This is the last Will and Testament of me Richard Goodson of Scalford in the County of Leicester Farmer

First I direct all my just debts funeral and testamentary expenses to be fully paid

I devise and bequeath all that my Close of Land situate at Scalford aforesaid and which I purchased of William Fox unto my affectionate Wife Elizabeth Goodson her heirs and assigns absolutely

I give all my Household Furniture Plate Linen China and other household effects of a like kind and also all my Brewing and Dairy Effects Horse Light Cart and Six Cows (to be chosen by my said Wife) And also the Legacy or sum of Four hundred pounds unto my said Wife Elizabeth Goodson for her own use absolutely

I give and bequeath unto each of my Trustees hereinafter named the Legacy or sum of Ten pounds absolutely

Whereas I have sufficiently provided for my Brother George Goodson in my lifetime by advancing to him certain sums of money in respect of which said advances I direct that no claim be made by my Executors Now therefore as to all the rest residue and remainder of my personal Estate and Effects of whatsoever nature or kind that same may consist of (after payment as aforesaid) I give and bequeath the same and every part thereof unto Thomas Morris of Wycomb in the County of Leicester Farmer and Edward Henry Maior Clarke of Melton Mowbray in the County of Leicester Gentleman their executors administrators and assigns Upon trust that they the said Thomas Morris and Edward Henry Maior Clarke or the survivor of them or the executors or administrators of such survivor hereinafter called the Trustees or Trustee do and shall as soon as conveniently may be after my decease sell call in and convert into money such part of the same personal Estate as shall not at the time of my decease consist of money and after payment of all expenses attending such sale or sales to invest the residue thereof in their or his names or name in and upon the Public stocks or securities of Great Britain or upon Government or real securities in England or in or upon the securities of any Company Incorporated by Act of Parliament and paying a Dividend with power for the said Trustees or Trustee to vary the said stocks funds and securities at their or his discretion and do and shall stand possessed of such Trust funds and securities Upon trust to pay and apply the whole of the interest dividends and yearly income arising from the said Trust funds and premises unto my said Wife Elizabeth Goodson for and during the term of her natural life provided she so long continue my Widow and from and after her decease or second marriage I give and bequeath the whole of the said Trust funds and premises (after payment of all expenses) unto and to be equally divided between my Niece Mary Kirk the Wife of John Nimmo of Melton Mowbray aforesaid Draper and all my other Nephews and Nieces the Sons and Daughters of my Sister Sarah Kirk, my late Sister Ann Holmes and my late Brother Joseph Goodson share and share alike absolutely or the issue of any such Nephews or Nieces as may be dead or may die in my lifetime such issue however only to take equally amongst them what would have been his her or their deceased parents share if living

I devise and bequeath all estates vested in me by way of mortgage with the appurtenances unto the said Thomas Morris and Edward Henry Maior Clarke their heirs executors and administrators according to the nature of the same premises subject to the equity of redemption subsisting therein respectively but the money secured on such Mortgage to be considered as part of my personal estate

I direct that the sections contained in part three of an Act of Parliament entitled An Act to give to Trustees and Mortgagees and others certain powers now commonly inserted in Settlements Mortgages and Wills share be considered as applicable to this my Will

I appoint the said Thomas Morris and Edward Henry Maior Clarke to be Trustees and Executors of this my Will hereby revoking all others by me at any time heretofore made and I declare that the said Edward Henry Maior Clarke shall be entitled to charge for all professional business done by him in relation to the trusts hereof in the same manner as he might have done if he had not been made an Executor hereof

In Witness whereof I the said Richard Goodson the Testator have to this my last Will and Testament written on this and the preceding sheet of paper set my hand this second day of July One thousand eight hundred and seventy two

I Richard Goodson of Scalford in the County of Leicester Farmer declare this to be a Codicil to my last Will dated the second day of July One thousand eight hundred and seventy two

I hereby revoke the gift contained in my said Will of the Legacy or sum of Four hundred pounds unto my Wife Elizabeth Goodson and I direct that the same shall sink into and form part of my residuary personal Estate

In all other respects I confirm my said Will

In Witness whereof I the said Richard Goodson the Testator have hereunto set my hand this twenty fifth day of May One thousand eight hundred and seventy five

I Richard Goodson of Scalford in the County of Leicester Farmer declare this to be a second Codicil to my last Will dated the second day of July One thousand eight hundred and seventy two

I give and devise all that my Close piece or parcel of Pasture Land containing Three acres three roods and thirty perches or thereabouts situate lying and being in the Lordship of Stathern in the said County of Leicester now in the occupation of Jarvis Jackson unto Thomas Morris of Wycomb in the said County of Leicester Farmer and Edward Henry Maior Clarke of Melton Mowbray in the same County Gentleman (the Executors of my said Will) their heirs and assigns Upon trust that they the said Thomas Morris and Edward Henry Maior Clarke or the survivor of them or the heirs or assigns of such survivor (hereinafter called the Trustees or Trustee) do and shall as soon as conveniently may be after my decease sell the said Close piece or parcel of land either together or in parcels and either by Public Auction or Private contract with full power to buy in and rescind any contract for sale and to resell without being responsible for any loss occasioned thereby and to do all such acts and assurances for effectuating any such sale or sales as they or he shall think fit And I do hereby declare that the said Trustees or Trustee do and shall stand possessed of and interested in the moneys which shall arise from such sale or sales as aforesaid Upon trust in the first place to deduct and retain all costs charges and expenses which they or he shall have sustained or be put unto in the performance of the aforesaid trusts or in relation thereto

And then do and shall deduct and retain the sum of One hundred pounds and hold the same Upon and for the trusts intents and purposes in my said Will expressed and declared of and concerning the residue of my personal Estate in my said Will given and bequeathed it being my Will that the said sum shall be added thereto and form part thereof and be disposed of accordingly

And do and shall stand possessed of and interested in the residue or surplus of the moneys which shall arise from the sales aforesaid after answering the purposes aforesaid As to One moiety or equal half part thereof In trust for my Brother George Goodson absolutely

And as to the remaining moiety or equal half part thereof In trust for all my Nephew and Nieces the Sons and Daughters of my late Brother Joseph Goodson in equal shares absolutely Provided and I hereby expressly declare that in case any of the said residuary Legatees shall depart this life in my lifetime leaving lawful issue him her or them surviving that the issue of the Legatee or Legatees respectively so dying shall take and be entitled to (if more than one equally amongst them) the share or respective shares in the said trust monies and premises which his her or their parent or respective parents would have taken under the trusts aforesaid if he she or they had respectively survived me

And I declare that the said Edward Henry Maior Clarke shall be entitled to charge for all professional business done by him in relation to the aforesaid trusts in the same manner as he might have done if he had not been a Trustee

In all other respects I confirm my said Will

Proved at Leicester with two codicils on the Ninth day of February 1877 by the Oaths of Thomas Morris and Edward Henry Maior Clarke the Executors named in the Will to whom Administration was granted

The Testator Richard Goodson was late of Scalford in the County of Leicester Farmer and died on the Twelfth day of November 1876 at Scalford aforesaid
