James Cooke of Long Clawson 1896 Will

This is the last Will and Testament of me James Cooke of Long Clawson in the County of Leicester Farmer

I revoke all Wills and testamentary dispositions heretofore made by me

I appoint Edmond Roadley of Scotter in the County of Lincoln Arthur Brown of Long Clawson aforesaid Farmer and William Cooke of the same place Farmer Executors and Trustees of this my Will and I bequeath to them my said Trustees all my real and personal estate whatsoever and wheresoever to be held by them in trust as hereinafter mentioned until my Nephew James William Bramford shall attain the age of twenty one years if he shall so long live 

I direct my Trustees to stand possessed of all my personal estate during the before mentioned period Upon trust to pay thereout my funeral and testamentary expenses and subject thereto to permit my Nephew Edward Bramford to have the use and enjoyment thereof in specie and to carry on the Farm at present in my occupation at Long Clawson aforesaid and Abb Kettleby he providing a home for his Brothers and Sisters or such of them as shall for the time being unmarried And I expressly direct that during such time as my said Nephew Edward Bramford shall be permitted by my Trustees to have the use and enjoyment of my personal estate and to carry on the Farm my Trustees shall not be in any way responsible for the preservation of my residuary personal estate or for any losses which may be incurred in carrying on the said Farm And when my said Nephew James William Bramford shall attain the age of twenty one years or die under that age I direct my Trustees to make over my Furniture Farming stock and all other my residuary personal estate to my said Nephew Edward Bramford for his own absolute use and benefit Subject to the payment thereout of a Legacy of One hundred pounds which I bequeath to my Niece Susan Rillie Bramford and a like Legacy of One hundred pounds which I bequeath to my said Nephew James William Bramford if he lives to attain the age of twenty one years

I further direct my said Trustees to stand possessed of all and singular my real estate during the minority of my said Nephew James William Bramford Upon Trust to receive the rents thereof and after payment thereout of the interest on the Mortgages subsisting thereon and the expenses of repairs and management to accumulate the surplus until my said Nephew James William Bramford shall have attained the age of twenty one years if he so long live And when my said Nephew James William Bramford shall have attained the age of twenty one years or in case of his death under that age I devise my said real estate subject to the several Mortgages subsisting thereon as follows (that is to say)

I devise to my Nephew Thomas Bramford a house Carpenter’s shop and other premises and Garden adjoining also a field adjoining the Sands Road called Rooklands containing about six roods in the occupation of Henry Hall all situate at Scotter aforesaid

I devise to my Niece Elizabeth Mary Bramford four tenements with their appurtenances and Gardens adjoining in the occupations of Charles Holland Hannah Hall Henry Hall and George Rennison situate on the Sands Road in the Village of Scotter aforesaid

I devise to my Niece Eliza Jane Bramford two Cottages with Gardens on the Gainsborough Road in the occupations of George Fitchett and Mrs Everett situate in the said Village of Scotter And I devise to my Niece Tacy Ann Bramford two Cottages and Gardens situate in High Street in the said Village of Scotter in the occupations of George Gurnell and Joseph Foster

I direct my Trustees to stand possessed of the sum devised from the accumulation of the rents of my real estate during the minority of my said Nephew James William Bramford after payment thereout of all expenses incurred in connection with the management of my said real estate Upon Trust in the first place to pay to my said Niece Eliza Jane Bramford a Legacy of Twenty five pounds and to divide the residue between my said Nephew Thomas Bramford and my said Nieces Elizabeth Mary Bramford Eliza Jane Bramford and Tacy Ann Bramford in equal shares as tenants in common

In witness whereof I have hereunto set my hand this Twenty second day of September One thousand eight hundred and ninety three

Signed and declared by the above named James Cooke the Testator as and for his last Will and Testament in the presence of us both being present at the same time who at his request in his presence and in the presence of each other have hereunto subscribed our names as Witnesses the word “Elizabeth” between the twenty first and twenty second lines from the top of the second page hereof having been first interlined
