This is the last Will and Testament of me Andrew Basilico of Colston Bassett in the County of Nottingham Esquire made and published this twentieth day of December in the Year of our Lord One thousand eight hundred and twenty two in manner following (that is to say)

I Give and bequeath all and singular my Plate Linen China Household Goods and Furniture monies and Securities for money and all other my Personal Estate and Effects of what nature or kind soever of which I may be possessed at the time of my decease unto my dear Wife Sophia Charlotte Basilico and my sons Andrew Basilco and John Basilico their Executors Administrators and Assigns upon the trusts nevertheless that they may said trustees or the survivor of them or the Executors or Administrators of such Survivor do and shall permit and suffer my said dear Wife Sophia Charlotte Basilico To hold use occupy and possess All and singular my said plate Linen China and household Goods and Furniture of every description for and during the term of her natural life

And as to all the residue and remainder of my said trust estate and effects Upon Trust to sell and dispose of the same as soon as conveniently may by after my decease and call in and receive all such debts sum and sums of money as shall be due and owing to me at the time of my death and by and out of the same in the first place pay and satisfy all my just debts funeral expenses and the expenses of proving this my will and the probate thereof And from and after payment thereof Upon further Trust to place out the clear residue of the monies arising by such sale or disposal and the monies so to be called in and received upon Government or other good and sufficient Security in their own names and in such manner as they shall think proper and vary and alter the same from time to time as they may deem expedient And do and shall receive the interest and dividends thereof from time to time as the same shall become payable and pay the same and every part thereof unto my said dear Wife for her own sole and absolute use for and during the term of her natural life

And from and after her decease Upon further trust that they my said Trustees or the Survivor of them or the Executors or Administrators of such survivor do and shall call in recover and receive all my said trust monies and every part thereof and sell and dispose of all and singular my household Goods and Furniture Plate Linen China Prints and Pictures and all other Personal Estate and Effects and divide the monies arising by such sale and disposal and also the monies so to be called in and received and every part thereof and all other my Personal Estate and Effects whatsoever unto my said Sons Andrew Basilico and John Basilico in case they shall be living at the decease of my said Wife in equal shares and proportions to whom I hereby give and bequeath the same accordingly Provided nevertheless and I do hereby declare my Will and mind to be and I do hereby order and direct my said trustees before they proceed to a division of my said trust monies to deduct from my said Son John’s share thereof the Sum of one thousand and six hundred pounds which I have already advanced to him in part and on account of his Fortune And I do hereby charge and make chargeable my said Son John’s share to and with the payment thereof accordingly

But in case it shall happen that either of them my said Sons shall be dead at the decease of my said Wife without leaving lawful issue then and in that case I do hereby give and bequeath the whole of my said trust monies and all other my personal Estate and Effects unto the Survivor of them my said Sons absolutely immediately upon the decease of my said Wife

But in case both or either of them my said Sons shall happen to die in the life time of my said Wife leaving lawful Issue then upon Trust that the Survivor of them my said trustees his or her Executors or Administrators do and shall as soon as may be after the decease of my said wife again place out the share or shares of him or them so dying upon Government or Real Security in manner aforesaid and pay and apply the Interest Dividends and proceeds thereof or a sufficient part thereof from time to term for and towards the maintenance education and bringing up of the Child or Children of him or them so dying until such Child or Children shall attain his her or their age or respective ages of twenty one years and when and as they shall attain that age In trust to pay assign and transfer the share or shares of their deceased parent or parents subject nevertheless as to my said son John’s share thereof to the payment or deduction thereof of the said Sum of one thousand and six hundred pounds as aforesaid and the unapplied Interest dividends and proceeds thereof unto such her or their Child or Children share and share alike if more than one

And in case it should happen that both my said Sons should die in the life time of my said Wife without leaving lawful Issue then and immediately from and after the decease of the Survivor of them my said Sons I give and bequeath the whole of my said trust monies and all other my personal Estate and Effects unto my said dear Wife absolutely

And I do hereby authorise and empower the survivor of them my said Trustees his or her Executors or Administrators in case it should happen that either of them my Sons should die in the life time of my said Wife leaving Issue as aforesaid to apply such part or parts of the share or respective shares of such Issue as may be necessary for putting them out to business for his her or their advancement in the world

And it is my Will and meaning that my said trustees or either of them shall not be liable to answer or make good any loss or losses that shall or may happen to the aforesaid trust Estate and Effects in placing out the trust monies according to the directions of this my will or in transacting any money affaires or otherwise relating to or concerning the execution of the trusts mentioned in this my Will unless the same shall appear to have happened by or through their or either of their wilful neglect or default nor shall either of them my said trustees be answerable or accountable for the Acts deeds receipts and disbursements of the other of them but each of them shall be answerable only for his own separate Acts deeds receipts and disbursements

And I do hereby direct that my said trustees shall and may pay and reimburse themselves and himself out of the aforesaid trust monies all reasonable and necessary Costs Charges and Charges [sic] whatsoever which they or either of them shall or may bear pay or be put unto or sustain in or about the execution of this my Will or the trusts hereby in them reposed

And lastly I do hereby nominate constitute and appoint my said trustees the said Andrew Basilico and John Basilico Executors of this my last Will and Testament And do hereby revoke and make void all former and other Will and Wills by me at any time heretofore made and do declare this to be my last Will and Testament

In Witness whereof I the said Andrew Basilico the Testator have to this my last Will and Testament contained on four sheets of paper to the three first sheets set my hand and to this fourth and last sheet thereof my hand and Seal the day and year first above written
