This is the last Will and Testament of me John Caunt of Plungar in the County of Leicester Gentleman

First I order that all my just debts funeral and testamentary expenses and the several legacies hereinafter by me given be paid by my Executors and executrix hereinafter named

I give and bequeath unto my daughter Mary Blankley the wife of William Wood Stamp the legacy or Sum of four hundred pounds to be paid by my executors and executrix Twelve Calendar months after my decease

I also give and bequeath unto my son George Frederick Caunt and my daughter Catherine Caunt the legacy or Sum of four hundred pounds apiece to be paid to them as and so soon as they shall respectively attain the age of Twenty one years and in case either of them my said Son George Frederick Caunt or my said daughter Catherine Caunt shall die before he or she shall attain the age of Twenty one years then and in that case I will and direct that the legacy or Sum hereinbefore by me bequeathed to him or her so dying shall belong and be equally divided between and amongst the Survivors or Survivor of them the said Mary Blankley Stamp, George Frederick Caunt, and Catherine Caunt, share and share alike

And I do hereby further will and direct that in case my personal Estate shall be insufficient to pay the said legacies (after payment of my just debts funeral and Testamentary expenses) then I do hereby charge and make chargeable all my freehold House closes lands tenement and Hereditaments situate at Plungar aforesaid now in my own occupation with the payment of any such deficiency

I give and bequeath unto my Wife Mary Caunt one annuity of clearly yearly Sum of Twenty pounds a year for and during the Term of her natural life to be paid to her or her Assigns quarterly and the first payment thereof to begin and be made on the first quarter day which shall happen next after my decease

I also give and bequeath unto my Son William Caunt one annuity or clear yearly Sum of Forty pounds a Year for and during the Term of his natural life to be paid to him or his assigns quarterly (but not by way of anticipation) and the first payment thereof to begin and be made on the first quarter day which shall happen next after my decease

And I do hereby charge and make chargeable all that my said Freehold messuage closes lands tenements and hereditaments situate at Plungar aforesaid with and to the payment of the said annuities of Twenty pounds and forty pounds And in case the same annuities or any part thereof shall be unpaid for the space of fifteen days next after any of the days whereon the same is hereby reserved and made payable it shall and may be lawful for the said Mary Caunt and William Caunt or either of them their or either of their assigns to enter upon all and every or any part of the said Hereditaments charged with the said annuities as aforesaid and to distrain for the same or for so much thereof as shall be so in arrear and for all costs and charges occasioned by the non-payment thereof and to sell such distresses in like manner as for rent reserved by Lease or common demise

I give Devise and bequeath all that my House wherein I now dwell and all those my Closes Lands Hereditaments and premises situate at Plungar aforesaid containing by estimation Sixty Six acres be the same more or less now in my own occupation And also all that freehold messuage or Dwellinghouse and all those several freehold and Copyhold Closes lands Hereditaments and premises situate at Stathern in the said County of Leicester containing by estimation eighty Two acres be the same more or less now in my own occupation together with all and singular the rights members and appurtenances thereto belonging And All and singular my Household furniture plate linen and China ready money mortgages and all other Securities for money personal Estate and Effects of what nature or kind soever and wheresoever And all other my real estate whatsoever and wheresoever and of what nature or kind soever Unto my Son John Caunt To hold the said messuages or Dwellinghouses freehold and Copyhold closes lands hereditaments and all and singular other the premises with their and every of their appurtenances Unto and to the only proper use and behoof of my said Son John Caunt his Heirs and assigns for ever Subject nevertheless and charged and chargeable in such and the same manner as the same are hereinbefore by me charged and made chargeable

And Lastly I do hereby nominate constitute and appoint my Brother William Caunt of Plungar aforesaid Gentleman, my said Son the said John Caunt, George Wells of Plungar aforesaid Gentleman, and my sister Alice Caunt of Plungar aforesaid Spinster joint Executors and Executrix of this my Will hereby revoking all former and other Wills by me at any time heretofore made

In Witness whereof I the said John Caunt the Testator have to this my last Will and Testament contained in three Sheets of paper set my Hand and seal to wit to the Two first Sheets thereof my Hand and to this third and last Sheet thereof my Hand and Seal this fifth day of June in the year of our Lord one thousand eight hundred and Thirty Six

Signed sealed published and declared by the said John Caunt the Testator as and for his last Will and Testament in the presence of us who in his presence at his request and in the presence of each other have hereunto set our names as Witnesses to the execution thereof the interlineation in the nineteenth line of this Sheet having been first made

This is a Codicil to the last Will and Testament of me John Caunt of Plungar in the County of Leicester Gentleman bearing even date herewith

Whereas under my said Will I have given and bequeathed unto my son George Frederick Caunt and my daughter Catherine Caunt the Legacy or Sum of four hundred pounds apiece to be paid to them as and so soon as they shall respectively attain the age of Twenty one years Now I do hereby empower my Executors and Executrix in my said Will named to invest the said Sum of eight hundred pounds in the public funds or other good and sufficient Security and to receive the Interest Dividends and annual proceeds thereof and to pay and apply the same in and towards the maintenance and support of my said Son George Frederick Caunt and my daughter Catherine Caunt until they shall respectively attain the age of Twenty one years and when and so soon as they shall respectively attain the age of Twenty one years then to pay to each of them the said Sum of Four hundred pounds for his and her own use and benefit

And I do hereby confirm my said Will in all other respects but do declare this to be taken and considered as part thereof

In Witness whereof I the said John Caunt the Testator have to this my Codicil set my hand and Seal this Eighth day of June in the year of our Lord one thousand eight hundred and thirty six
