This is the last Will and Testament of me William Adkin of Saxelby in the County of Leicester Farmer

First I direct all my just debts funeral and testamentary expences to be fully paid

I Give and bequeath all my personal Estate live and Dead Stock implements of husbandry household furniture plate money and securities for money and all other my effects of whatsoever nature or kind the same may be and consist of unto my three friends William Mackley of Welby and George Goodson of Saxelby and Jasper Houghton of Asfordby in the said County of Leicester their Executors and administrators Upon the trusts and for the purposes following that is to say

Upon trust that they the said William Mackley George Goodson and Jasper Houghton or the survivor or survivors of them or the Executors and administrators of such survivor (hereinafter called the Trustees or Trustee) do and shall carry on my Farm and pay the Interest dividends and yearly income arising from my said Farm and other my personal Estate unto my Wife Mary Adkin for the benefit of herself and the bringing up Maintenance and Education of all my children during such part of her natural life as she shall continue my Widow and from and immediately after her decease or Marriage Then I direct my said Trustees or Trustee for the time being to apply the Interest dividends and yearly income arising from my said Farm and personal Estate unto and for the benefit bringing up Maintenance and Education of my children during their minorities until the youngest of my children shall attain to his or her age of twenty one years and when such youngest child attaining to his or her age of twenty one years Then I direct my said Trustees or Trustee as soon after as they in their discretion shall think fit to sell and absolutely dispose of all my said personal Estate and Effects either by Public Auction or Private contract as my said Trustees or Trustee may think fit And after the payment of all expenses attendant thereupon Then to divide the residue of such trust monies and premises unto & equally amongst all my said children To whom I Give and bequeath the same absolutely share and share alike

Provided and I do hereby expressly direct that in case any of my said children shall depart this life in the life time of my said Wife or previous to the youngest of my said children arriving at the age of twenty one years without leaving lawful issue Then and in that case I direct the original and accruing share or shares of such deceased child or children shall go to and be paid to the survivors of them in equal shares and proportions and in case there should be only one such child Then the whole to go to such only child his or her executors and administrators absolutely

But in case any of my said children shall depart this life in the life time of my said Wife or previous to the youngest of my said children arriving at the age of twenty one years leaving lawful issue Then I direct that the original and accruing share or shares of such of them so dying shall go to and be equally divided between the issue of such deceased child or children such issue however only taking amongst them what would have been their deceased parents share if living

And I hereby empower my said Trustees or Trustee with the consent in writing of my said Wife during her widowhood and after her death or marriage then in their or his discretion to raise any part or parts of the then expectant presumptive or vested share or fortune of any child under the trusts hereinbefore contained not exceeding in the whole for any such child one half part of his or her then expectant presumptive or vested share or fortune and apply the same for his or her advancement or benefit

I devise and bequeath all the estates vested in my by way of mortgage with the appurtenances unto the said William Mackley George Goodson and Jasper Houghton their heirs executors and administrators according to the nature of the same premises subject to the equity of redemption subsisting therein respectively but the money secured on such mortgage to be considered as part of my personal estate And I further direct that the sections in part three of an Act of Parliament entitled “An Act to give to Trustees Mortgagees and others certain powers now commonly inscribed in Settlements Mortgages and Wills” shall be considered as applicable to this my Will

I give and bequeath unto my daughter Mary Ann Adkin (in addition to what she may be entitled to under the trusts of this my Will) a Legacy or sum of One hundred pounds absolutely

And lastly I hereby appoint the said William Mackley George Goodson and Jasper Houghton Trustees and Executors of this my Will hereby revoking all others by me made

In witness whereof I the said William Adkin have to this my last Will contained on this and the preceding sheet of paper set my hand this twenty fourth day of January 1867

Signed and acknowledge by the said William Adkin as his Will in the presence of us present at the same time and who in his presence and in the presence of each other have hereunto subscribed our names as Witnesses the words “Goodson” “Jasper Houghton” and “twenty” being previously written on erasures and “of Saxelby” and “out” interlined
