John Cox of Scalford 1792 Will

This is the Last Will and Testament of me John Cox of Scalford in the County of Leicester Cordwainer as follows

In the first place I Give and devise All that Messuage or Tenement with the yard Garden Homestead and Appurtenances to the same belonging situate standing and being in Scalford aforesaid and now in the Occupation of Susannah Roberts Widow her Assignee or Assigns unto my dear and loving Wife Mary Cox and her assigns for and during the term of her natural life

And from and immediately after the decease of my said Wife I Give and devise the said Messuage or Tenement Hereditaments and Premises unto my Relation John Wilford of Burton Lazers in the said County of Leicester Grazier his heirs and assigns To hold the same unto and to the use of the said John Wilford his heirs and assigns for ever subject nevertheless and Charged and Chargeable as hereinafter mentioned vizt

I Give and bequeath unto my Nephew William Cox the sum of Fifty pounds which I Will shall be paid to him at the end of Six Calendar months next after the decease of my said Wife And I do hereby subject and Charge the said Messuage or Tenement Hereditaments and premises with the just and true payment thereof accordingly

Also I Give and devise all that Close of Meadow or Pasture Ground inclosed situate lying and being in Scalford aforesaid containing by Estimation four Acres or thereabouts and called or known by the Name of Priestalls Close now in my own possession with the Appurtenances unto my said Wife Mary Cox and her Assigns for and during the term of her natural life

And from and immediately after her decease I Give and devise the said Close and premises unto my two Friends Robert Hind of Melton Mowbray in the said County of Leicester Currier and Thomas Wilford of Scalford aforesaid Grazier (youngest son of William Wilford) and to their heirs Upon this special Trust that they the said Robert Hind and Thomas Wilford or the survivor of them or the heirs of such Survivor do and shall as soon as conveniently may be after the decease of my said Wife make sale of the said Close Hereditaments and Premises either by Public Auction or private Contract as to them or him shall seem meet And for Facilitating such Sale my Will is And I do hereby declare that the receipt or receipts of the said Robert Hind and Thomas Wilford or the Survivor of them or the heirs of such Survivor shall from time to time be a good and sufficient discharge or good and sufficient Discharges to the Purchaser or Purchasers of the said last mentioned premises his her and their respective heirs Executors Administrators and Assigns for so much Purchase money as shall be therein acknowledged or expressed to be received and that such Purchaser or Purchasers his her or their heirs Executors or Administrators or any of them shall not afterwards be answerable or accountable for any loss nonapplication or misapplication of such Purchase money so received or any part thereof

And upon Trust that they my said Trustees or the Survivor of them his heirs Executors or Administrators do and shall pay and dispose of the Purchase money to arise from the sale of my said last mentioned Hereditaments and premises in manner hereinafter mentioned (that is to say)

Unto my Nephews and Nieces Francis Cox Mary Cox the said William Cox and Elizabeth Tyers (the Children of my Brother James Cox) the sum of Thirty Pounds apiece to my Brother George Cox the sum of Ten pounds and to Ann his Daughter the sum of Twenty Pounds to my Nephew George Cox the sum of Ten pounds and to my said Brother James Cox the sum of Ten pounds And if it shall happen that there shall be a surplus of such Purchase money remain after payment of the said several Legacies Then my will is that such Surplus Purchase money shall be by my said Trustees paid unto and amongst all my said several Legatees in equal shares and Proportions

Provided always that if any one or more of my said Legatees hereinbefore mentioned shall happen to die in the life time of my said Wife Mary Cox Then my Will is that the Legacy or Legacies share or shares of the Purchase money aforesaid of him her or them so dying shall go and be paid to the Executors Administrators or Assigns of such Legatee or Legatees so dying as aforesaid respectively and shall not by any means sink in for the benefit of my Executrix or her Executors or Administrators

And Lastly I Give and bequeath all my Household Goods other Goods Stock Cattle Chattels rights Credits ready money and Securities for money and all other my Personal Estate whatsoever and wheresoever unto my said Wife Mary Cox whom I do hereby nominate constitute and appoint full and Sole Executrix of this my last Will and Testament hereby revoking all former Wills by me made

In Witness whereof I the said John Cox the Testator have hereunto set my hand and Seal this third day of March in the year of our Lord One thousand seven hundred and ninety two

Signed Sealed Published and declared by the said John Cox the Testator as and for his last Will and Testament in the presence of us who have at his request in his presence and in the presence of each other set our hands as witnesses to the due Execution thereof

I John Cox of Scalford in the County of Leicester Cordwainer do make this present Codicil to my last Will and Testament annexed and which I order and direct shall be taken as and for part thereof

And I do hereby Will and Direct that my Trustees Robert Hind and Thomas Wilford or the Survivor of them his heirs Executors or Administrators shall pay out of the purchase money to Arise from my Close and premises the sum of Thirty pounds unto my Niece Hannah Reeve And then divide such purchase money between her father payment of the several specific sums in my said Will contained and my several Legatees in manner therein mentioned

I Give and bequeath unto my said Nephew William Cox and unto my Nephew John Cox (the Son of my Brother George Cox) the sum of Thirty pounds apiece Which I Will shall be paid to them respectively within twelve months next after the decease of my Wife Mary Cox

And I do hereby subject and Charge all and singular my personal Estate and premises in my said Will given to her my said Wife with the just and true payment of such Legacies accordingly

And I do by this my Codicil establish ratify and Confirm all and every the uses Trusts Gifts Legacies and bequests in my said Will contained and which are not hereby revoked or altered

Let probat be granted to Mary Cox the sole executrix of the will within written & codicill annexed; who was sworn to the due Execution thereof, & also made oath that the whole personal estate of the Testator did not amount to the sum of Three hundred pounds
