Edward Holmes of Eastwell 1882 Will

This is the last Will and Testament of me Edward Holmes of Eastwell in the County of Leicester Grocer and Grazier

I give and bequeath the sum of Fifty Pounds and all my live and dead Farming Stock tools Implements and utensils, horses, carts and carriages, stock in trade, book debts, Fixtures, Household Furniture, Plate plated articles linen, glass China, books, pictures, watches, ornaments of the person and other my Household goods stores and provisions to my Daughter Fanny Holmes for her sole use absolutely she paying thereout my funeral Expenses only

I give devise and bequeath all my real estate and all the residue and remainder of my personal Estate and Effects whatsoever and wheresoever (including as well real as personal estate over which I have or shall have a general power of appointment) unto my Son William Edward Holmes and my Friend William Jackson of Eastwell aforesaid Farmer their heirs executors administrators and assigns Upon trust that they the said William Edward Holmes and William Jackson or the survivor of them his heirs executors administrators or assigns shall in such manner and under such stipulations and upon such terms and conditions in all respects as they or he shall in their of his uncontrolled discretion think fit sell collect or otherwise convert into ready money (according to the nature of the premises) all such parts of the same premises shall not consist of ready money and may buy in or rescind or vary any contract for sale or any other description and re sell without being answerable for loss and may for the purposes aforesaid or any of them execute and do all such assurances and things as they or he shall think fit and after payment of my just debts and Testamentary expenses shall hold the residue of the monies to be produced by such sale collection and conversion and all other monies arising from or forming part of my residuary estate In trust as to one sixth part of share thereof for the separate use of my Daughter Elizabeth Lancaster

As to one other sixth part or share thereof In trust for the separate use of my Daughter Sophia Partington

As to one other sixth part or share thereof In trust for the separate use of my Daughter Harriet Holmes

As to on other sixth part or share thereof In trust for my said Son William Edward Holmes

As to one other sixth part or share thereof In trust for my Son Roger Holmes

And as to the remaining one sixth part or share thereof Upon trust to invest the same in the name of the Trustees or Trustee for the time being of this my Will in any of the Public stocks funds or government securities of the United Kingdom or upon real securities in England or in or upon the stocks funds shares debentures, mortgages or securities of any corporation company or Public body municipal commercial or otherwise in the United Kingdom and paying a dividend but not in any other mode of investment and may vary or transpose such stocks funds shares and securities into or for others of the like nature at their or his discretion And shall pay the interest dividends and income of the said stocks funds shares or securities to my Daughter Mary Smith for her life for her separate use but so that she shall not have power to deprive herself of the benefit thereof by any dealings therewith in the way of anticipation and that her receipts alone whether covert or sole shall alone be effectual discharges for the same and upon the death of the said Mary Smith I direct my said Trustees or Trustee to pay and divide the said one sixth part or share of and in the said residuary capital trust funds and premises equally between all my said other children including the said Fanny Holmes share and share alike to whom I give and bequeath the same absolutely or the issue of such as may be dead such issue only taking amongst them what would have been their deceased parents share

I devise all Estates vested in me as Mortgagee or Trustee unto and to the use of the said William Edward Holmes and William Jackson their heirs executors administrators and assigns respectively and as far as I am beneficially interested as Mortgagee to be disposed of as part of my personal estate for the purposes of my Will

I appoint the said William Edward Holmes and William Jackson Executors of my Will

In Witness whereof I the said Edward Holmes have hereunto set my hand this Sixth day of November one thousand eight hundred and seventy eight

Signed and acknowledged by the said Edward Holmes the Testator as and for his last Will and Testament in the presence of us present at the same time, and who at his request in his presence and in the presence of each other have hereunto subscribed our names as Witnesses

Proved at Leicester on the Thirteenth day of January 1882 by the Oaths of William Edward Holmes, the Son, and William Jackson, the Executors to whom Administration was granted

The Testator Edward Holmes was late of Eastwell in the County of Leicester Grocer and Grazier and died on the Thirtieth day of July 1881 at Eastwell aforesaid
