Mary Faulks of Long Clawson 1911 Will

This is the last Will and Testament of me Mary Faulks of Long Clawson in the County of Leicester Spinster

I appoint my friend Henry Richmond of Long Clawson aforesaid Farmer to be the Sole Executor and Trustee of this my Will

I give devise and bequeath all my real and person estate and personal estate whatsoever and wheresoever (subject to the payment of my debts and funeral and testamentary expenses) unto my said Trustee Upon Trust to apply the rents of my said real estate (after providing for repairs and insurance) and the income of my said personal estate and such parts of the capital of my said personal estate as my said Trustee shall think fit for the proper lodging and maintenance of my brother George Faulks during his life and I desire that my furniture and  household effects shall not be sold at my death but shall be used by my said Trustee for furnishing a home for my said brother

And upon the death of my said brother I give devise and bequeath all my said real and personal estates unto my said Trustee Upon Trust to sell the same and to stand possessed of the proceeds of such sale after payment of the expenses attending the same Upon Trust to pay to my sister in law Kate Faulks the sum of One hundred pounds in recognition of any trouble she may have in looking after my said brother to the Trustees of Hickling Wesleyan Sunday Schools the sum of Twenty pounds and to William Beresford the tenant of one of my houses at Alfreton the sum of Fifty pounds and Upon Trust as to the residue thereof that he my said Trustee shall give and divide the same to and between any of the poorest of my relatives or any Charity or Charities and in such shares and proportions as my said Trustee shall in his uncontrolled discretion think fit And I declare that the receipt of two or more of the Trustees of the said Sunday Schools shall be a sufficient discharge to my said Trustee for the sum so as aforesaid bequeathed to them Provided always that my said Trustee may at any time during the life of my said brother sell all or any part of my said real estate upon such terms and under such conditions as my said Trustee shall think fit And I declare that my said Trustee shall invest the proceeds of any such sale as aforesaid and shall apply the income arising from such investments in the same manner as is hereinbefore directed with regard to the rents of my said real estate

And I declare that my said Trustee shall be entitled to be repaid out of my said estates all reasonable costs and expenses he may incur or be put to in carrying out the trusts of this my Will

And I hereby revoke all former Wills and testamentary dispositions made by me

This is a Codicil to the last Will and Testament of me Mary Faulks of Long Clawson in the County of Leicester Spinster which Will bears date the Eleventh day of December One thousand eight hundred and ninety nine

Whereas by my said Will I have bequeathed a legacy of Fifty pounds to William Beresford now I hereby revoke such bequest and I give and bequeath the said legacy of Fifty Pounds to my Friend Henry Richmond the Executor and Trustee of my said Will payable on the death of my brother George Faulks And in all other respects I confirm my said Will

In witness whereof I have hereunto set my hand this Seventh day of February One thousand nine hundred and four
