Thomas Hill of Nether Broughton 1809 Will

In the name of God Amen This is the last Will and Testament of me Thomas Hill of Nether Broughton in the County of Leicester Labourer

First I will and direct that my Executors In Trust hereinafter named shall immediately after my decease deliver to my Wife Sarah Hill all my Household furniture which was hers before my Marriage with her for her own sole use and benefit

And I give and devise all that my Messuage or Tenement and Home Close thereunto adjoining situate lying and being in Nether Broughton aforesaid and now in my own occupation with all the Hereditaments thereto belonging Unto my Brother Richard Hill and my Friend Richard Reavill Tallow Chandler both of Nether Broughton aforesaid and to their Heirs and Assigns for ever Upon Trust nevertheless that they the said Richard Hill and Richard Reavill or the Survivour of them or his Executors Administrators or Assigns Do and shall in their or his discretion as soon as conveniently may be after my decease sell and dispose of my said Messuage or Tenement Home Close and Premises either by public Auction or private Contract for the most money which can reasonably be obtained for the same and for facilitating such Sale or Sales I do hereby declare that the Receipt and Receipts of the said Richard Hill and Richard Reavill or the Survivour of them or his Executors Administrators or Assigns shall be a good and effectual discharge or good and effectual discharges to the purchaser or purchasers of the said premises for as much money as in such Receipt or Receipts shall be acknowledged to or expressed to be Received and that after such Receipt or Receipts so given the said purchaser or purchasers shall not be bound or obliged to see to the application of such purchase money or answerable for any misapplication or nonapplication thereof

And upon the further Trust that they the said Richard Hill and Richard Reavil or the Survivour of them or his Executors Administrators or Assigns Do and shall after deducting all costs and charges which they may sustain in the Sale of the said premises making out a title or titles to the purchaser or purchasers thereof and all other expences incident to the Trust hereby reposed in them pay and dispose of the Residue of the money arising by such Sale or Sales in manner following That is to say

First I will and direct that they shall pay all my just debts my Funeral and Testamentary expences the sum of twenty one pounds to my son in law Michael Brown which I am bound by our marriage Agreement to be caused to be paid to him within six Months next after my decease and all the Legacies hereinafter given and bequeathed by me

First I give and bequeath the sum of ten pounds to my Daughter Elizabeth Wilkinson

Also I give and bequeath to my Grand Children the sons and daughters of my late son in law John Bowley the sum of ten pounds to be paid to them in equal shares as they attain their respective Ages of twenty one years the interest arising from the last mentioned Legacy during my said Grand Childrens Minorities I direct shall be paid to their Mother if living as it becomes due for her own use

Also I give and bequeath the sum of ten pounds to the Children of my late Daughter Ann Hoe to be paid to them in equal shares as they attain to their respective ages of twenty one Years and the interest arising from their Legacy during their respective Minorities I direct shall be paid to their Father Peter Hoe for his own use (if living) as it becomes due

Also I give and bequeath to my Grandsons Henry Shilcock and Thomas Shilcock the sum of five pounds apiece

Also I give and bequeath to my loving Wife Sarah Hill the sum of five pounds and all my tenant right to the Close and two Cow Pastures which I rent of the Earl of Radnor for and during the term of her natural Life in lieu of the Rooms which I am bound to find her in my dwelling House during her Widowhood to be paid and delivered to her immediately after my decease and immediately after my said Wifes decease I give and bequeath all my tenant right to the said Close and two Cow Pastures to my said Grandson Henry Shilcock

Also all the Residue and Remainder of my Household furniture and Linen which were not my said loving Wifes before my Marriage with her I give and bequeath to my Granddaughters Ann Shilcock and Sarah Shilcock to be divided between them and delivered to them when my said Trustees shall think fit

And all the Residue and Remainder of my Chattels Cattle and personal Estate whatsoever and wheresoever not herein disposed of I give and bequeath to my said Brother Richard Hill and said Richard Reavil in Trust to be by them applied towards the payment of the Legacies herein give and bequeathed by me And I will and direct that in case the monies arising from the Sale or Sales of my real Estate and my personal Estate hereby given to them (my said Trustees) shall be more than sufficient to pay all my just debts the Legacies herein bequeathed and all other expences attending the Execution of this my Will then I will and direct that my said Trustee or Trustees shall part amongst share and pay the surplus to all and every of my Legatees directed to be paid in Money in proportion to the amount of the sum or Legacy given to each of them and in case the said monies arising as aforesaid shall not be sufficient to make all such payments as beforementioned then my Legatees directed to be paid in money shall each pay a part of the deficiency in proportion to the amount of their respective Legacies

Lastly I do hereby make and ordain the said Richard Hill and Richard Reavill Executors in Trust of this my last Will and Testament And I do hereby will and direct that my said Trustees shall not be liable to answer or make good any loss or losses that shall happen to any part of the said Trust Monies unless the same shall happen by or through their or any of their Wilful neglect or default nor shall any of them be answerable or accountable for the Acts Deeds Receipts or Disbursements of the other of them but each of them shall be answerable only for his own separate Acts Deeds Receipts and Disbursements

And I declare this and none other to be my last Will and Testament

In Witness whereof I the said Thomas Hill the testator have to this my last Will and Testament written on two Sheets of Paper set my hand and Seal That is to the first Sheet thereof my hand and to this last Sheet thereof my hand and seal this fifteenth day of February in the year of our Lord One thousand eight hundred and nine

Signed sealed published and declared by the within named Thomas Hill the testator as and for his last Will and Testament in the presence of us who have at his request in his presence and in the presence of each other subscribed our names as Witnesses to the due execution thereof having first that the Words “in lieu of the Rooms which I am bound to find her in my dwelling House during her Widowhood” were interlined

Let probat be granted to Richard Hill & Richard Reavill joint Executors of the within written will they being sworn to the due Execution of it & made oath that the whole personal Estate of the Testator at the time of his death did not amount to the sum of Two Hundred pounds
