Thomas Hart of Long Clawson 1846 Will

The last Will and Testament of me, Thomas Hart Senior, of Claxton otherwise Long Clawson in the County of Leicester, Collar-maker

I Do hereby order, and Direct, that all my just Debts, Funeral and Testamentary expenses, shall be fully paid, and satisfied, as soon as conveniently may be after my decease by my sole Executor hereinafter mentioned

I hereby give and Bequeath to my two Sons, Thomas and Richard Hart, all my Household Furniture, Beds, Bedding, Goods, Chattels &c either to be sold or equally divided between them, as they think most proper

Also I hereby Give and Bequeath to my two Sons, Thomas and Richard Hart, all those three Closes of Land belonging to me, lying near the Hickling Lane and in the Possession of Richard Chester (save and except the sum of one Hundred and Thirty pounds, which sum I do order and direct my Son Richard Hart to pay out of his share of the aforementioned three Fields, to my Son Thomas Hart, except the above named sum be paid before the execution of this my last Will and Testament, in which case they shall both have equal shares) either to sell or let as my Two Sons can agree

I hereby make and appoint my two Sons Thomas and Richard Hart joint Executors of this my last Will and Testament in so far as the three Fields above mentioned are concerned but in nothing further

Also I do hereby nominate, constitute and appoint William Lovitt, Farmer of Claxton, otherwise Long Clawson, in the County of Leicester, to be my Trustee of this my last Will and Testament

Also I give and Bequeath to my Son Thomas Hart (whom I likewise constitute, made and ordain,  Sole Executor of this my last Will and Testament in all matters except the three Fields above mentioned) all and singular the Messuage or Tenement now occupied by me, with the Yard, Garden, Orchard, and Homestead by his heirs and assigns for ever freely to be possessed and enjoyed And I do hereby utterly disallow, revoke, and disannul, all former Wills by me made

In witness hereof I, the said Thomas Hart Senior, the Testator, have to this my last Will and Testament, set my Hand and Seal, this Fifteenth Day of June One thousand Eight hundred and Forty two

Published, and Declared, by the said Thomas Hart Senior, the Testator, as and for his last Will and Testament, in the presence of us who at his request, and in his presence, and the presence of each other, have subscribed our names as Witnesses

Thomas Hart of Claxton otherwise Long Clawson in the County of Leicester Collar and Harness Maker the sole Executor in this Will named was duly sworn to the Truth and faithful performance thereof as usual, and that the Goods Chattels and credits of the deceased do not amount in value to the Sum of Twenty Pounds and that the deceased died on the thirteenth day of February last past
