John Haywood of Harby 1821 Will

This is the last Will and Testament of me John Haywood of Harby in the county of Leicester InnKeeper as follows

First I desire my just Debts Funeral and testamentary expences to be fully paid

I Give Devise and bequeath all that my Close of Ground inclosed situate in the Lordship of Hose in the said County with the Appurtenances And also All my Personal Estate and Effects of what nature or kind the same may be unto my two friends William Shilcock of Hose aforesaid and William Marshall of Orston in the county of Nottingham their Heirs Executors Administrators and Assigns for ever But upon this Special trust ad confidence nevertheless that they my said two friends and the survivor of them his Heirs Executors and Administrators do and shall stand seized and possessed of All my said Close or Ground inclosed and Personal Estate and Effects and pay the Rents issues and Profits of all my said Real and Personal Estate and Effects unto my Dear wife Francis [sic] Haywood for and during the term of her natural life for the support of herself and my three Children William John and Ann Haywood in case she continues my Widow and not otherwise And from and After her death or Marriage which shall first happen then I direct my said two friends William Shilcock and William Marshall and the Survivor of them his Heirs Executors and Administrators to continue to stand seized of the said Real and Personal Estate and Effects for the benefit of my three Children William John and Ann Haywood until my youngest Son John shall attain his full age of twenty one years and when and so soon as he attains such Age then I Give and Devise the said Close or Ground inclosed and premises unto my two Sons William and John Haywood their Heirs and Assigns for ever to take as tenants in Common and not as joint tenants

And as to the whole of my Personal Estate and Effects (subject to the payment of my just Debts Funeral and testamentary expences and the Legacy hereinafter bequeathed to my said Daughter Ann Haywood) after my said Son John shall have attained his full age of twenty one years then I Give and bequeath the same unto my said two Sons William and John Haywood their Executors Administrators and Assigns in equal Shares and proportions

I Give and bequeath unto my said Daughter Ann Haywood the sum of two hundred and fifty pounds which I will shall be paid to her by my said Trustees out of my Personal Estate in the proportions and at the times following that is to say the sum of One hundred pounds part thereof when she shall have attained her full age of twenty one years or on the day of her marriage which shall first happen and the remaining Sum of One hundred and fifty pounds immediately after the decease or marriage of my said wife in case such death or marriage happens after my said Daughter has attained to her age of twenty one but if my said Daughter should be under Age at the time of my said Wifes death or marriage then I direct my said Trustees to retain the same in their hands until she shall have attained such age and then to pay or transfer the same to her accordingly

I direct an Inventory of my Personal Estate and Effects to be Written by my Trustees immediately after my death

And I nominate and appoint my said two friends William Shilcock and William Marshall joint Executors in trust of this my last Will and Testament hereby revoking all other wills by me made Provided and my will is that my said trustees and Executors and the survivor of them his heirs Executors and Administrators shall reimburse and indemnify themselves all costs charges and expences they may be put to in the execution of this my Will Nor shall they or either of them be answerable for the loss of any monies they may receive unless it happen through their wilful neglect or default nor the one of them for the other of them but each for his own acts and defaults only

In Witness whereof I have hereunto set my hand and seal this thirteenth day of March One thousand eight hundred and seventeen

Let a probat be granted to William Shilcock of Hose in the County of Leicester Farmer & Grazier & William Marshall of Orston in the County of Nottingham Farmer joint Executors named in the Will of John Haywood who died at Harby on the 16 day of August 1821

They the said William Shilcock & William Marshal being duly sworn to the faithful Execution of the Will as that the Testator’s Goods, Chattels & Credits as they were at this death without deducting any debts owing by him therefrom did not amount in value to the sum of two hundred pounds
