John Daft of Mountsorrel 1850 Will

This is the last Will and Testament of me John Daft of Mountsorrel in the County of Leicester Collar Maker

I Give and devise all my Messuages lands Tenements and real Estate whatsoever unto my Wife Elizabeth and her assigns for and during the term of her natural life if she shall so long continue my Widow but I direct her to pay thereout to my Daughter Sarah Stones the sum of two shillings and sixpence weekly and every week so long as she my said Wife shall enjoy the said real Estate and premises under this devise And I charge all my said real Estate with the payment of the said weekly sum accordingly and in case of nonpayment thereof I give to my said Daughter the same power to distrain upon my said real Estate for the same as Landlords have by Law for recovering Rent in arrear and I wish my Daughters Maria Forman and Elizabeth Watts and also my said Wife so far as she is interested in the same to allow my said daughter Sarah Stones to reside in that part of the House which was heretofore the property of William Greasley which is now in the occupation of Isaac Hornbuckle for the term of her natural life and without paying any rent for the same

And from and after the decease or second marriage of my said Wife Elizabeth whichever event shall first happen I give devise and dispose of all my real Estate as follows viz as to one undivided moiety or half part of the said House and Premises which heretofore belonged to the said William Greasley and which is now divided into two dwellings and which moiety or half part I bought of his son John Greasley I Give and devise the same to my daughter Maria Forman and her assigns for and during the term of her natural life without impeachment of waste and from and after her decease I Give and devise the same unto her Son Francis Forman his heirs and assigns for ever but the said Devises are upon condition that my said daughter Sarah Stones is permitted to reside in that part of the said House which is now in the occupation of Isaac Hornbuckle for her life without paying rent for the same

And as concerning the Messuage or Tenement Garden and premises in which I now reside and a Tenement adjoining thereto in the occupation of George Hewitt with the appurtenances all which premises were devised to me by the Will of my Father Samuel Daft And also the Common Right on Mountsorrel Hills which belongs to the said Messuage in my own occupation I give and devise the same and every part thereof unto my eldest daughter Elizabeth Watts and her assigns for and during the term of her natural life without impeachment of waste And from and after her decease I give and devise the same to her Son John Daft Watts his heirs and assigns for ever but I change and make liable the said Messuages or Tenements Common right and premises and also the Close containing three Acres or thereabouts next hereinafter by me devised with the payment of the said sum of Two shillings and sixpence weekly to my said daughter Sarah Stones during the term of her natural life such payment to commence at such time as the same shall cease to be payable by my said Wife and subject and charged with the said payment of two shillings and sixpence weekly

I Give and devise all that my Close containing three acres or thereabout situate in the South end of Mountsorrel and now in my own occupation and which I bought of Mr John Slater of Leicester unto my said eldest daughter Elizabeth Watts and her assigns for and during the term of her natural life without impeachment of waste and from and after her decease I Give and devise the same so charged and chargeable as aforesaid unto my said Grandson John Daft Watts his heirs and assigns for ever

And I give to my said Daughter Sarah Stones the same power of distraining upon all and every part of the premises so devised to my said Daughter Elizabeth Watts for life and then to her Son in fee for recovery of the said weekly sum of two shillings and sixpence and all arrears thereof as Landlords have by Law for recovering rent in arrear

And as concerning all that my Close in Rothley Plain containing two roods and twenty perches or thereabouts now in my own occupation and which was allotted to me on the inclosure of Charnwood Forest and Rothley Plain And also as concerning one Common right on Mountsorrel Hills which I purchased of Sergeant Major Coltman of Leicester and which Common right belonged to a Common right House formerly the property of John Hull but now belonging to [blank] Brearley I Give and devise the same and every part thereof to my Daughter the said Maria Forman and her assigns for and during the term of her natural life without impeachment of waste And from and after her decease I Give and devise the same unto my said Grandson Francis Forman his heirs and assigns for ever

And as to all other my real Estate whatsoever and wheresoever (if any) not by me before disposed of I Give and devise the same unto my said Grandson John Daft Watts his heirs and assigns for ever

And as concerning all my Household Goods and Furniture Stock Cattle Stock in trade Book debts and all other my personal Estate whatsoever I Give and bequeath the same and every part thereof unto my said Wife and my said Grandson John Daft Watts their Executors and Administrators In trust to permit and suffer my said Wife to have the use and benefit thereof for her life or widowhood and also the benefit which may arise from the carrying on of my Trade which I wish to be carried on under the Management of the said John Daft Watts her deducting a reasonable allowance by way of wages for his trouble in carrying on the same And from and after the decease of my said Wife or her second Marriage whichever shall first happen then I direct all the said Goods Chattels Stock and other personal Estate to be converted into Money and the produce thereof to be applied first in the payment of my debts and funeral and testamentary expences and then in payment and discharge of the debt or sum of Forty pounds and interest which I owe upon security of the moiety of the House late William Greasleys and which I bought of the said John Greasley and which debt or sum of Forty pounds and Interest I direct my said Executors to pay and discharge accordingly

And the remainder of the said Monies and premises after the payments aforesaid I Give to my said Grandson John Daft Watts for his own use absolutely And I appoint my said Wife and my said Grandson John Daft Watts Executors of this my Will hereby revoking all former Wills by me made

In Witness whereof I the said John Daft the Testator have to this my Will subscribed my name at the foot thereof this twenty first day of November in the Year of Our Lord One thousand eight hundred and forty six
