In the name of God Amen the four & twentieth day of January in the three & thirtieth yeare of the Raigne of our Soveraigne Lord King Charles the second over England &c Annoq Dni 1681 I John Cant of Wartnaby in the Countie of Leicester gentleman being of good & perfect memory (praysed be God) Do make my last will & testament in manner following

And first I give & bequeath my Soule to Allmighty God my Creator hopeing assuredly through the Merritts of Jesus Christ my onely Saviour & Redeemer to be made partaker of everlasting life And for my body I Comitt to the Earth to be buryed in a decent manner in the Church of Wartnaby aforesaid at the discretion of my Executrix herafter named

And both for my Reall & personall Estate I dispose thereof as hereafter followeth

Item I give & bequeath unto my eldest sonne Mathew Cant his heires & Assignes for ever All that my Capitall Messuage or Tenement with the appurtenaces scituate & being in Wartnaby aforesaid And all those six yard land of arrable land Meadowe and Pasture ground with the appurtenances lyeing & being in the fields Liberties & precincts of Wartnaby aforesaid to the aforesaid Capitall Messuage or tenement belonging & appertaining now in the tenure or occupacon of me thesaid John Cant And alsoe all that Close of meadowe ground with the appurtenances lyeing & being in Wartnaby Woulds to the aforesaid Captiall Messuage or Tenement & six yard land belonging & therewithall now used & enjoyed now alsoe in the Tenure or Occupation of mee the sayd John Cant And alsoe those three severall Cottages or Tenements with their & every of their appurtenances now in the severall tenures of occupations of Robert Freck Robert Peight & Edward  Jackson Together will all &singular houses edifices buildings barns stables orchards gardens yards backsides Closes lands ends leyes meadowes pasture ground Comons comon of pasture profits Comodityes Emoluments & hereditaments whatsoever to the sayd Capitall Messuages or tenement six yard land and Meadow upon the Woulds & three cottages or tenements or any of them belonging or in any wise appertaining unto him the sayd Mathew Cant his heirs and assignes for ever

Item my will & mind is that my said Sonne Mathew Cant shall pay unto my beloved wife Anne Cant the Sume of Eight pounds of lawfull Money of England for & dureing the terme of her naturall life Att four several Dayes or tymes in the yeare that is to say at the Feast of St Michael Tharchangell the Nativity of our blessed Lord & Saviour the Annunciation of the blessed Virgin Mary and St John the Baptist by even & equall porcons the first payment thereof to begin at such of the sayd Feasts as shall happen after he the sayd Matthew Cant shall attaine to the Age of One & twenty & in the interim to be at the sole dispose of the sayd Anne Cant if she the sayd Ann Cant do deliver up her Joynture which she hath setled to her for her naturall life out of my aforesaid Messuage & Lands in Wartnaby aforesaid to be made null & voyd

And if it shall happen that the aforesaid Annuity or yearly rent of Eight pounds per Annum or any parcell thereof shalbe behind or unpaid in part or in all by the space of twenty days after he the sayd Matthew Cant shall attaine the Age of one & twenty and the sayd Anne shall deliver up her Joynture to be cancelled That then it shall and may be lawfull to and for the sayd Anne & her Assignes into all or any of the aforesaid Capitall Messuage or tenement six yard Land Meadow and three Cottages or tenements and premisses with thappurtenances in Wartnaby aforesaid or any parcel thereof to enter And the same & the goods chattles & cattle thereupon remaining & being to sell & dispose of the same untill the same Annuity or yearly Rent of Eight Poundes and the Arrearages thereof (yf any shall happen to be) shalbe fully satisfied & payd rendring the surplus to the sayd Mathew Cant his heirs & Assignes And my Will & Mynd is that the sayd Ann shall hold & enjoy thaforesaid Capitall Messuage or tenement six yard Land Woulds Close and three Cottages or tenements with thappurtenances & every parcell thereof untill the sayd Mathew Cant shall attaine to the Age of One & twenty for the maintenance & Education of the sayd Matthew & the raysing of porcons for my younger children

Item I give & bequeath alsoe unto my said Son Mathew Cant (after the decease of my said wife Anne) All that messuage or tenement with thappurtenances scituate & being in Grimston in the sayd Countie of Leicester & three quarters of a yard land & other parcells of Arrable lands Leyes meadows & pasture ground lying & being within the fields & precincts of Grimston aforesaid to the sayd Messuage or tenement belonging now in the tenure & occupation of Robert Adcock To hold unto him the sayd Matthew Cant his heires and Assignes for ever

Item I give & bequeath unto the sayd Matthew Cant (after the decease of my said wife Ann) All that my Close of Meadowe or pasture ground with thappurtenances lyeing & being within the fields & precincts of Hollwell in the sayd Countie of Leicester now in the tenure & Occupacion of John Goodicary unto the sayd Mathew Cant his heires and Assignes for Ever

Item I give & bequeath unto the sayd Mathew Cant his heires and Assignes for ever all other my lands tenements and hereditaments whatsoever in Wartnaby Grimston and Hollwell aforesaid

Item I give & bequeath unto John Cant my Second Sonne and his heires and assignes for ever all that my Messuage or Tenement with thappurtenances scituate and being in Barrow upon the Soare in the sayd Countie of Leicester now in the occupation of William Cox And alsoe all those severall parcells of arrable land Leyes Meadow & Pasture ground with the appurtenances Lyeing and being within the fields & precincts of Barrow upon the Soare aforesaid containing by estimation three score Acres or thereabouts to the sayd Messuage or tenements belonging now alsoe in the tenure or occupation of the sayd William Cox together withall and singular houses edifices buildings Barnes Stables Orchards Gardens Yards backsides Commons profitts Emoluments & hereditaments whatsoever to the sayd Messuage or tenement and severall parcells of Arrable Land belonging

Item I give and bequeath to my sayd Sonne John Cant and to his heires and Assignes for ever All that my Moyetie or halfe part of a Close lyeing and being in Barrow uppon the Soare aforesaid to the same messuage or tenement belonging comonly called or known by the Name of Palmers Plott now alsoe in the tenure and Occuption of the sayd William Cox And all other the Lands tenements & hereditaments whatsoever of me the sayd John Cant in Barrow upon the Soare aforesaid To hold to him the sayd John Cant my Son & to his heires & assignes for ever

Item my Mynd & will is that my said Son John Cant shall pay unto his Mother Anne Cant the Summe of five pounds of lawfull money of England for & dureing the terme of her naturall life att the aforesaid severall dayes or times in the yeare before herein mentioned by even & equall porcons The first payment therof to begin att such of the sayd Feasts as shall happen after he the sayd John Cant my Son shall attaine to the Age of one & twenty And in the meantime to be att the sole dispose of my said wife Anne & to receive & take the rents issues & profitts therof towards the education & maintenance of her children yf she the sayd Anne do deliver up her Joynture which she hath setled upon her dureing her naturall life out of my aforesaid messuage & Lands in Wartnaby aforesaid to be made Null & voyd And yf it shall happen that the aforesaid Annuity or yearely rent of five poundes per Annum or any parcel thereof to be behind or unpayd in part or in all by the space of twenty dayes next after any of the aforesaid Feasts or dayes of payment before herein mentioned from & after the sayd John Cant my son shall attaine to the Age of one & twenty & she the sayd Anne shall have delivered up her Joynture to be made Null & cancelled That then it shall & may be lawfull to & for the sayd Anne & her Assignes into the sayd messuage or tenement arrable lands Leyes meadow & pasture ground & premises above mentioned or any parcell thereof in Barrow upon the Soare aforesaid to Enter and distreyne upon the same And the goods chattles & cattle thereupon remaining and being to sell & dispose of the same to her own use for the payment of the aforesaid Annuity or yearly Rent of five pounds and the arrearages therof (if any shall happen to be) shalbe fully satisfied & payd she rendring the overplus to my sayd Son John Cant his heires & Assignes And my will & mynde is that the sayd Anne shall hold and enjoy the aforesaid Messuage and Lands in Barrowe upon the Soare aforesaid untill my sayd Sonne John shall attayne to the Age of One and twenty years for the Education of the sayd John and rayseing portions for my younger children

Item I give to my sister Elizabeth Pare widdowe and to her heires and assigns forever All that the moyety or halfe part of my meadowe lyeing & being in Barrowe South Holme contayneing nine Acres or thereabouts which I lately purchased of Henry Dyson and William Welles to enter upon the same imediately after my decease and to hold to her the sayd Elizabeth her heirs and assigns for ever

Item I give the other Moyety or halfe part of the sayd Nine Acres of Meadow lyeing in South Holme aforesaid unto my saidSonne John Cant his heires & assignes to enter upon & enjoy the same when he shall accomplish the Age of One & twenty yeares and in the meantime my will and mynde is that my wife Anne shall receive the Rents yssues & profitts thereof towards my younger Childrens Education Subject nonetheless to the payment of the aforesayd five pounds per annum to his Mother dureing her naturall life at thetime herein before lymitted yf she the sayd Anne doe resigne and deliver up her Joynture to be made null & voyd as aforesaid

Item I give and bequeath to William Cant my third Sonne and his heyres and assignes for ever All that my Messuage or Tenement and two Oxgangs of Land of arrable land meadow & pasture ground & foure Closes thereunto belonging and all Comons Comon of Pasture profitts Commodities Emoluments hereditaments & appurtenances whatsoever to the same or any part or parcell thereof belonging or appertaining scituate lyeing and being in Nether Broughton in the sayd Countie of Leicester & within the towne fields Liberties & precincts thereof which I lately purchased to me & my heires of one Henry Browne of Alderton in the Countie of Darby & now is in the tenure or Occupation of one Margarett Worsdale widdow to hold to him the sayd William Cant his heires and Assignes for ever

Itm my will & minde is that my said Sonne William Cant shall alsoe pay unto his sayd Mother Anne Cant the Sume of six pounds of lawful money of England for & dureing the terme of her naturall llife at the aforesaid several dayes or times in the yeare before herein menconed by even and Equall portions the first payment hereof to begin att such of the said Feasts as shall happen after he the said William Cant shall attayne to the age of two and twenty And in the meane time to be att the sole dispose of my said wife Anne to receive & take the Rents yssues & profitts thereof towards the Education & Mayntenance of her younger children yf she the sayd Anne doe resigne & deliver up her Joynture which she hath setled upon her dureing her naturall life out of my aforesaid Messuage & Lands in Wartnaby aforesaid to be made null & voyd And if itt shall happen that the aforesaid Annuity or yearly Rent of six pounds or parcell thereof to be behind or unpaid in part or in all by the space of twenty Days next after any of the aforesaid Feasts or days of payment before herein menconed from & after he the sayd William Cant shall attayne to the Age of two & twenty And she the sayd Anne shall have delivered up her Joynture to be cancelled & made voyd That then it shall & may be lawfull for her the sayd Anne & her assignes into the aforesaid Messuage or Tenement & two Oxgangs of Land & foure Closes with the appurtenances or any parcell thereof in Nether Broughton aforesaid to enter & distreyne upon the same And the goods Chattle & Cattle thereupon found to sell & dispose of the same to her owne use for the payment of the aforesaid Annuity or yearly Rent of six pounds & the arrearages thereof (if any shall happen to be) shalbe fully satisfyed & payd she rendring the overplus to the sayd William his heyres and assignes And my will & minde is that the sayd Anne my wife shall hold & enjoy the aforesaid Messuage or Tenement & two Oxgangs of Land four closes & Comons with theire and every of theire appurtenances & every parcel therof in Nether Broughton aforesaid to receive & take the Rents yssues & profitts therof to her owne use untill the sayd William shall attaine to the Age of Two & twenty yeares for the education of the sayd William & the raising portions for my younger children

Item I give & bequeath unto my Fourth Son Thomas Cant & his heires & Assignes for ever All that Messuage or tenement with thappurtenances scituate & being in Loughborough in the said Countie of Leicester in the Churchgate now in the tenure or Occupation of Samuell Barrodell And alsoe all that little shop now used as a parlour next Robert Bunnys foregates & now in the sayd Robert Bunnys Occupcon And also all that one halfe yard Land of arrable land Meadow & pasture ground & Comons and common of Pasture with thappurtenances lying and being within the fields & precincts of Loughborough aforesaid now in the tenure or Occupation of Patrick Cox and alsoe all that other halfe yard Land of arable land Meadow pasture Ground & Comons with thappurtencances lying & being within the fields & precincts of Loughborough aforesaid now in the Tenure or occupation of Christopher North And alsoe all that one yard Land & an halfe yard Land of arrable land Meadowe & pasture ground Comons & common of pasture with thappurtenances lyeing & being within the fields & precincts of Over Broughton in the County of Nottingham now in the tenure or Occupcons of William Sympson & Thomas Lyster To have & to hold to the sayd Thomas Cant his heires & assignes for ever And my will & mind is that my said Son Thomas Cant shall alsoe pay unto his sayd Mother Anne Cant the Sume of Foure pounds of lawfull money of England for & dureing the terme of her naturall life at the aforesaid severall dayes or times in the yeare before herein menconed by even & equall porcons the first payment thereof to begin at such of the sayd Feasts as shall happen after he the sayd Thomas Cant shall attaine to the Age of two & twenty And in the meantime to be at the sole dispose of my sayd wife & to receive & take the Rents yssues & profitts thereof towards the education & maintenance of her younger children yf she the sayd Anne doe resigne & deliver up her Joynture which she hath settled upon her dureing her life out of my aforesaid Messuage & Lands in Wartnaby aforesaid to be cancelled & made voyd And if it shall happen that the aforesaid Annuity or yearly Rent of foure pounds or any parcell thereof to be behind or unpaid in part or in all for the space of twenty dayes after any of the aforesaid Feasts or dayes of payment before herein mentioned from & after he the sayd Thomas Cant shall attayne to the Age of two & twenty And she the sayd Anne shall have delivered up her Joynture to be cancelled and made voyde That then it shall and may be lawfull for her the sayd Anne and her assignes into the aforesaid Messuage or tenement & two Oxgangs of Land of arrable land Meadowe & pasture grounds & parlor or Shop in Loughborough aforesaid with thappurtenances And alsoe in to & upon the aforesaid two yard Land and an halfe of arrable land meadow & pasture ground with thappurtenances in Over Broughton aforesaid or any parcel therof to enter & distreyne upon the same And the goods Chattle & Cattle thereupon found to sell distreyne & dispose of the same to her owne use for the payment of the aforesaid Annuity or yearly Rent of four pounds & the arrearages therof (yf any shall happen to be) be fully satisfyed & payd she rendring the overplus to the sayd Thomas Cant his heires & assignes And my will & mynd is that the sayd Anne my wife shall hould & enjoy the aforesaid messuage or Tenement two Oxgangs of Land & little shop or parler in Loughborough aforesaid with thappurtenances And the aforesaid yard land & halfe with thappurtenances in Over Broughton aforesaid & every parcell thereof And to receive & take the rents yssues & profitts therof to her owne use untill the sayd Thomas shall attaine to the age two & twenty years for the Education of the sayd Thomas & the raysing porcons to my younger children

Item my will & mind is that if it shall please God that the sayd Anne my wife shall depart this life before my Sonns John William and Thomas shall atteyne to their severall ages before herein mentioned Then my will and mind is that my loveing uncle Thomas Neale of Wollestroppe [Woolsthorp, Lincolnshire – Thomas Neale rector was buried there 1689] Clerke and my Sonne in Law John Ludlam shall receive and take the Rents yssues and profitts of the aforesaid messuages Closes Lands and Tenements for the sole use and benefitt of the said John William and Thomas my Sonns untill they and every of them shall severally attayne to theire severall Ages before herein mentioned and expressed Then the sayd Thomas Neale and John Ludlam deducting their reasonable charges for theire trouble about the same And yf any of my sonnes John William and Thomas or any of them shall depart this life before they shall attaine to their several agesbefore herein mentioned Then my will and Mynde is that the Legacies and Estates before herein given and bequeath[MJ1] ed unto him or them soe dyeing shall discend and come to all the rest of my Sonns surviving and to theire heires and assignes for ever equally to be devided amongst them

Item my will & mynde alsoe is that the rents yssues and profitts of the aforesaid messuages Closes lands & tenements before herein given to my said Sonns John William and Thomas shalbe for theyre Maintenance and Education and putting them apprentices & raysing of them stock to sett them up to trades untill theire severall Ages before mentioned

Item I give and bequeath unto my Daughter Elizabeth three hundred pounds to be payd unto her when she shall attayne to the Age of One and twenty yeares And yf the sayd Elizabeth shall depart this life before she shall attayne the Age of One and twenty yeares Then my will is that the sayd three hundred pounds shalbe equally divided amongst all my Sonns Matthew John William and Thomas

Item I give to mother Needham twenty Shillings to buy her a Ring

Item my will and mynde is that in case my said wife shall refuse to resign her Joynture to my Sonne Matthew That then the aforesaid Annuities that are to bee payd her out of the sayd John William and Thomas Estates before herein mentioned shalbe payed to my Sonne Matthew till they come to their sayd severall Ages as aforesaid with the same power to distreyne for the same as his mother should have had if she had held the same as aforesaid in case the sayd Annuities or any of them shalbe behind and unpayed towards raysing them a Stocke

Item I give to the sayd Thomas Neale and John Ludlam twenty shillings apiece to buy them Rings

Item I give to Mr Robert Ireland twenty Shillings and to Ambrose Streete five Shillings

Item I give to the poore of Wartnaby fourty Shillings to be distributed upon the Day of my funerall

Item I give to my Daughter Mary a broad piece of Gold and to my Sonne in Law William Drury a Gynney piece of Gold to buy him a Ring

All the rest of my goods Chattles & Cattle whatsoever I give unto my Deare and loveing wife Anne who I make to be Executrix of this my last will and Testament And I doe make the sayd Thomas Neale & John Ludlam Overseers of this mywill desireing them to be ayding & assisting unto her by theire good Advice and Councell to see this my will performed according to the true Intent & meaning thereof

In wittnesse whereof I the sayd John Cant have hereunto sett my hand & seale this seaventeenth day of July in the fourth yeare ofthe Raigne of our Soveraigne Lord King James the Second over England &c Annoq Dni 1688

Received the Originall will of John Cant the Testator aforenamed according to the Sentence of Samuell Daniell Clerke Master of Arts of the Peculiar Jurisdiccon of Rothley in the Countie of Leicester conservator lawfully constituted the sayd will being first proved by Witnesses & Sentence passed for the validitie of the same this being a true Copy of the said Originall exactly and carefully examined by us whose names are under written this Tenth day of November in the yeare of our Lord 1688
