Richard Guy of Plungar 1835 Will

This is the Last Will and Testament of me Richard Guy of Plungar in the County of Leicester Gentleman as follows

First I commend my Soul to God in full hope of Eternal Life through the merits and mediation of my Blessed Lord and Savour Jesus Christ

Secondly As to the Property wherewith it has pleased God to bestow on me I dispose of in manner following that is to say

I direct all my just debts Funeral and Testamentary Expences to be paid after my decease out of my personal Estate

I give and bequeath To the Treasurer for the time being of the Fund for the support of superannuated Wesleyan Methodist Teachers the Sum of Two Hundred Pounds out of my personal Estate and no part thereof to be payable out of my real Estate Which said Legacy I do direct shall be paid by my Executor George Wells within Twelve months after my wife’s decease and I do declare that the Receipt of such Treasurer shall be a good and effectual discharge for the same

And as to all the Rest Residue and Remainder of my Estate consisting of Goods Household Goods and Furniture Plate Linen Books China Cattle Crops Chattels and Effects Messuages Lands Tenements Hereditaments and Premises and all other my real and personal Estate whatsoever and wheresoever and of what nature or kind soever of which I am or at my decease by any acquisition hereafter shall be seized or possessed of or in any way entitled unto or otherwise which I have or shall have any power to dispose of by this my Will and all such right and Interest in and to the same as I have or shall have power to dispose of including all Sums of money Stocks Funds and Securities according to the natures of the Property respectively I give devise and bequeath the same to my Dear wife Ann Guy for and during the Term of her natural Life and from and immediately after the decease of my said wife Ann Guy I give devise and bequeath all my said real and personal Estate unto my Nephew George Wells his Heirs Executors Administrators and Assigns for ever subject nevertheless and I declare the same with the payment of the following Legacies that is to say I give and bequeath to each of my Nephews Edward Wells Joseph Wells and Samuel Wells and to my Nieces Ann the wife of Charles Leavers and Elizabeth the wife of – [- in the original] Duffty [?[] the Sum of Six Hundred Pounds apiece to and for their own use and benefit

I give and bequeath to my Nephews Andrew Wells and Richard Wells the Sum of Four Hundred Pounds apiece to and for their own us and benefit

I give and bequeath to my Great Nephew Guy Wells Eldest Son of my Nephew Richard Wells the Sum of Two Hundred Pounds to and for this own use and benefit at his age of Twenty one years in case he is under age at my wife’s decease

All which said Legacies I do direct shall be paid within Twelve months after my wife’s decease and all Legacy Duty payable on the aforesaid Pecuniary Legacies as well as the aforesaid Legacy of Two hundred Pounds so given To The Treasurer of the Wesleyan Superannuated Methodist Teachers shall be paid by the said George Wells

And Lastly I do hereby nominate constitute and appoint my said wife Ann Guy and my said Nephew George Wells Executrix and Executor of this my Will

And I do hereby revoke annul and make void all former and other Will and Wills by me at any time heretofore made and do declare this to be may last Will and Testament

In witness whereof I the said Richard Guy the Testator have to this my last Will and Testament contained in two Sheets of Paper set my hand and Seal to the first Sheet thereof my hand and to this Second and last Sheet thereof my hand and Seal the Fifteenth day of July one thousand eight hundred and thirty three

In the Goods of Richard Guy late of Plungar in the County and Archdeaconry of Leicester Gentleman deceased

3rd July 1835

Let a Probate be granted to Ann Guy of Plungar aforesaid Widow and George Wells of Arnold in the County of Nottingham Farmer the joint Executors named in the Will of the deceased who died on the 16 day of November last past

The one residing within the Archdeaconry of Nottingham and the other …ing voluntarily interest in the purpose They having been duly sworn by Requisition addressed in the usual form to the Venerable George Wilkins Clerk Doctor in Divinity Archdeacon of the Archdeaconry of Nottingham lawfully constituted his Surrogate or any other competent Judge in this behalf as well to the faithful Execution of the Will as that the Testators Goods Chattels and Goods lying within the Diocese of Lincoln do not Amount in value to the sum of [blank] Pounds

Let Probate and Requisition pass

We Christopher Hodgson Master of Arts Commissary to the Right Reverend Father in God John by divine permission Lord Bishop of Lincoln for the Archdeaconry of Leicester lawfully constituted To the Venerable George Wilkins Doctor in Divinity Archdeacon of the Archdeaconry of Nottingham lawfully constituted his Surrogate or any other competent Judge in this behalf Whereas Richard Guy late of Plungar in the County and Archdeaconry of Leicester Gentleman departed this life on or about the sixteenth day of November last past having duly made and executed his last Will and testament and thereof appointed his Wife Ann Guy and George Wells joint Executors And Whereas the Reverend William Lowfield Fancourt Clerk Doctor in Divinity our Surrogate lawfully appointed rightfully and duly proceeding in the business of proving the said Will in due form of Law for Effects with the Diocese of Lincoln hath upon the Allegation that the said George Wells now resides within your Jurisdiction and that the said Ann Guy will voluntarily come into it for the purpose decreed a Requisition to be granted or made to you jointly and severally and your aid and assistance to be asked and desired in the premises in the manner and form following (Justice so requiring) We do therefor earnestly entreat and request you (In aid of Law and for supply of Justice) to administer unto the said Ann Guy and George Wells the oath hereunder specified and also to swear them to the truth of the affidavit hereunto annexed And further to do all such Acts Matters and things as shall be requisite or necessary to be done in and about the premises requesting furthermore that such oath being administered and Affidavit taken you will transmit to us our lawful Surrogate or some other competent Judge in this behalf the Will of the said Deceased and all your proceedings thereon authentically sealed and subscribed with the proper hand or hands of one or more of you for which shall receive the like favor from us when at any time required Given at Leicester under seal of our office the third day of July in the year of our Lord one thousand eight hundred and thirty five

The form of the oath to be administered to the Executrix and Executor laying their hands on the Bible or New Testament

Your oaths are that this paper Writing contains the true last Will and Testament of Richard Guy late of Plungar in the County of Leicester Gentleman deceased as far as you know or believe and that you will truly perform the same by paying first his debts and then the Legacies therein contained as far as his Goods Chattels and Credits will thereto extend and the law charges you and that you will make a true and perfect Inventory of all the said Goods Chattels and Credits and exhibit the same into the Registry of the Commissary’s Court for the Archdeaconry of Leicester at the time assigned you by the said Court and render a just account thereof when lawfully required, that the contents of the Affidavit hereto annexed to which you have subscribed your names were and are true and that the Goods Chattels and Credits of the said deceased lying within the Diocese of Lincoln do not amount in value to the Sum of Seven thousand Pounds So help you God

Saturday 4 July 1835 Ann Guy widow of Plungar and George Wells farmer of Arnold, Nottinghamshire appeared before George Wilkins clerk in Nottingham and swore to that the Will was the true last Will of Richard Guy late of Plungar deceased and that they would administer the estate and produce an inventory
