Thomas Brex of Nether Broughton 1840 Will

This is the last Will and Testament of me Thomas Brex of Nether Broughton in the County of Leicester Grazier

I direct all my just debts funeral and Testamentary expences to be fully paid

I Give and Devise All my Messuages Cottages Closes Lands Tenements hereditaments and Real Estate whatsoever situate in the Parish and Lordship of Nether Broughton aforesaid or elsewhere within the Kingdom of England with their appurtenances And also All my Personal Estate and Effects of every description of which I shall be possessed Unto my affectionate Wife Elizabeth Brex and her assigns for and during the Term of her natural life provided she continues my widow And from and immediately after her death or marriage Then I Give Devise and bequeath All my said Real and Personal Estate and Effects unto my Son Joseph Brex his heirs executors administrators and assigns for ever Subject to the payment of the following legacies namely

Unto my Son John Brex the sum of Thirty pounds

Unto my daughters Mary Elizabeth Sarah Philis and Ann the Sum of Ten Pounds apiece to be paid to them within Twelve months after my said Wifes decease

And Lastly I do appoint my said Son Joseph Brex Sole Executor of this my last Will and Testament hereby revoking all former Wills by me made

In Witness whereof I have hereunto set my had and seal this Seventeenth day of February 1836

Signed sealed published and declared by the said Testator Thomas Brex as and for his last Will and Testament in the presence of us who have at his Request in his presence and in the presence of each other set our hands as witnesses to the due execution thereof

Whereas I Thomas Brex have duly made and published my last Will and Testament as within written Now I do declare this to be a Codicil to my said Will and direct the Same to be taken as part thereof

And whereas my two daughters Mary and Phillis have died since the making of my said Will Now I do hereby Give to my Three Surviving daughters Elizabeth Sarah and Ann in addition to the Ten pounds each bequeathed in my said Will the further Sum of Nine pounds and Nineteen shillings apeice and do confirm my said Will in every other particular thereof

In Witness whereof I have hereto set my hand and Seal this fifteenth day of August 1839

Joseph Brex of Nether Broughton Grazier the sole Executor in this will named was duly sworn to the truth and faithful performance thereof as usual and that the goods, chattels and credits of the deceased without deducting any debts owing by him therefrom do not amount in value to the sum of two hundred pounds and that the deceased died on the twenty second day of October one thousand Eight hundred and thirty nine      

On the 24th day of December 1840 the Origl Will and Codicil exhibited Before the Revd Jemson Davies Clerk MA and Surrogate & Probate decreed to pass Seal in the presence of
