Hugh Gill of Hickling 1728 Will, Inventory and Bond

In the name of god amen I Hugh Gill of Hickling in the County of Nottingham yeoman being mindfull of my Mortality doe make & ordaine my last Will & Testament in manner Following
Imprimis I will that All my just debts & my funeral expenses be fully paid & discharged
Allsoe I … make ordain constitute & appoint my loveing wife Margaret & my eldest son John joynt Executors of this my last Will & Testament
Also I Give & bequeath the sume of three hundred pounds of good & lawfull money of Great Britain which shall be raised & paid by my sd Extors out of my personal Estate to my two sons (Vizt) William and Hugh to be equally divided between them when they shall severally attain their ages of one & twenty years and the Interest thereof in the meantime to be applyed towards their maintenance & ducacon
Also I Give & Devise all those my two closes of meadow ground with their respective appts lying & being within the Manor or Lordship of Colson Basset in the sd County of Nottingham containing together by estimacon eighteen acres be the same more or lesse commonly called or known by the several names of the Bigger Beesom holme Meadow & the lesser Beesom holme meadow Together with the Impropriate Tythes belonging to and arising from the same two Closes unto my sd two sons William and Hugh their heirs & Assigns for ever to take as tenants in common & not as joynt tenants & not to accrue by Survivorship when they shall attain their several ages of one & twenty years
And whereas all my Copyhold lands at Baberton and Coddington in the sd County of Nottingham will fall to my youngest son Joseph at the decease of my sd wife as heir at Law according to the Custom of the Manor so that he will be well provided for and my will is that in the meantime my sd Extors doe take care of his Ducation and bringing up And in case that either of my sd two sons William or Hugh shall happen to depart this life before they shall attain their age of one and twenty years then my will & mind is that the survivor of them shall Inherit All the aforesd two Closes of meadow ground and the sd Impropriate Tyths thereof And also shall receive from my sd Extors the sume of one hundred and fifty pounds and my youngest son Joseph shall receive the sume of fifty pounds also from my sd Extors when he shall attain his Age of one & twenty years and in such case my sd son John shall be intituled to the sume of one hundred pounds of my personal Estate more than my sd wife shall be intituled to
And in case my sd son Joseph shall happen to depart this life before he shall attain the Age of one & twenty years so that my sd Copyhold Lands shall come to my sd son Hugh that then my sd son William shall Inherit All the aforesd two closes of meadow ground & the Impropriate tyths and shall be intituled to the sume of one hundred & fifty pounds and my sd son Hugh shall be intituled to the sume of fifty pounds onely when they shall attain their several ages of one & twenty years
And in case my sd son John shall happen to depart this life before he shall attain his age of one & twenty years & leave noe issue of his body lawfully begotten then my will & mind is that my next eldest son shall succeed him in his share of my personal estate as well as in his inheritance of my real estate and shall have no part … of my other Estate as a younger brother but shall be wholly excluded from the same
And in case that two of my sd three younger sons shall happen to depart this life before they shall attain their ages of one and Twenty years then my Will & mind further is that my youngest son shall have & enjoy the aforesaid two closes of meadow ground and the sd Impropriate Tyths And Alsoe All my sd Copyhold Estate to him his heirs & Assigns for ever And that my eldest son shall be entituled to all the sd sume of three hundred pounds hereinbefore appointed to be raised & paid out of my sd personal estate when he shall attain his age of one & twenty years
And my Will and mind further is that in all the aforesaid cases that if my sd son John or heir for the time being shall thinke fit to pay to his younger brother or younger brothers the full & just sume of four hundred and forty pounds of good & lawfull money of Great Britain in Lieu of the aforesd two closes of Meadow ground & the sd impropriate Tyths thereunto belonging then it shall & may be lawfull to & for my sd son John or other eldest son for the time being upon such paymt of the sd sume of four hundred & forty pounds as aforesd To hold & Enjoy the aforesd two closes of meadow ground together with the sd Impropriate Tyths thereunto belonging to him his heirs & assigns for ever any thing herein before contained to the contrary thereof notwithstanding
And whereas my Children being all under age & incapable to act for themselves therefore I doe hereby nominate & appoint my two Brothers in Law Mr Richard Gaskill [?] & Mr Henry Wilkinson to be Guardians & Trustees to my sd children & doe hereby Impower them to receive the yearly rents & profits of the sd two Closes of meadow ground and other the yearly produce & increase of the sd sume of three hundred pounds to be raised & paid out of my personal estate as aforesd And Alsoe the aforesd Impropriate Tyths and to apply the same rents & interest money towards to the maintenance & Ducacon of those of my sd younger sons as shall be entituled to the same according to the respective limmittacons aforesd and I doe hereby desire my said Trustees to Assist my sd Extors in the Execution & Management of their affairs
And Lastly I Doe hereby make & ordain this my last will and Testament hereby revoking all Former Wills & Testaments whatsoever by me at any time heretofore made
