William Burton of Holwell 1837 Will

This is the last Will and Testament of me William Burton of Holwell in the County of Leicester Blacksmith

I direct my just debts funeral and Testamentary expences to be fully paid

I give and bequeath unto my friend Thomas Buck of Holwell aforesaid the sum of Eighty pounds upon Trust to place the same out at interest on good security and with the Interest to apply for the benefit of Education and support of my two Grandchildren Mary Jane Burton and Clarke Burton the Son and Daughter of my late Son John Burton until they Respectively attain the age of Twenty one years in equal proportions at the Discretion of my said Trust [sic] Thomas Buck as he shall see right And when and as my said Grandchildren shall attain such age as aforesaid Then I give and bequeath the said sum of Eighty pounds unto and between them both share and share alike And if either of them shall happen die under age Then I give his or her share to the Survivor But in case both shall die before the said legacies become payable Then I will that the said sum of Eighty Pounds and all Interests there due shall sink in for the benefit of my daughter Ann Thorpe

I give and bequeath unto my daughter Ann Thorpe the wife of John Thorpe of Holwell aforesaid Shepherd all my household goods chattels rights credits ready money securities for money and all other the Residue and Remainder of my Personal Estate and affects whatsoever unto and for her own use and benefit absolutely

And do appoint my said friend Thomas Buck Executor In trust of this my last will and Testament hereby revoking all other wills by me made

And lastly my will is that the said Thomas Buck his Executors or administrators shall be at liberty out of the said Trust monies to retain all necessary expences he shall be put to in executing the Trust of this my will and that neither he nor they shall be answerable for any thing except his own wilful neglect or default

In Witness whereof I have hereunto set my hand and seal this tenth day of February One Thousand Eight Hundred and Thirty four

Let a Probate be made to Thomas Buck of Holwell in the County of Leicester Farmer & Grazier the Executor named in the will of William Burton, the deceased, who died the Eight day of February one thousand eight hundred & thirty five

He having been first duly sworn as well to the faithful Execution of the Will as that the Testators Goods Chattels & credits without deducting any debts due & owing by him therefrom do not amount in value to the sum of three hundred Pounds
