This is the last Will and Testament of me John Goodwin of Goadby Marwood in the County of Leicester Gentleman

First I direct all my just debts funeral and Testamentary Expences to be fully paid

I Give and Devise all those Messuages Dwellinghouses and Gardens with the homestead and appurtenances thereto belonging situate in Holwell in the said County of Leicester in the occupation of Thomas Sharpe and others and also all that Close of Land situate in the said Lordship of Holwell now in the occupation of William Morris (free from all sums of money which may be chargeable thereon at the time of my decease and which I direct shall be paid off by my Trustees hereafter named out of the Real and personal property hereinafter devised to them in Trust unto my Niece Lucy the Wife of Thomas Stanley her heirs and assigns for ever

Also I Give and bequeath the Legacy of Five hundred Pounds unto my said Niece Lucy Stanley her Executors Administrators and assigns absolutely And I do hereby direct that the said Legacy shall be paid to my said Niece by my said Trustees out of my Real or personal Estate hereinafter devised to them in Trust

I Give devise and bequeath all my Messuages or Tenements Closes Lands and Hereditaments situate at Scalford in the said County of Leicester and all other my Real Estate whatsoever (not hereinbefore disposed of ) And also all my personal Estate and Effects of what kind soever (subject to the payment of the aforesaid Legacy) Unto Joseph Copley of Melton Mowbray in the said County of Leicester and William Shipman of Waltham in the same County Farmers and Graziers their Heirs Executors Administrators and assigns Upon Trust that they the said Joseph Copley and William Shipman or the Survivor of them or the Heirs Executors Administrators and Assigns of such Survivor (hereinafter called my Trustees) do and shall yearly and every year receive the rents and yearly income arising from my said real and personal Estate and pay the same over unto and for the benefit of my Nephew John Carter during the Term of his natural life and from and immediately after his decease then I direct my said Trustees or Trustee to pay over or apply the rents and annual income as aforesaid unto Elizabeth the Wife of the said John Carter during her natural life or so long as she continues his widow

And from and immediately the death or Marriage of the said Elizabeth Carter Then I Give and Devise all such remainder of my said Real and personal Estate and Effects (subject to the payment of the two legacies hereinafter bequeathed) Unto John Thomas Carter (the Son of the said John Carter) his heirs Executors Administrators and Assigns absolutely

I Give and bequeath unto Lucy Ann Carter and Elizabeth Carter (the two Daughters of the said John Carter) the Legacy or sum of Four hundred Pounds apiece absolutely which sums I expressly charge upon my real and personal Estate hereinbefore devised and bequeathed to their brother and which I direct him to pay to each of them out of such property within six months after the decease of the said survivor of them the said John Carter and Elizabeth his Wife or the second Marriage of the said Elizabeth Carter as the case may be

Provided always it is my Will And I do hereby expressly declare that for the purpose of paying the aforesaid Legacy of Five hundred Pounds or any money that may be required for the purpose of carrying out the Trusts of this my Will that it shall be lawful for my said Trustees or the Survivor of them to raise the same or any part thereof at any time and in such manner as they may consider necessary by Mortgage of the said last mentioned hereditaments or a competent part thereof And for that purpose by any deed or deeds instrument or instruments in writing by them duly executed and attested to grant or appoint the said hereditaments or any parts thereof to such person or persons for such uses and in such manner as they or he shall think proper for the purpose of effecting any such Mortgage as aforesaid And I expressly declare that the person and persons paying money to my said trustees on any such Mortgage as aforesaid shall not be bound to ascertain or enquire that the same is wanted for the purposes aforesaid or to see to the application of the money advanced by him or them or be accountable for the misapplication of the same

I Devise all Estates vested in me by way of Mortgage with the Appurtenances unto my said Trustees or Trustee according to the nature of the same premises subject to the equity of redemption therein but the money so secured to be considered as part of my personal Estate

And Lastly I hereby appoint the said Joseph Copley and William Shipman Trustees and Executors of this my last Will and Testament hereby revoking all former Wills by me heretofore made

In Witness whereof I the said John Goodwin the Testator have to this my last Will and Testament written on three sheets of paper to each of which I have set my hand this seventh day of June One thousand eight hundred and sixty one

On the thirteenth day of June 1862 the Will of John Goodwin late of Goadby Marwood in the County of Leicester Gentleman was proved by the Oaths of Joseph Copley and William Shipman the Executors named in the Will they having been first sworn duly to administer

Sworn under £100 and that the Testator died on the third day of March 1862
