James Bampton of Stathern 1812 Will

This is the last Will and Testament of me James Bampton of Statherne in the County of Leicester Farmer and Grazier

First I direct that all such Debts as I shall justly owe at the time of my decease and my Funeral and Testamentary expenses be paid by my Executor hereinafter named

I Give and Devise unto my two Daughters Isabella Bampton and Sarah Bampton All that my Messuage or Tenement with the Orchard Garden Outbuilding and Appurtenances to the same belonging situate standing lying and being in Stathern foresaid and in the Tenure or Occupation of Richard Gulson to them their Heirs and Assigns for ever to take and hold the same as Tenants in Common and not as joint Tenants

I Give and Devise unto my Son John Bampton All my Collegehold Estate situate lying and being in the Lordship or Liberty of Statherne aforesaid and now in my own Occupation to him his Heirs and Assigns for ever

I Give and Devise unto my Son James Bampton All the rest of my Freehold property (not hereinbefore disposed of) situate standing lying and being in Statherne aforesaid or within the Lordship or Liberty thereof and now in my own Occupation to this his Heirs and Assigns for ever And also All the rest residue and remainder of my Personal Estate and Effects of what nature or kind soever the same may be or consist of (Subject as aforesaid) to him his Executors Administrators and Assigns Subject and Chargeable Nevertheless with the payment of the following Annuity or Rent Charge and the several Legacies hereinafter named (that is to say)

One Annuity of Yearly Rent Charge of Sixty Pounds unto my Dear Wife Mary Bampton and her Assigns payable half yearly at Lady day and Michaelmas the first payment thereof to begin and be made on such of the said days which shall next happen after my decease And in Case of failure of payment thereof after coming due for the space of twenty days (being lawfully demanded) it shall be lawful to distrain for the same and have the same power to sell under such Distress as Landlords have for the recovery of Rent in Arrear

I Give and Bequeath unto my said two Daughters Isabella Bampton and Sarah Bampton the Sum of Five Hundred pounds apiece to be paid to them by my said Executor within six Calendar Months next after my decease And in Case one or both of them shall happen to die before her or their said Legacy or Legacies shall become due and payable unmarried and without Issue then I direct that the Legacy or Legacies of her or them so dying shall go and be equally divided amongst all the Surviving Brothers and sisters share and share alike

I Give and Bequeath unto my Daughter Ann Marriott the Sum of Three Hundred pounds I also Give and Bequeath unto my Daughter Mary Jackson (besides what she has already had of me) the Sum of One Hundred Pounds to be paid them within the like space of time already mentioned

I also Give and Bequeath unto my Granddaughter Mary Marriott the Sum of Fifty Pounds to be paid her when she shall attain her Age of Twenty one years or day of Marriage which shall first happen

And Lastly I do hereby Nominate Constitute and Appoint my said Son James Bampton Sole Executor of this my last Will and Testament hereby revoking all former and other Wills by me at any time heretofore made

In Witness whereof I the said James Bampton the Testator have to the first sheet of this my Will (which is contained on two sheets of paper) set my Hand and to this last sheet thereof my Hand and seal this Third day of June in the Year of our Lord One Thousand eight Hundred and twelve

Let a probat be granted to James Bampton of Stathern Farmer the sole Executor within named He the said James Bampton being duly Sworn as well to the faithful execution of the Will as that of [sic] the Testators Goods Chattels & Credits do not amount in value to the sum of one Thousand Pounds
