Ann Sharp of Kinoulton then Long Clawson 1879 Will

This is the last Will and Testament of me Ann Sharp of Kinoulton in the County of Nottingham Widow

First I direct all my just debts funeral and Testamentary expenses to be full paid

I give and bequeath unto my friend George Goodwin of Langar in the County of Nottingham Grazier the Legacy or sum of Nineteen pounds and nineteen shillings

I give devise and bequeath All that my Close or Ground inclosed situate in the Lordship of Asfordby in the County of Leicester containing by estimation Nine acres and a half and known by the name of “Robbinridge Close” with the appurtenances belonging thereto in the occupation of Stephen Lee And also all that my Close or Ground inclosed situate in the Lordship of Scalford in the County of Leicester containing by estimation Twenty one acres or thereabouts called or known by the name of “Newtons Close” with the appurtenances belonging thereto in the occupation of Charles Wright Also all those my two Closes of Land or Ground inclosed situate in the Lordship of Nether Broughton in the County of Leicester containing by estimation Twelve acres and a half or thereabouts with the appurtenances thereto belonging in the occupation of William Lovett And also all my Stock Cattle Chattels money securities for money and all other my personal Estate and Effects of whatsoever nature or kind the same may be and consist of and wheresoever situate unto the said George Goodwin of Langar aforesaid and my Son Richard Sharp of Fawley in the County of Hants Grazier their heirs and assigns

Upon trust that they the said George Goodwin and Richard Sharp and the Survivor of them and the heirs executors administrators and assigns of such Survivor (hereinafter called the Trustees or Trustee) do and shall as soon as conveniently may be after my decease call in and convert into money such part of my personal Estate as may not at the time of my decease consist of money And also absolutely sell the said Closes of Land hereditaments and premises hereinbefore mentioned either by Public Auction or Private Contract with full power to buy in and rescind any contract for Sale and to re-sell without being responsible for any loss occasioned thereby and to do all such acts for effectuating any such sale as they or he shall think fit and for facilitating any such sale or sales of such Real Estate and the indemnity of the purchaser or purchasers I declare that the receipt or receipts of the said Trustees or the Survivor of them or the heirs executors administrators or assigns of such Survivor shall be good and sufficient discharges for the purchase money therein expressed to be received and that the person or persons paying the same his her or their heirs Executors administrators or assigns shall not be liable to answer for any loss or misapplication thereof and with the monies to arise from the Sale or Sales of the before mentioned Real Estate and the calling in and conversion into money of my Personal Estate (after payment of all expenses incident to the trusts of this my Will and the Legacy hereinbefore by me bequeathed) I direct my said Trustees or Trustee to divide the same into seven equal parts or shares

And as to Six seventh parts or shares thereof to pay and divide the same unto and equally between my six children namely Richard Sharp, Ann Margaret the Wife of George Swain, Thomas Sharp, Mary the Wife of John Henry Wilson, Taylor Sharp and Emma the Wife of John Christian share and share alike to whom I give and bequeath the same absolutely

Provided and I do hereby expressly direct that in case of any of my said Sons or Daughters shall die in my lifetime leaving lawfull issue then and in that case I give the share or shares of him her or them so dying unto and to be equally divided between his or her issue if more than one share and share alike such issue only to take amongst them what would have been their deceased Parents share if living

And as to the remaining one seventh share of and in the said monies I direct my said Trustees or Trustee to stand possessed thereof in trust for all the children of my deceased Son John Sharpe to be vested interests in them when and as they respectively attain their respective ages of Twenty one years and in the meantime to apply the interest Dividends and yearly income of their respective shares towards their maintenance education and advancement in such manner as my said Trustees or Trustee may think proper

Whereas I believe some of my said children have borrowed and raised by way of Mortgage or otherwise certain sums of money on their shares in certain property bequeathed to them under the Will of my late Husband Now I hereby expressly direct that in case such shares respectively should not be sufficient to discharge the sum or sums of money so borrowed and charged upon them respectively together with any Interest the said Trustees or Trustee of this my Will shall pay and make good such deficiency or deficiencies respectively out of the share or shares hereby respectively bequeathed to such children under this my Will

And I declare that the Trustees or Trustee for the time being of this my Will shall be chargeable only with such monies as they or he respectively shall actually receive and shall not be answerable the one for the other of them, nor for any banker, broker or other person in whose hands any of the trust monies shall be placed nor for the insufficiency of any stocks funds shares or securities nor otherwise for involuntary losses

And that the said Trustees or Trustee for the time being may reimburse themselves or himself out of the monies which shall come to their or his hands under the trusts aforesaid all expenses to be incurred in or about the execution of the aforesaid trusts

I devise and bequeath all the estates vested in me by way of Mortgage with the appurtenances unto the said George Goodwin and Richard Sharp their heirs executors and administrators according to the nature of the same premises subject to the equity of redemption subsisting therein respectively but the money secured on such mortgage to be considered as part of my Personal Estate

I direct that the sections contained in part three of an Act of Parliament entitled an Act to give to Trustees Mortgagees and others certain powers now commonly inserted in Settlements Mortgages and Wills shall be considered as applicable to this my Will

And I hereby appoint the said George Goodwin and Richard Sharp to be Trustees and Executors of this my Will hereby revoking all others by me at any time heretofore made

In Witness whereof I the said Ann Sharp the Testatrix have to this my last Will written on this and the two preceding sheets of paper to each of which I have set my hand this First day of December One thousand eight hundred and sixty eight

Proved at Leicester on the Sixth day of May 1879 by the Oaths of George Goodwin and Richard Sharp, the Son, the Executors to whom administration was granted

The Testatrix Ann Sharp was formerly of Kinoulton in the County of Nottingham and late of Long Clawson in the County of Leicester Widow and died on the Seventeenth day of April 1879 at Long Clawson aforesaid
