William Bailey of Nether Broughton 1798 Will

In the Name of God Amen I William Bailey of Nether Broughton in the County of Leicester Cordwainer being Weak and Sick in Body but of a sound Mind Memory and Understanding praised be Almighty God for the same do make Publish and declare this to be my last Will and Testament in manner following (that is to say)

First I Give and Devise to my Son Samuel Bailey all that my Messuage Cottage or Tenement together with the Homestead thereto adjoining and all other the out Offices and Buildings thereunto belonging situate in Nether Broughton aforesaid To hold unto him my said Son Samuel Bailey and his Heirs and Assignes forever But Subject nevertheless to and with the Payment of the following Legacies as is hereinafter mentioned

Also I Give and bequeath to my Son John Bailey the Sum of thirty Pounds of good and lawfull Money of Great Britain

And Also I Give and bequeath to my Daughter Sarah Bailey the sum of thirty Pounds of good and lawfull Money of Great Britain

And also I Give and bequeath to my Daughter Hannah Bailey the Sum of thirty Pounds of good and lawful Money of Great Britain which said Legacies hereinbefore bequeathed to be paid out of the aforesaid Messuage Cottage or Tenement Homestead and Premises by my said Son Samuel Bailey at the end of twelve Months next after my Decease

And my Mind and Will is that my Wife Ann Bailey shall have a peaceable dwelling and Home with my Son Samuel Bailey during her lifetime if she thinks most fit and convenient, But my mind and Will further is that if my said Daughter Sarah Bailey shall happen to Marry then such Legacy hereinbefore bequeathed to her shall go to my Son John Bailey Hannah Bailey and my Executor and Executrix share and share alike But if she remain Single and unmarried then such Legacy to stand good to her as aforesaid And if she should happen to be in want during her lifetime then my mind and Will the further is that my Son John Bailey Hannah Bailey and my Executor and Executrix shall contribute to her share alike so that she may not become troublesome to a Parish

And Lastly I do hereby nominate constitute and appoint my said Son Samuel Bailey and my said Wife Ann Bailey joint Executor and Executrix of this my last Will and Testament revoking all former Wills by me at any time heretofore made they paying all my just Debts and Funeral Expences

In Witness whereof I the said Testator have to this my last Will and Testament set my hand and Seal this tenth day of May in the Year of our Lord one thousand seven hundred and ninety seven

Let probat be granted to Samuel Bailey and Ann Bailey joint Executors of the within written will: they being sworn to the due execution thereof & at the same time made oath that the whole personal estate of the Deceased at the time of his death did not amount to the sum of One hundred pounds
