Probate of the Will of John Collishaw

This is the last Will and Testament of me John Collishaw of Hickling in the County of Nottingham Grazier

Firstly I revoke all former Wills by me made

I give and bequeath unto my daughter Mary Dixon the sum of One hundred and seventy pounds in addition to what I have already given or advanced her to be paid to her at the end of twelve calendar months next after my decease for her own sole and separate use and benefit free and clear of and from the legacy duty or tax and all other taxes and deductions whatsoever and also independent of and free from the control or engagements of her present or any future husband And I do direct that the receipt of my said daughter alone shall be a good discharge for the same notwithstanding her coverture

I Give and bequeath unto my daughter Anne Collishaw the sum of Twenty pounds to be paid to her immediately after my decease and also the sum of Four hundred pounds to be paid to her at the end of twelve calendar months next after my decease for her own sole and separate use and benefit free and clear respectively of and from the legacy duty or tax and all other taxes and deductions whatsoever and also independent of and free from the controul or engagements of any husband with whom my said daughter Anne Collishaw may happen to intermarry And I do direct that her receipts alone shall be a good discharge for the said two last mentioned legacies notwithstanding her coverture

I give and bequeath unto my dear Wife Dorothy Collishaw and her assigns for and during the term of her natural life All those my two shares in the Grantham Canal Navigation with all the dividends which may be due or growing due thereon at the time of my death And from and immediately after the death of my said Wife I give and bequeath the said two shares unto and amongst all and every or any one or more of my said children Mary Dixon and Anne Collishaw and my Son William Collishaw and in such shares proportions manner and form as she my said Wife shall in or by any deed or deeds writing or writings to be by her executed in the presence of one or more credible witness or witnesses or by her last Will and Testament in writing or any writing purporting to be her last Will and Testament to be signed and published by her in the presence of two or more such witnesses direct limit or appoint give or bequeath the same And in default of any such appointment or as to the said shares or any part thereof respectively whereof no appointment shall have been made or to which the same shall not extend I direct that the said shares shall form part of my residuary personal Estate

I give and devise unto my Wife Dorothy Collishaw and her assigns for and during the term of her natural life All that my messuage or dwellinghouse situate in Hickling aforesaid wherein I now reside with the outbuildings gardens and appurtenances thereto belonging And also all that close called the Home Close and the Coal Wharf situate in Hickling aforesaid now also respectively in my own possession And from and immediately after her decease I give and bequeath the exclusive use and privilege of the great parlour in my said House and the Chamber over my Sitting Room unto my said daughter Anne Collishaw during such part of her life as she shall continue single and unmarried

And I give and devise all other my hereditaments and real Estate situate in Hickling aforesaid or elsewhere within the Kingdom of Great Britain And also my said messuage outbuildings lands and hereditaments so by me given and devised to my said Wife as aforesaid from and immediately after her decease subject to the use and privilege as aforesaid unto and to the use of my said son William Collishaw and of his heirs and assigns for ever Subject and chargeable nevertheless in and of my residuary personal estate to the payment of all my just debts and funeral and testamentary expences and of the several legacies or sums of One hundred and seventy pounds Twenty pounds and Four hundred pounds by this my Will given and also of the legacy duty or tax and all other taxes and charges whatsoever which shall or may be taxed or charge upon or in respect of the said legacies respectively

I give and bequeath unto my said wife all the monies or debts which shall be due or owing to me at the time of my decease in respect of the Coal business which I now carryon at the aforesaid Wharf and such two Cows belonging to my farming Stock as she shall make choice of absolutely And I give and bequeath unto my said Wife for her life the use but not the property of all my household goods and furniture books plate linen china beds bedding brewing vessels and other effects in or belonging unto my said house

And from and immediately after her decease I give and bequeath all the furniture of every description which shall be in or belong to the said great parlour and the Chamber over my said Sitting Room at the time of my decease unto my said daughter Ann Collishaw absolutely

And I give and bequeath all the rest residue and remainder of my personal estate and effects and also my said household goods furniture plate linen china beds bedding and other effects so by me given to my said Wife as aforesaid from and immediately after her decease unto my said son William Collishaw his executors administrators and assigns Subject nevertheless to the payment of my just debts funeral and testamentary expences and the said several legacies by this my Will given and the said legacy duty or tax

And lastly I hereby nominate constitute and appoint my said Wife Dorothy Collishaw and my said son William Collishaw Joint Executrix and Executor of this my Will

In Witness whereof I the said John Collishaw the Testator have hereunto set my hand and seal the nineteenth day of March in the year of our Lord One thousand eight hundred and eighteen
