful Execution of the Will as that the Testators Goods Chattels and Credits without deducting any debts due and owing by him therefrom do not amount in value to the sum Two Thousand pounds
