John Harby of Long Clawson 1881 Will

This is the last Will and Testament of me John Harby of Long Clawson in the County of Leicester Wheelwright

I bequeath all my furniture plate linen china books and household effects to my daughters Ann the wife of John Wightman, Mary Harby and Sarah Harby and my sons Thomas Harby and William Harby to be divided between them in shares as nearly equal as may be according to the uncontrolled judgment and discretion of my said Daughter Ann Wightman whose division shall be conclusive

I bequeath all the timber wood iron and other materials and stock in trade of or belonging to my said trade to my said Son Thomas Harby absolutely

I also bequeath all the Tools and Implements used or employed by me in carrying on my said trade to my said Sons Thomas Harby and William Harby in equal shares absolutely and I bequeath the following pecuniary Legacies namely

To my said Daughter Ann Wightman the sum of Eighty Pounds

To my said Daughter Mary Harby the sum of Ninety Pounds

To my said Son William the sum of Ninety Pounds

And to my said daughter Sarah Harby the sum of Eighty Pounds

And I direct each of the last mentioned Legacies to be paid within twelve calendar months after my deceased

I devise and bequeath all that my Messuage or Tenement together with the Wheelwrights shop Outbuildings Garden and appurtenances thereto belonging situate in Long Clawson aforesaid and in my own occupation and all other my real estate and all my personal estate not hereinbefore otherwise disposed of subject to and charged with the payment of my just debts funeral and testamentary expenses and the pecuniary legacies bequeathed by this my Will to my said Son Thomas Harby absolutely

I devise all Estates vested in me as a Trustee or Mortgagee to my said Son Thomas Harby his heirs and assigns subject to the trusts and equities affecting the same respectively and I appoint my said Son Thomas Harby sole Executor of this my Will

In Witness whereof I have hereunto set my hand this Third day of February One thousand eight hundred and eighty

The Testator John Harby was late of Long Clawson in the County of Leicester Wheelwright and died on the Eighth day of January 1881 at Long Clawson aforesaid
