Richard Dunsmore of Harby 1833 Will

This is the last Will and Testament of me Richard Dunsmore of Harby in the County of Leicester Grazier

I give to my three Grandchildren John Richard and Sarah Maltby Children of my deceased daughter Mary Maltby the sum of Six hundred pounds to be equally divided amongst them and to be paid to such of them as shall have attained the age of twenty one years at my death within six months after my death and the each of them as shall then be under that age when he she or they shall respectively attain the age of twenty one years and at first that interest at the rate of four pounds per cent shall be applied towards my said Grandchildrens maintenance until the principal shall be paid If any of my said Grandchildren shall die under the age of twenty one years leaving a Children or Children such Child or Children shall take the share or of his her or their deceased parent but if any of them shall so die under the age of twenty one years without leaving a Child or Children then the share or shares of such shall go to the survivors or survivor of my said Grandchildren If all my said Grandchildren shall die under the age of twenty one years without leaving issue then the said sum of Six hundred pounds shall go among all the Children of my three daughters who shall live to attain the age of twenty one years or marry

I give the sum of Six hundred pounds to my two Granddaughters Mary and Sarah Lamming to be equally divided between them and to be paid at such times with such maintenance and in the event of their dying to go to their issue and in default thereof to the survivor of them as I have directed as to the Children of my daughter Mary Maltby and in case of both of them dying without issue under the age of twenty one years then the said sum of six hundred pounds to go to all the Children of my three daughters who shall live to attain that age or marry

I give to my Son William Dunsmore and my Great Nephew James Musson the younger their executors and administrators the sum of Six hundred pounds to be paid within six months after my death with interest at the rate four pounds per cent from the day of my death Upon Trust to place the said sum of Six hundred pounds out at interest on good security and pay such interest unto my daughter Jane Kemp for her life And I expressly I direct that the dividends or interest to arise from the said sum of Six hundred pounds shall be paid unto my daughters own hands that the same shall in no way be liable to the control or the debts or engagements of her Husband and that my said daughter shall have no power to sell or anticipate such interest And after the death of my said daughter I direct that the principal sum of Six hundred pounds or the funds on which it shall be invested shall be equally divided among such of my said daughters Children now born or hereafter to be born as shall live to attain the age of twenty one years with such maintenance and with such benefit of survivorship and in the event of their dying to go to their Children as I have directed in respect to my deceased daughter Mary Maltbys Children If all the Children of my said daughter Jane Kemp shall die without issue under the age of twenty one years then the said sum of Six hundred pounds shall go to all the Children of my daughters as shall live to attain the age of twenty one years or marry

I also give to the said William Dunsmore and James Musson the sum of fifty pounds to be paid on my death and the interest applied towards the maintenance of my Grandson Richard Kemp until he shall live to the age of twenty one years and on his attaining that age to pay to him the principal And I give a power to the Trustees if they think proper to advance any part of the principal for putting my said Grandson out apprentice or otherwise for his advantage during his minority If he shall die under the age of twenty one years then the said sum of fifty pounds or such part as shall not have been advanced shall go to his Brothers and Sisters I mean this fifty pounds to be in addition to his share which he will take with his Brothers and Sisters

It shall be lawful for my said Trustees to vary the funds on which the said sums of Six hundred pounds and fifty pounds shall be placed as they shall think proper And if either of them dies the survivor shall appoint another person a Trustee to act with him and so from time to time that the Trusts may be kept up until the objects of it are fully performed

Subject and expressly charged with the payment of all the above Legacies and my debts and funeral expences I give devise and bequeath all my Real and Personal Estate and Effects whatsoever of which I shall die possessed unto my only Son the said William Dunsmore his heirs executors administrators and assigns absolutely for ever

And I appoint my said Son William Dunsmore sole Executor of this my last Will and Testament hereby revoking all former Wills by me at anytime heretofore made

In witness whereof I the said Richard Dunsmore the Testator have to this my last Will and Testament contained on three sheets of paper set my hand and seal in manner following that is to say to the two first hereof my hand and to this third and last hereof my hand and seal this twenty fifth day of November in the year of our Lord one thousand eight hundred twenty three

Let a Probate be made to William Dunsmore of Harby in the County of Leicester Farmer the sole Executor named in the will of the deceased who died on the twentieth day of December last

He having been duly sworn as well to the faithful Execution of the Will as that the testator’s Goods Chattels and Credits within the Diocese of Lincoln without deducting any debts owing by the deceased therefrom did not amount in value to the Sum of Six hundred Pounds
