John Gill of Nether Broughton 1787 Will

This is the Last Will and Testament of me John Gill of Nether Broughton in the County of Leicester Grazier

First I desire that all and every my just Debts and Funeral Expences be paid by my Executors hereinafter named

And also I Give and bequeath all my Household Goods other Goods Stock Cattle Chattels and all other my personal Estate whatsoever situate and depasturing in and upon my dwelling house and farm in Broughton aforesaid which I now rent of the Reverend Mr Greenaway unto my Brothers William Gill and Edward Gill and my Brothers in Law William Possnett and Thomas Baldock Upon Trust that they my said Trustees and the survivors and Survivor of them and the Executors and Administrators of such Survivor do and shall immediately after my decease enter into the possession of my said personalty and farm and take upon themselves the Management and Execution thereof untill my youngest Child shall attain to the age of Twenty one years or for so long time as they may continue in possession of the said farm as Trustees for my said Children and the interest benefits and profits arising therefrom (after payment of Rent and all other Expences that may be incurred in the Management and Execution of the Trusts hereby in them reposed) yearly and every year to pay and apply the same for the maintenance and Education of all and every my Children And when and as soon as my said youngest Child shall so attain to the Age of Twenty one years Then upon this further Trust that they my said Trustees and the Survivors and Survivor of them and the Executors and Administrators of such Survivor do and shall make a Division of the said Personal Estate and Effects that shall be so situate and depasturing upon my farm in Broughton aforesaid And all other my Personalty whatsoever in manner hereinafter mentioned (that is to say)

Four sixth parts thereof unto and among my three Sons John Gill Thomas Gill and Walter Gill in equal shares and proportions and the remaining two sixth parts unto my two Daughters Elizabeth Gill and Mary Gill in equal shares Provided always and my mind and Will is that in case my said Trustees shall not continue in the possession of the said farm untill my said youngest Child shall attain to the age of Twenty one years Then I do direct my said Trustees William Gill Edward Gill William Possnet and Thomas Baldock and the Survivors and Survivor of them and the Executors and Administrators of such Survivor to sell and dispose of my said Stock Cattle Chattels and personalty And the money arising therefrom (after payment of all Expences attending the same) to put and place out at interest upon one or more good and sufficient security or securities or make such other use thereof as they my said Trustees shall think proper And the interest and produce arising therefrom yearly and every year to pay for and towards the Maintenance and Education of all and every my Children untill my said youngest Child shall attain to the Age of twenty one years and when and as soon as he or she shall so attain to the Age of twenty one years Then to pay the said Principal sum and all interest that shall be due for the same unto and among all and every my Children in the shares and proportions before specified Provided further and my Will is that in case any of my said Children shall die before my said youngest Child shall attain to the age of Twenty one years then and in such Case I do direct the share or shares of him or them so dying to go and be paid to and amongst the Survivors and Survivor of them share and share alike

And my mind and Will further is that it shall and may be lawful for my said Trustees and the Survivors and Survivor of them and the Executors and Administrators of such Survivor to pay the distributive share or shares of my Personalty or any part thereof unto all or any of my said Children before my said youngest Child shall attain to the Age of twenty one years if they my said Trustees of the Survivors or Survivor of them or the Executors or Administrators of such Survivor shall think proper

And Lastly I do hereby nominate and appoint the said William Gill Edward Gill William Possnet and Thomas Baldock joint Executors of this my Last Will and Testament hereby revoking all former Wills by me made

In Witness whereof I the said John Gill the Testator have hereunto set my hand and seal this twenty third day of July in the year of our Lord one thousand seven hundred and eighty six

Signed sealed published and declared by the said John Gill the Testator as and for his Last Will and Testament written on two sheets of paper to each of the said sheets he hath set his hand and to the Last hath fixed his seal In the presence of us the Witnesses under Written who have at his request in his presence and in the presence of each other set our hands as Witnesses to the due execution of this his said Will

Let a Probat be made to William Gill, Edward Gill William Possnet & Thomas Baldock, the Joint Executors they being duly sworn as well to the faithful Execution of the Will, as that the Testators Goods, Chattels & Credits do not amount in Value to the Sum of six-hundred pounds
