Levi Doughty of Harby 1852 Will

This is the last Will and Testament of me Levi Doughty of Harby in the County of Leicester Farmer and Grazier

I direct that all my just Debts funeral and testamentary Expences be fully paid and satisfied by my Executor and Executrix hereinafter named as soon as conveniently may be after my decease

I Give and Devise unto Levi Doughty Whittle son of my Niece Ann Whittle All that my Tenement or Building used and occupied as a Chapel situate at Harby aforesaid with the appurtenances which I have lately purchased of and from John Harston To Hold the said Hereditaments and premises unto and to the Use of the said Levi Doughty Whittle his heirs and assigns for ever

I Give and Bequeath Unto my nephew William Wass of Humby in the County of Lincoln Cottager one Annuity or clear yearly sum of five pounds free and clear of Legacy duty for and during the term of his natural life payable half yearly the first payment thereof to be make within Six calendar Months next after my decease

I Give and Bequeath all the rest residue and remainder of my personal Estate and Effects whatsoever and wheresoever and of what nature or kind soever unto my Niece Ann Whittle of Harby aforesaid Widow to and for her own use and benefit absolutely

I appoint the said Ann Whittle and Thomas Pickering of Bottesford in the County of Leicester aforesaid Ironmonger joint Executrix and Executor of this my Will

I declare that all receipts under the hands or hand of my said Executors or the Survivor of them his or her executors or administrators shall effectually discharge all persons paying them any or either of them monies under this my Will from all liability respecting the application of the same monies that my said Executors shall not be liable for each others acts but each only for his or her own acts and deeds and that they and the survivor of them his Executors or administrators shall not be liable for any involuntary losses happening to the Monies coming to their any or either of their hands or hand under this my Will and that they retain to themselves and allow their co trustee all costs and expences incurred in or incidental to the execution of this my Will

I revoke all former and other Wills by me at any time heretofore made

In Witness whereof I have hereunto set my hand this fourteenth day of November in the year of our Lord one thousand eight hundred and forty six

This is a Codicil to the last Will and Testament of me Levi Doughty of Harby in the County of Leicester Farmer and Grazier which Will bears date the fourteenth day of November One thousand eight hundred and forty six

I Give and devise all those my four Messuages Tenements or Dwelling houses with the Homestead and appurtenances thereto adjoining and belonging situate and being at Harby aforesaid lately purchased by me of and from Eustace Compton Kemp unto John Whittle Son of my Niece Ann Whittle of Harby aforesaid Widow his heirs and assigns To hold the same unto and to the use of the said John Whittle his heirs and assigns for ever Subject nevertheless and charged and chargeable with the payment by the said John Whittle his heirs and assigns of any principal sum of sums of money which my be due and owing from me upon the Mortgage or upon the deposit of the Deeds relating to the Title of the said Messuages and hereditaments and all interest thereon

In all other respects I confirm my said Will

In witness whereof I the said Levi Doughty the Testator have hereunto set my hand this tenth day of May in the Year of our Lord one thousand eight hundred and fifty one

Signed Published and Declared by the above named Levi Doughty the Testator as and for a Codicil to his last Will and Testament in the presence of us both then present together who in his presence at his request and in the presence of each other have hereunto subscribed our Names as Witnesses the same having been first read over and explained to him

Ann Whittle of Harby Widow and Thomas Pickering of Bottesford Ironmonger the joint Executrix and Executor in this will named were duly sworn to the truth and faithful performance thereof as usual and that the goods chattels and credits of the deceased without deducting any debts owing by him therefrom do not amount in value to the sum of Fifty Pounds and that the deceased died on the fourth day of July last past
