This is the last Will and Testament of me George Baguley of Harby in the County of Leicester Farmer

I hereby revoke all former testamentary dispositions made by me

I appoint my brother Thomas Baguley and William Taylor of Trent in the County of Derby a Station Master in the employ of the Midland Railway Company (who are hereinafter called “my Trustees”) to be the Executors and Trustees of this my Will and I bequeath to each of them on proving my Will a legacy of Ten pounds

I bequeath to my Wife Sarah Baguley a Legacy of Fifty pounds to be paid to her within one calendar month after my decease and I also bequeath all my plate linen china glass books pictures prints wines liquors furniture and other household effects and all my carriages and riding and driving horses to my said Wife absolutely

I bequeath the following Legacies namely to my brothers John Baguley and Thomas Baguley Two hundred pounds apiece and to my Niece Mary Ellen Whittle Fifty pounds and in the event of the death of any one or more of the said John Baguley Thomas Baguley and Mary Ellen Whittle in my lifetime leaving a child or children living at my decease then I declare that in every such case such child or children shall take (and if more than one equally between them) the Legacy hereinbefore bequeathed to his her or their parent

I give and bequeath all the live and dead farming stock implements of husbandry and other effects being in upon or belonging to the farm or farms in my occupation at my decease and all other my personal estate and effects not hereby otherwise disposed of to my Trustees Upon trust that my Trustees shall sell call in and convert the same into money or such part thereof as shall not consist of money and shall with and out of the moneys produced thereby and out of my ready money pay my funeral and testament expenses and debts and the before mentioned Legacies and shall stand possessed of the net residue of the said moneys In trust for my said Wife absolutely

I devise all my Messuage or Tenement situate in Harby aforesaid in which I now reside together with the outbuildings yard and garden thereto belonging and the two Cottages situate in the yard at the back of the said Messuage or Tenement And also all that my Close of pasture land called Greggs Close containing about five acres situate in Harby aforesaid and all other my real estate whatsoever and wheresoever to my said Wife Sarah Baguley and her assigns during her life without impeachment of waste and from and after her decease I devise the same to my Trustees Upon Trust that my Trustees shall sell the same real estate as soon as conveniently may be after the decease of my said Wife and shall pay and divide the net proceeds arising from the sale thereof Unto and equally between such of the children of my said brothers John Baguley and Thomas Baguley and my late Sister Ellen Whittle as shall be then living Provided always that if any one or more of the persons who would if living at the time hereinbefore appointed for the distribution of the net proceeds of the sale of my real estate be entitled to share therein under this my Will shall die either in my lifetime or after my decease before the time of distribution aforesaid leaving a child or children who shall be living at such time then and in every such case such child or children shall take (and if more than one equally between them) the share of and in the said net proceeds of sale of my real estate which his her or their parent would have taken under this my Will if such parent had been living at the time of distribution aforesaid

And I declare that my Trustees shall be Trustees of this my Will for the purposes of the Settled Land Act 1882

This is a Codicil to the above written Will of me the above named George Baguley

I revoke the appointment of my Brother Thomas Baguley as an Executor and Trustee of my said Will and also the Legacy of Ten pounds bequeathed to him conditionally upon proving my Will and instead thereof I appoint my Nephew John George Baguley the son of my Brother John Baguley to be an Executor and Trustee of my said Will in the place of the said Thomas Baguley and I declare that my said Will shall be read construed and take effect as if the said John George Baguley had been originally appointed a Trustee and Executor thereof instead of the said Thomas Baguley And I bequeath to the said John George Baguley on proving my said Will a Legacy of One hundred pounds

I bequeath to my Wife Sarah Baguley a Legacy of Fifty pounds to be paid to her within one calendar month after my decease in addition to the Legacy of Fifty pounds bequeath to her by my said Will And I confirm my said Will as altered by this Codicil

This is a second Codicil to the within written Will of me the within named George Baguley

I bequeath a legacy of Two hundred pounds to my Brother William Baguley and in the event of his dying in my lifetime I bequeath the same legacy to his child or children living at my decease and if more than one equally between them And I declare that the child or children of the said William Baguley shall participate in the distribution of the net proceeds of sale of my real estate at the decease of my wife the within named Sarah Baguley in the same manner in all respects as the children of my brothers John Baguley and Thomas Baguley and my late sister Ellen Whittle are entitled to under my said Will and with a similar gift over the share of any of the said first mentioned children dying before the time of distribution to their child or children

And in all other respects I confirm my said Will and the first Codicil thereto

Proved at Leicester with two Codicils on the eighth day of December 1891 by the Oaths of William Taylor the Executor named in the Will and John George Baguley the Nephew of the deceased (son of his Brother John Baguley) the Executor named in the first Codicil to whom Administration was granted

The Testator George Baguley was late of Harby in the County of Leicester Farmer and died on the fifteenth day of October 1891 at Harby aforesaid
