William Barnes of Long Clawson 1800 Will

In the name of God Amen I William Barnes of Claxton otherwise Long Clawson in the County of Leicester Shopkeeper being weak in Body but of sound mind and memory Do make and ordain this my last Will and Testament in manner following

First I give and devise All my Messuages or Tenements and Homestead situate and being in Claxton otherwise Long Clawson aforesaid which I purchased of John Moore Gentleman and which are now in the Occupation of Thomas Clayton and William Skinner and all and singular the Hereditaments thereto belonging to my loving Wife Fortune Barnes for and during the term of her natural Life and from and immediately after her decease I give and devise the same to my son George Barnes his Heirs and Assigns forever Subject nevertheless to and I do hereby charge all the said Premises with the payment of the sum of one hundred pounds which I give and bequeath to my son Samuel Barnes to be paid to him out of the said Premisses within twelve Months after the decease of my said Wife and in case my said son Samuel Barnes shall die before my said Wife and leave Issue of his Body my Will is that the said sum of one hundred pounds shall be paid to such Issue that is if only one Child to such Child if more than one in equal shares amongst such Children

Also I give and bequeath to my said son Samuel Barnes the sum of two hundred pounds to be paid within two Months after my decease

Also I give and bequeath to my said son Samuel Barnes a Silver Table Spoon marked SF six Silver Tea Spoons marked WAF a pair of Silver Tea Tongs marked B six oak Chairs and an oak armed Chair and one half of all my Books to be delivered to him at my decease

All the Residue and Remainder of my Goods Chattels Cattle Stock in Trade ready Money securities for Money and personal Estate whatsoever and wheresoever Subject to the payment of all my just Debts my Funeral expences and the expences of executing this my last Will and Testament I give and bequeath to my said Wife Fortune Barnes and my said son George Barnes to be used and employed by them as a Stock in Partnership for the comfortable maintenance of my said Wife and for providing for her all the necessaries of Life suitable to her Station during her natural Life and for the Benefit of my said Son George And I will and direct that in Case my said Wife and my son George Barnes shall continue to live and carry on Business together till her decease that her part or share of the said Stock in Partnership shall Vest in and be the sole property of my said son George Barnes immediately after her decease But in case my said Wife shall choose to leave my said son George his Executors or Administrators and shall discontinue to live with him or them then and in such case I give and bequeath the sum of two hundred pounds to my two Friends John Moore Gentleman and Robert Goodacre Schoolmaster both of Claxton otherwise Long Clawson aforesaid and their Executors Administrators and Assigns in Trust only to be paid to them within two Months after my said Wife shall separate from and discontinue to live with my said son George by him my said son George Barnes in lieu of and in full Compensation for her share of and interest in my personal Estate herein before given to her Save and accept [sic] such part of my Household furniture as she shall select out and choose for her use during her natural Life only not exceeding twenty pounds in Value at a fair Appraisement And I will and I direct that my said Trustees shall place the said sum of two hundred pounds out at Interest as soon as it shall be paid into their hands and receive the Interest arising therefrom and pay it to my said Wife as it becomes due during her natural Life Provided nevertheless that in case my said Wife shall discontinue to live with my said son George Barnes as before mentioned and my said son George Barnes shall procure and give such security to my said Trustees as they shall approve of for the true payment of ten pounds a year to my said Wife during her natural Life or for the true payment of the said two hundred pounds and Interest then I desire they will permit the same to remain in his Hands But my mind and Will is that if my said Wife shall marry again she shall have no part whatsoever of my personal Estate And all my personal whatsoever which is not herein disposed I give to my said son George Barnes

And I do hereby make constitute and appoint my said Wife Fortune Barnes and my said son George Barnes Executrix and Executor of this my last Will and Testament

In Witness whereof I the said William Barnes have hereunto set my hand and Seal this Fifteenth day of February One thousand seven hundred and ninety nine

The within written Will was Signed Sealed published and declared by the within written William Barnes as and for his last Will and Testament in the presence of us who in his presence at his request and in the presence of each other have subscribed our Names as Witnesses thereunto (after having observed that the Word “within” in this attestation was interlined.)

Let probat be granted to George Barnes, Executor of the above written will, he being duly sworn to the execution thereof & also made oath, at the same time, that the whole personal estate of the deceased, at his death did not amount to the sum of one Thousand pounds.

At the same time power was reserved for Fortune Barnes the other Executor within named
