Samuel Sumner of Hose 1821 Will

This is the last Will and Testament of me Samuel Sumner of Hose in the County of Leicester Farmer as follows

I Give and Devise All that Messuage or Tenement Yard Garden Orchard hereditaments and appurtenances whatsoever situate standing lying and being in Hose aforesaid and now in my own occupation (Subject to the Residue therein of my Son James Sumner so long as he continues single and unmarried) unto my dear Wife Margaret Sumner and her assigns for and during the term of natural life and from and immediately after her decease Then I Give and Devise the said Messuage or Tenement Yard Garden Orchard hereditaments and premises with their and every of their appurtenances (subject as aforesaid) unto my Son William Sumner his heirs and assigns for ever

I Give and Devise All that Messuage or Tenement Barn and small piece of ground thereunto belonging situate standing lying and being in Hose aforesaid and which I lately purchase of Mr Thomas Musson of Long Clawson Miller and Baker unto my Son Charles Sumner his heirs and Assigns for ever

I Give and bequeath unto my Son Thomas Sumner the sum of Twenty pounds

Unto my Son Samuel Sumner the sum of Eighty pounds

Unto my Son John Sumner the sum of One hundred pounds

Unto my daughter Mary Sumner the sum of One hundred pounds

Unto my said Son James Sumner the sum of One hundred pounds

And unto my Son Francis Sumner the sum of Forty pounds

All which said several legacies I will shall be paid to them and each of them my said Children within twelve months next after my decease by my Executrix and Executor hereinafter named

And as to all the Residue of my Personal Estate and Effects whatsoever and wheresoever and of what nature kind or quality soever the same may be I Give and bequeath the same and every part thereof (subject to the payment of my just debts legacies funeral and Testamentary expences) unto my said Wife Margaret Sumner and my said Son William Sumner their Executors administrators and assigns in equal Shares and proportions

And I humbly Request my Landlord The Most Noble John Henry Duke of Rutland to admit my said Wife Margaret Sumner and my said Son William Sumner joint Tenants to the Farm I now Rent or hold under his Grace

And Lastly I do hereby nominate constitute and appoint my said Wife Margaret Sumner and my said Son William Sumner joint Executrix and Executor of this my last Will and Testament hereby Revoking all former Wills by me made

In Witness whereof I have hereunto set my hand and seal this Sixteenth day of August One thousand eight hundred and fourteen

Signed sealed published and declared by the said Samuel Sumner the Testator as and for his last Will and Testament in the presence of us who have at his Request in his presence and in the presence of each other set our hands as Witnesses to the due execution thereof The erazures in the body of this Will being made before the execution

Let a probat be granted to William Sumner of Hose in the County of Leicester one of the Executors within named with power of making the like Grant to Margaret Sumner of the aforesaid Parish widow the Executrix named in the Will of Samuel Sumner who died at Hose July the sixth 1821

He being duly sworn as well to the faithful execution of the Will as that the Testators goods Chattels & Credits as they were at his death without deducting any debts owing by him therefrom did not amount in value to the sum of three hundred pounds

17 December 1821 Probat decreed by the Revd George Berkeley Mitchell MA Surrogate to the Commissary & same day probat passed the seal
