James Dixon of Harby 1835 Will

The last Will and Testament of James Dixon Farmer of the Parish of Harby in the County of Leicester dated this 27th day of April 1830

First I will to my Brother William Dixon the Land and Houses that I bought of him in the Parish of Billingham Lincolnshire

Second I will that my Lands and Tenements which I bought in the Parish of Harby in the County of Leicester be sold and all my Money out on Mortgage or elsewhere be called in and all my debts paid and what there is remaining when all expence is paid to be equally divided between my Mother Mary Dixon my Sister Mary Dixon my Brother William Dixon my Brother John Dixon my Brother George Dixon my Brother David Dixon and my Brother Thomas Dixon

And I name by Brother William Dixon and my Brother George Dixon Trustees to see it executed as the Will directs

In the Prerogative Court of York In the Goods of James Dixon deceased Appeared personally John Adcock of Harby in the County of Leicester Farmer and George Musson of the same place Carpenter and made oath that they know and were acquainted with James Dixon late of Harby aforesaid Farmer deceased for several years next before and until the time of his death and with his manner and character of handwriting and subscription having often seen him write and subscribe his name and having now with care and attention viewed and inspected the paper writing hereunto annexed marked with the Letter A and bearing date the 27th day of April 1830 purporting to be and contain the last will and Testament of the said deceased they those deponents say they do verily believe the whole body … and contents of the said paper writing to be the own proper handwriting of the said James Dixon deceased and of no other person whatsoever

… the fourth day of April in the year of our Lord one thousand eight hundred and thirty five the said John Adcock and George Musson were duly sworn to the truth of this Affidavit at the Town of Nottingham Before me George Wilkins DD Surrogate

In the Court of the Commissary of the Lord Bishop of Lincoln for the Archdeaconry of Leicester Appeared personally John Adcock of Harby in the County and Archdeaconry of Leicester Farmer and Grazier and George Musson of the same place Carpenter and each speaking for himself only and not one of them for the other of them maketh oath and saith that they knew and were well acquainted with James Dixon late of the Parish of Harby aforesaid Farmer deceased for some years before and up to the time of his death which as these Deponents have been informed and believe happened in the month of July last past and that during such the time of their acquaintance with the said deceased they have frequently seen him write and thereby became well acquainted with his manner and character of handwriting and subscription and having now carefully viewed and inspected the paper writing hereunto annexed marked with the letter (A) beginning thus “The last Will and testament of James Dixon Farmer of the Parish of Harby in the “County of Leicester” ending thus “Witnessed by me” and then subscribed “James Dixon”.  They these Deponents make oath and say that the whole series and contents of the said paper Writing beginning ending and subscribed as aforesaid are all of the proper hand Writing of the said James Dixon deceased according to the best of the knowledge information and belief of these deponents

On the 24th day of Decr 1834 the said John Adcock and George Musson were duly sworn at Leicester in the County of Leicester to the truth of the aforegoing Affidavit

Let a Probate be made to William Dixon of Cropwell Butler in the County of Nottingham Farmer and Grazier one of the Executors named in the Will of the deceased with power of making the like Grant to George Dixon of Cotgrave in the same County Plumber and Grazier [sic] the other Executor when he shall apply for the same

He the said William Dixon having been first duly sworn as well to the faithful Execution of the Will as that the Testators Goods Chattels and Credits lying within the Diocese of Lincoln without deducting any debts due and owing by the deceased therefrom do not Amount in value to the sum of Six hundred Pounds
