Henry Drake of Nether Broughton 1866 Will

This is the last Will and Testament of Henry Drake of Nether Broughton in the County of Leicester late Cowkeeper

First I direct that all my debts funeral and testamentary expenses be paid as soon after my decease as can conveniently be done

I Give and bequeath to my Brother Thomas Drake the whole of my personal Estate and Effects together with all my money and securities for money that may be in my possession at my decease out of which he shall purchase decent mourning for my sister Mary Doubleday the Wife of Henry Doubleday

I Give and devise to my Brother Thomas Drake Henry Redgard and my Nephew Henry Drake the whole of my real and freehold Estate consisting of two Messuages or Tenements with the appurtenances thereto belonging situate in Park Street New Lenton in the County of Nottingham In trust that they receive the rents and pay the same when so received in the following manner (viz)

The rent of one house occupied by George Stafford situate next to the Chapel shall be for the sole use and benefit of my Sister Mary Doubleday the Wife of Henry Doubleday during her life And at her decease I direct that the rent of the said House shall be received by or for the use of my Brother Thomas Drake or his Wife Mary Drake should she survive her husband Thomas Drake but should the above named Mary Doubleday survive after the decease of my Brother Thomas Drake or his Wife Mary Drake then the rents of both the two houses shall be for the sole use and benefit of the said Mary Doubleday during her life

I further direct that the rent of the house occupied by George Barrott shall be received by or for the use of my Brother Thomas Drake or his Wife Mary Drake should she survive her husband but if the before named Mary Doubleday decease before the death of my Brother Thomas Drake or his Wife Mary Drake then I direct that the rent of both houses shall be received by my Brother Thomas Drake or his Wife Mary Drake (should she survive her husband) during her life And I further direct that after the decease of my Brother Thomas Drake and his wife Mary Drake and Mary Doubleday the Wife of Henry Doubleday that the said two houses be sold either by public Auction or private Contract and the money derived by such sale be equally divided between my Nephew and Nieces (viz) Henry Redgard Charles Redgard James Redgard John Tomlinson and Henry Doubleday Sarah Ann Shephard the Wife of George Shephard Mary Ann Towle the Wife of Alfred Towle Emma Martin the Wife of William Jones Martin and Emma Drake the daughter of my Brother Thomas Drake but should any of the parties above named die leaving no issue Then their share or shares shall become the property of all the Sons and daughter of my Brother Thomas Drake in equal proportions

And I hereby appoint my Brother Thomas Drake Executor of this my Will hereby revoking and cancelling any former Wills made by me at any time

Proved at Leicester the twenty seventh day of June 1866 by the oath of Thomas Drake brother of the deceased the sole Executor to whom Administration was granted

The Testator Henry Drake was late of Nether Broughton in the County of Leicester Cowkeeper and died on the twelfth day of July 1863 at Nether Broughton aforesaid
