This is the last Will & Testament of me Thomas Burnett of Hickling in the County of Nottingham wheelwright & joiner

I hereby revoke all former testamentary dispositions made by me

I appoint my sons William Burnett & John Burnett (hereinafter called “my Trustees”) to be the Executors & Trustees of this my Will

I desire my messuage & premises situate in Hickling aforesaid & also my other messuage in Hickling aforesaid & the Blacksmith’s & joiner’s shops & yard adjoining the same now in the occupation of myself my said son William Burnett & Alwyn Shelton unto my said son William Burnett in fee simple

I devise my two closes of pasture land with the spinney adjoining thereto containing altogether 20 acres & 29 perches or thereabouts situate in Nether Broughton in the county of Leicester which I purchased of Mr John Henry Bell & others to my said son John Burnett in fee simple

I bequeath all my plate & plated articles unto my Trustees upon trust to divide the same amongst my four children namely the said William Burnett & John Burnett & my daughter Mary the wife of Holland Taylor & Annie the wife of Frederick Harris & my grandchild Frederick Burnett Wallis in shares & proportions as nearly equal in value as may be such division to be made by my Trustees according to the best of their judgement & their decision shall be final

I bequeath to each of my fourteen grandchildren hereinafter mentioned namely the eight children of my said daughter Mary Taylor the four children of my said son William & my grandchildren Frederick Burnett Wallis & Mary Burnett a legacy of 15£

I give devise & bequeath all my real & personal estate & effect not hereby otherwise disposed of unto my Trustees upon trust to realise the same & hold the net proceeds thereof after payment thereout of my funeral & testamentary expenses & debts & the pecuniary legacies bequeathed by this my Will or any Codicil hereto upon trust for such of them my said daughters Mary Taylor & Annie Harris & my said grandson Frederick Burnett Wallis as shall be living at my decease if more than one in equal shares provided always & I declare that if any child or grandchild of mine shall die in my lifetime leaving a child or children who shall survive me such last mentioned child or children attaining the age of twenty one years or being female marrying shall take by substitution if more than one equally between them the legacy or share of residue which his or her or their parent would have taken under the trusts of this my will if such parent had survived me

I also declare that my Trustees shall retain in their hands the share of my said daughter Mary Taylor of & in my residuary estate under this my Will & shall invest the same in the joint names of my Trustees in any investment for the time being authorised by law for the investment of trust funds & shall hold the same & the investments thereof upon trust to pay the income thereof unto my said daughter Mary Taylor during her life & so that whilst under coverture she shall not be able to deprive herself of the benefit thereof in the way of anticipation & from & after her decease upon trust as is as well the capital as the income thereof for the child if only one wholly or all the children if more than one in equal shares of my same daughter who shall be living at her decease & the child or children then living of any child of my same daughter who shall have died in her lifetime leaving a child or children such last mentioned child or children taking only & if more than one equally between them the share which his her or their parents would have taken had such parent been living at the death of my same daughter
