Mary Swain of Long Clawson 1839 Will

This is the last Will and Testament of me Mary Swain of Long Clawson in the County of Leicester Spinster
I direct my just debts funeral and Testamentary expences to be paid
I Give unto my Neice Ann Burgin the Interest of the sum of Fifty Pounds after the Rate of Four Pounds and Ten Shillings Per Centum Per Annum to be paid to her yearly and every Year for the space of five years from my decease Then I Give to her the said Principal Sum of Fifty Pounds for her own absolute use But in case the said Ann Burgin shall die before the said legacy becomes payable Then I will that the same fall in for the benefit of my Residuary legatees
Also I Give unto my neice Mary Kellam the Interest of the like Sum of Fifty pounds after the rate aforesaid to be paid to her Yearly and every Year for the space of five Years from my decease Then I Give to her the said Mary Kellam the said Principal Sum of Fifty pounds for her own Absolute use But in case the said Mary Kellam shall happen to die before the said legacy becomes payable Then I will that the same fall in for the benefit of my Residuary legatees
One half part or share of my Wearing apparel I Give to my Neice Sarah White The other half part thereof I Give to the said Ann Burgin and Mary Kellam in equal shares
And as to all the Rest Residue and Remainder of my Personal Estate and Effects whatsoever I Give and bequeath the same unto my Two brothers George Swain and John Swain Share and Share alike and do appoint them Joint Executors of this my last Will and Testament hereby Revoking all former Wills by me made
In Witness whereof I have hereunto set my hand and seal this Eight day of December one thousand eight hundred and Thirty two

Signed sealed published and declared by the said Testator Mary Swain as and for her last Will and Testament in the presence of us who have at her Request in her presence and in the presence of each other set our hands as Witnesses to the due Execution thereof

George Swain of Long Clawson in the County of Leicester Carpenter one of the Executors in the will named was duly sworn to the truth and faithful performance thereof as usual and that the deceased died on the Eighteenth day of June last part and that the goods chattels and credits of the deceased do not amount in value to the sum of one Thousand five Hundred Pounds

On the 17th Augt 1839 Origl Will exhibited before the Revd Thomas Stevenson Clerk MA & Surrogate of the Commissary and Probate decreed to pass Seal (with reservation for John Swain the other Executor when he shall apply for the same) in the presence of
